Supply of electricity and services associated with EmiliAmbiente for the year 2019 - CIG 761092914D

The contract relates to the supply of electricity and services associated with EmiliAmbiente for the calendar year 2019

Main Site: Province of Parma

Supply of electricity for a total presumed amount (excluding losses) for the entire contract period of about MWH 15, 340, 724 (diconsi megawatt hour fifteen thousand three hundred forty / 724) distinct and distributed as reported in Annex 1A to the Competition Regulations

The value of the supply based on the tender and EUR 825 626.98 (said eight hundred and twenty-five thousand six hundred and twenty-six euros / 98 euros); this amount is determined by the basic unit prices of electricity (PUB) placed on the basis of the auction multiplied by the respective quantelectricity (increased by losses by voltage level), net of supplementary unit prices (PUI).

Supply will run from 00:00 on 01.11.2019 to 24.00 on 31.12.2019

Participants in custody procedure must possess pursuant to paragraph 3 of the art. 83 of Legislative Decree 50/2016:

a) entry in the register of the chamber of commerce, industry, artborn and agriculture or in the register of the provincial commissions for the craft, or with the competent professional orders, for activities related to the subject of the contract (supply of electricity);

b) to the citizen of another Member State not resident in Italy and proof of registration is required, according to the procedures in force in the State of residence, in one of the professional registers or commerciali referred to in Annex XVI of Legislative Decree No. 50/2016, by sworn declaration, or according to the procedures in force in the Member State in which it is established or by attestation, under their own responsibility, that the certificate produced has been issued by a professional or business registers established in the country in which they reside.

c) entry in the special list of the big onesthe Authority for electricity, gas and water services for at least one year prior to the expiry date of the call for tenders.

1. The contract is awarded pursuant to art. 94, paragraph 1 of Legislative Decree 50/2016

2. The contracting authority may decide not to make the award if no offer is convenient or suitable in relation to the subject of the contract.

3. For offers-abnormally low, it will proceed according to the art. 9 of the Disciplinary and of the art. 97 of Legislative Decree 50 / 2016.

4. All the declarations requested:

a) are issued pursuant to article 47 of the D.P.R. n. 445 of 2000, in plain paper, with the signing of the declarant (legal representative of the bidder or another subject with the power to contractually commit the bidder himself), in lingua Italian or accompanied by sworn translation.

b) must be accompanied by a photocopy of a document of recognition of the registrant, in the course of validity; for each registrant and only one copy of the identification document is sufficient, even if there are several declarations on separate sheets;

c) must be signed by the bidders, in any form of participation, singoli, raggruppati, consorziati, auxiliary companies, each for their own competence;

5. The obligation to comply with art. 5 of the law n. 136/2010 and the protection of workers in contractual and union matters.

6. Partial bids are not allowed.

7. Amounts must be expressed in euro, in number and in letters.

8. The right of access to the tender documents, to sensi of Law 241/90, will be allowed in the ways and times referred to in art. 53 of Legislative Decree 50/2016. If the request comes from RTI, it must be signed by the legal representative of the parent company.

9. The shortcomings of any formal element of the application, and in particular, the lack, incompleteness and any other essential irregularities of the elements and of the DGUE, with the exception of those afferento the economic offer and the technical offer, can be remedied through the procedure of preliminary investigation as per art. 83, paragraph 9 of the Code.

Deficiencies of the documentation that do not allow the identification of the content or of the person responsible for it are essential irregularities.

Irregularity essential and remediable where it is not accompanieda substantial deficiency of the requirement to which the omitted or irregularly produced documentation was finalized. The subsequent document correction and integration is permitted where it allows to certify the existence of pre-existing circumstances, ie requirements for participation and documents / elements accompanying the offer [for example:certain date prior to the expiry date of the bids, etc.] Failure to meet the prescribed requirements can not be remedied by means of preliminary investigation and will result in exclusion from the tender procedure. For the purposes of the amnesty the contracting authority assigns a term to the competitor of 7 days for the necessary declarations to be made, supplemented or regularized, indicating the contents ethe subjects who must make them. In the same term the competitor is required to inform the contracting authority of any intention not to use the preliminary aid.

In case of communication of the competitor of the will not to avail the preliminary aid and, in any case, in case of unnecessary term, the contracting authority proceeds to the exclusion of the competitor from the prthanks
