Electricity Purchase at Calarasi Municipality

According to the provisions of art. 44 par. (2) and paragraph (3) of the Public Procurement Act no. 98/2016, with its subsequent modifications and completions, the Municipality of Calarasi, acting as contracting authority, jointly undertakes the acquisition of furElectricity supply at the level of the Municipality of Calarasi acting both in its own name and in the name and on behalf of all Public Services and educational units under the administration of the Local Council of Calarasi Municipality, according to Annex no. 1 of the Task Force.

Provide low voltage and medium voltage power for 236 consumers located on-Calarasi district, according to Annex 1 of the Tender Specifications, of which:

Calarasi City Hall:

- 106 consumers of electric energy for public lighting,

- 36 consumers of low voltage electricity,

1 consumer of medium voltage electric power.

The units subordinated to the City Hall of Calarasi:

- 92 consumers of low voltage electricity,

- 1 consumato• The supplier will ensure the supply of electricity and the provision of services and consumption points, other than those listed in Annex 1 to the tender specifications, which will be put into operation following the finalization of the ongoing investment works .

I. Bidders, supportive third parties and subcontractors MUST not find themselves in the situationprovided in art. 164, 165 and 167 of Law no. 98 / 2016.

Modalities of implementation and applicability in the procedure:

The economic operators participating in the procedure (tenderer, associate, third party and subcontractor) will complete and present the DUAE with the information related to their situation.

The supporting documents / proof that the fulfillment of the criteria qualification and selectionas they have been declared and assumed in the DUAE, shall be mandatory submitted by the tenderer placed in the first place after the application of the award criterion, at the request of the contracting authority

Documentary evidence / proof that the fulfillment of the undertaken by completing the DUAE: a) tax certification (debts to the general consolidated budget) and tax and tax certificate(local debts to local budgets) or equivalent documents showing that the tenderer / third party / subcontractor has no overdue debts at the time of their presentation. b) documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 paragraph (2), art. 167 para. (2), art. 171 of the Public Procurement Act 98/2016

c) criminal recordl judiciary of the economic operator and of the members of the management, management or supervisory body of the respective economic operator, or those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by ONRC / the constitutive document; d) other editorial documents, as appropriate.

If in the country of origin or inthe country in which the tenderer / third party / subcontractor is established does not issue documents of the nature mentioned above or the documents do not cover all the situations stipulated in art.164, 165 and 167, the contracting authority has the obligation to accept the declaration under its own responsibility, a statement authentic date before an administrative or judicial authority or an associateprofessional body with competence in this respect. The economic operators participating in the procedure (tenderer / associate / leader / subcontractor / third party) must not be in a situation of conflict of interest and / or unfair competition.

Mode of completeness in the procedure:

Economic operators participating in the procedure bidder / associate / leader / subcontractor / third party supporter)will present the DUAE form and the Declaration on non-compliance in the situations provided in art. 60 of Law 98/2016 Form no. 6.

If the tenderer demonstrates his economic and financial situation by invoking the support given by another person, then he / she has the obligation to prove his / her support by submitting a firm commitment of the person concerned. The person who provides the financial support should not be in the situation that leads to exclusion from the procedure-according to the provisions of art. 164, art. 165 and art. 167 of Law 98 / 2016.

The average global annual turnover for the last 3 years, respectively 2015, 2016, 2017, will be at least 6, 000, 000 RON.

1) If the first ranked offers have equal prices, the contracting authority will request re-allocation, in order to divide the bids. The date for submission of tenders will be sharedas in the request sent by the evaluation committee; 2) During the procedure for awarding the public procurement contract, all clarifications on the awarding documentation, the erasures, the notifications, the information regarding the extension of the validity of the tenders, etc. will be made by posting them in SEAP; 3) At the request of the contracting authority, the tendererafter the application of the award criterion on the admissible tenders, will present the supporting documents proving the fulfillment of the requirements. These will be uploaded to SEAP, signed with an extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider under the terms of the law. Subsequently, by the date of signing the contract, they will bemade in original form / certified copy / legible copy with the mention "according to the original" at the headquarters of the contracting authority.
