Electricity Purchase for All Workspaces of the Society

1) Exclusion Reasons. Bidders, subcontractors and third partiesshould not be found in the situations provided for in art. 177, 178 and 180 of Law no. 99/2016 on sector acquisitions. Way of completing: the initial completion and presentation of the DUAE by the economic operators participating in the award procedure (tenderers, including associates / subcontractors and third parties) as the first proof of non-compliance in the dit's exclusion. The bidder ranked first after application of the award criterion on admissible tenders will prove the non-compliance in the exclusion situations by presenting, at the request of the contracting entity, the following information and documents:

(a) tax attestation certificate on fiscal / a tax attestation tax certificate and you(b) the criminal record certificate of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of those having the power of representation, decision-making or control within it, as evidenced by the certifying certificate issued by ONRC / ac(c) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 179 par. (2), art. 180 par. (2), art. 184 of Public Procurement Act 99/2016, (d) other documents requested by the contracting entity, as the case may be.

Foreign legal persons shall present, in a legible copy the mention "according to the original"-the supporting documents issued by the authorized institutions of the country of residence, accompanied by the authorized translation into Romanian. The manner in which the fulfillment of the requirement can be demonstrated: completion of the DUAE, according to art. 202 par. (1) lit. a) of Law no. 99/2016. The supporting documents proving the fulfillment of the undertaken by the completion of the DUAE are to be presented on the groundthe contracting entity, only by the first ranked bidder in the intermediate rankings drawn up at the completion of the tender evaluation; 2) Declaration on own responsibility regarding the non-existence of the conflict of interests, as regulated by the exemplary title in Art. 73 of Law no. 99/2016. Mode of accomplishment: Form no. 3. Form no. 3 will be prby all economic operators (bidders / subcontractors / thirds supporters) with the DUAE. In the case of a group of economic operators submitting a joint bid, each member of the group has the obligation to submit this statement (each member of the association, and each proposed subcontractor as well as supporting third parties). Economic operatorswho submit the offer must prove a form of registration under the law of the country of residence, as well as being legally constituted, that they are not in any of the situations of cancellation of the establishment and have the professional capacity to carry out the activities covered contract. General information on the total business figures of the economic operator on the lastthousands of 3 years (2015, 2016 and 2017). The average of the total business turnover is equal to or higher than 14, 800, 000 RON. Relevant Documents: The balance sheet or balance sheets recorded at the competent bodies, the audit report, as the case may be, or any other equivalent documents.

It will complete the DUAE, in accordance with Notification No. 240/2016. Instructions on how to complete DUAE are available at www.e-licitatie.ro. Failure to comply with the offer will lead to the rejection of the bid as unacceptable, in accordance with the provisions of art. 143 par. (2) lit. b) from H.G. no. 394 /2016. According to art. 205 para. (1) of the Law no. 99/2016, the contracting entity has the right to require at any time that bidders submit all or some of the supporting documents as evidence of the information contained in the DUAE at any time during the course of the procedure. According to art. 205 para. (2) of the Law no. 99/2016, before the award of the sectoral contract, the contracting entityto request the tenderer ranked first, after application of the award criterion, to submit updated supporting documents demonstrating the fulfillment of all the qualification and selection criteria, according to the information contained in the DUAE. Those relevant documents shall be valid on the date of their request by the contracting entity.
