Electricity supply contract at the consumption points related to the objectives achieved within the project" Integrated Waste Management System in Iasi County "

The total estimated energy quantity to be delivered within 12 months is 10 000 MWh composed of:

- Integrated Waste Management Center in Iasi County, -Tutora commune - 8, 300 MWh,

- Ruginoasa transfer and sorting station, Iasi county - 1, 620 MWh,

- Baltati transfer station - Baltati commune - 80 MWh

The supply period is 12 months and will produce effects from date of termination of the contract with the current supplier.

Estimated value of the contract: 3, 623, 400 RON without VAT.

Estimated value excluding VAT: 3, 623, 400 RON.-reasons for exclusion:

Participating economic operators (sole bidder, leader, associate, third party, subcontractor) should not be found in the situations provided by art. 164, 165 and 167 of Law no. 98 / 2016.

The participating economic operator (sole bidder, leader, associate, third party, subcontractor) has the obligation to complete and present the initial DUAE as the first proof of non-(see DUAE User Guide developed by ANAP available at www.anap.gov.ro). The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted at the request of the contracting authority, only by the bidder ranked first after applying the criterion-according to art. 196 of the Law no. 98 / 2016.

Requirement no. 1. An economic operator (individual bidder, member of an association, subcontractor, third party claimant) or any person who is a member of its board of directors / management, management or supervisory bodies, or who has the power to represent, control within it is not in itof the situations referred to in art. 164 par. (1) of the Law no. 98/2016, on grounds of exclusion regarding criminal convictions.

The Contracting Authority is entitled, according to the provisions of art. 166 par. (1) of the Law no. 98/2016, in exceptional circumstances and for overriding reasons of general interest, such as public health or environmental protection, do not exclude an Econo Operatorsmall-scale enterprise in the above situations.

Documentary evidence: the criminal record of the economic operator and the members of the management, management or supervisory body of that economic operator or of those having the power of representation, decision-making or control within it, as it results from the certifying certificate issued by the ONRC / constitutive document, or other documentsequivalents issued by the competent authorities issued by that country in the case of foreign bidders. 2: The economic operator (individual bidder, member of an association, subcontractor, third party supporter) is not in any of the situations mentioned in art. 165 par. (1) and paragraph (2) of the Law no. 98/2016, on the grounds for exclusion regarding the payment of taxes, or-of social security contributions.

Reasons for exclusion for breach of obligations to pay taxes, taxes and contributions to the state budget (referred to in art. 165 par. (1) and paragraph (2) of the Law no. 98/2016] applies to Economic Operators for which this violation has been established by a court decision or an administrative decision having a final and ain accordance with the law of the State in which the economic operator is established or for which the Contracting Authority can demonstrate by appropriate means the breach of obligations to pay the taxes, duties or contributions to the general consolidated budget

The economic operator is not excluded from the procedure, if he made the payment of these obligations or turned off obligations by other means of extinguishing or benefiting from payment on payment or other facilities for extinguishing these obligations, under the conditions specified in art. 165 par. (3) of the Law no. 98/2016, before the Contracting Authority formulates the exclusion decision.

By way of exception to the provisions of Art. 165 par. (1) and (2), an economic operator is not excluded from the award procedurewhen the amount of taxes, duties and contributions to the general consolidated budget due and outstanding is less than RON 10 000.
