Electricity Supply Framework Agreement according to the Tasks:

- Average Minimum Amount For Frame Agreement: 5 361 361 KWh,

- Minimum Low Voltage for the Cadence AgreementRg: 15 493 518 KWh,

- Maximum frame rate under the framework agreement: 6 552 775 KWh,

- Maximum under-voltage under the framework agreement: 18 936 522 KWh.

Subsequent contracts will usually be awarded annually, and the minimum and maximum quantities are specified below:

- Medium Minimum Voltage for a Subsequent Contract: 1 340 340 KWh,

- Low Minimum Quantityrelated to a subsequent contract: 3 873 380 KWh,

- Maximum mean voltage under a subsequent contract: 1 638 193 KWh,

- Maximum low voltage under a subsequent contract 4 734 131 KWh.

For each subsequent contract be awarded, the contracting authority will consult in writing the promising suppliers signing the framework agreement by submitting uinvitations to participate in re-casting which will contain information on the quantities and specific items to be covered by the contract to be awarded, the award criterion, the submission of the tender and the closing date for the submission of the tender. only the financial offer can be improved, the technical criterion being the one set in the first stagea.

Tenders will be submitted in writing for all quantities requested and their content will remain confidential until the deadline for opening has expired

The contracting authority will award the contract to the tenderer who submitted the best financial offer based on the criterion of the award specified in the awarding documentation.

Bidders, third parties and subcontractorsthe contractors must not find themselves in the situations provided by art. 59, 60, 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the end of the evaluation of the tenders. These documents may be:

1) Finding certificates regarding the lack of outstanding debts regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.)(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision-making or control therein; results from the certifying certificate issued by the ONRC / constitutive act; 3) as the case may be, documents provingthat the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; 4) other editorial documents, as appropriate.

Economic operators (tenderers / associates / subcontractors / third-party supporters) have the obligation to file the UAE with the offer, subject to the rejection of the latter as unacceptableaccording to art. 137 par. (2) lit. b) of GD no. 395 / 2016.

Note: The following documents will be submitted together with the DUAE: firm commitment of the third party to support the way in which its sustainability, subcontracting agreement and / or association agreement will materialize, as the case may be



1) Economic operators submitting a tender must prove a form of registration in cothe law of the country of residence, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that he has the professional capacity to carry out the activities covered by the contract (the professional capacity referred to in the ONRC statement issued by the investigator must match the object• The requirement applies also to subcontractors and / or third party supporters who fill in the information related to their situation at the level of a distinct DUAE • The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the procedure assignment with information related to their situation.

The supporting documents asto prove the fulfillment of the assumed by completing the DUAE, respectively the certificate issued by the ONRC or for the foreign tenderers, equivalent document issued in the country of residence (this document will be submitted translated into Romanian by an authorized translator) to be submitted at the request of the authority only by the bidder ranked I in the interim ranking(2) The economic operators submitting the tender must prove that they hold the license for electricity supply issued by A.NR.E. in accordance with Law no. 123/2012 of electricity and natural gas and with the A.N.R.E. no. 12/2015 on the approval of the Regulation for the granting of licenses and authorizations in the energy sectorNote: If the validity of the license issued by ANRE expires during the performance of the contract, the tenderer designated as the winner has the obligation to submit to the contracting authority within 3 working days after its expiration, the copy of the new license [...] details on www.e-licitatie.ro

Requests for clarifications and bids are only sent to SEAP-submitting requests for clarification regarding the awarding documentation, the economic operators will register in SEAP (www.e-licitatie.ro) as economic operator according to the provisions of art. 5 par. (1) of H.G. no. 395/2016 and will transmit the requests taking into consideration the deadline for reply of the contracting authority stipulated in art. 160 161 of Law no. 98 / 2016.

Communication on the resultthe procedure will be transmitted both through SEAP (with / -) and through one of the following ways of communicating: Email to the email address indicated in the DUAE.

For viewing the awarding documentation uploaded in SEAP, it is necessary that economic operators to own / install on the workstation, the application that allows verification of the electronic signature and document viewingelectronic signatures (available on the websites of electronic signature providers). The maximum allowed size of uploaded SEAP files is max. 40 Mb, their number being unlimited
