1.1. The participant shall hold a license issued by the CESR for "trading in electricity" in accordance with Article 39, paragraph 1, item 5 of the Energy Act (EE) and / or "production of electricity" pursuant to Art. 39, para. 1, item 1 of the Energy Act (EE), including rights and obligations related to the activity "Balance Coordinatorin accordance with Article 39 - 5 of the Energy Act .. The form of the guarantee may be a sum of money, a bank guarantee or insurance that ensures performance by covering the contractor's liability. The terms and conditions for the retention or utilization of the guarantee are set out in the draft contract.
