The Employer allows partial bids.

Main Site: Wieliczka, POLAND.

1. As part of this contract, the Contractor undertakes to sell and deliver Employer for payment (delivery) electrical materialsOther general-purpose materials, the type and maximum quantities of which are set out in Annex 1 to the Specification of Essential Terms of Order available at (https://kopalniawieliczka.ezamawiacy.pl/).

2. As part of the order, the Employer undertakes to purchase electrical materials and materials of general use specified in Annex 1 to the Essential Specificationsh Terms and Conditions, worth 60% of the total price indicated in the Contractor`s offer. The remaining amount of electrical materials for general use, with a value of 40% of the total price, the Purchaser will purchase depending on the needs (option right).

3. Terms of delivery:

1) electrical materials of general use will be delivered by the Contractor on behalf of the Employer, successively, in batches, over the duration of the contract in a maximum of 50 batches;

2) the quantity and type of electrical materials of general use materials that will be delivered in one lot depends on the needs of the Employer and will be specified in a written order;

3) orders for the supply of electrical materials commonly used materials will be submitted and forwarded to the Contractor by fax or e-mail4) the Contractor undertakes to provide electrical materials for general use listed in Annex 1 to the ToR within the maximum period specified in column VII of Annex 1 to the ToR from the date of submission of the Contractor`s order;

5) on the preparation of the ordered delivery of electrical materials for general use, the Contractor will be obliged to notifyordering by phone or e-mail, not later than one day before the required delivery date;

6) place of delivery warehouse of the Wieliczka Salt Mine SA, 32-020 Wieliczka, POLAND, Kinga Park 1;

7) delivery time to the Salt Mine "Wieliczka" is established on business days from Monday to Friday between 7.00 13.00;

8) The Contractor is obliged to provide materials elelectrical materials of general use at their own expense and at their own expense;

9) with the supply of electrical materials of general use materials, the Contractor should provide:

a) warranty documents,

b) documents listed in column V of Annex 1 to the ToR,

c) proof release of the product outside the WZ or VAT invoice.

4. The Contractor is obliged to provide the Employer with a guarantee forshielded electrical materials, materials of general use for a period of 12 months from the date of delivery of a particular batch to the Ordering Party. ).

Applies to Part I and Part II of the contract.

I. Part VI of the ToR:

1. According toArt. 22 paragraph 1 of the Act on awarding a contract may be applied by Contractors who meet the conditions regarding:

1) competence or authorization to conduct specific professional activity, entry to one of the professional or trade registers kept in a Member State of the European Union in which the contractor has its registered office, set out in Annex XI to Directive 2014/24 / U or meetother requirements set out in this Annex or entry in the Central Register and Information on Economic Activity;

2) economic or financial situation in accordance with Section III, point 1.2) of this notice;

3) technical or professional capacity in accordance with Section III, point 1.3) of this notice .

2. The contractor may rely on z to confirm compliance with the conditions for participation in the proceduretechnical or professional difficulties or the financial or economic situation of other entities, regardless of the legal nature of the legal relations which it has with him. In this case, the Contractor must prove that by carrying out the contract he will have the necessary resources of these entities, in particular together with the offer presenting the undertaking of these entities to make available to himnecessary resources for the implementation of the contract. The Employer will request the submission of relevant documents, in accordance with - 9 of the Regulation of the Minister of Development of 26.7.2016 regarding the types of documents that the Employer may request from the Contractor in the procurement procedure and documents indicated in Part VIII of the Specification, referring to entities whose capabilitiesThe contractor will rely. If the technical or professional ability or economic or financial situation of the entity referred to above does not confirm the fulfillment by the Contractor of the conditions for participation in the proceedings or there are grounds for exclusion for these entities, the Employer shall request that the Economic Operator within the time limit specified by the Employer:

1) replaces this entity by another entity or entitymi or;

2) undertook to personally perform the relevant part of the contract, if it demonstrates the required technical or professional capacity or financial or economic situation.

3. In the event of a change or resignation from the subcontractor referred to in point 2, the Contractor shall be obliged to demonstrate to the Employer that the proposed other subcontractor or Contractor independently meets the conditions for participation in the progressnot less than a subcontractor, whose resources the Contractor relied on during the contract award procedure.

II. Part VII of the ToR grounds for exclusion:

1. The Awarding Entity will exclude Contractors who are subject to the circumstances referred to in Art. 24 paragraph 1 of the Act, subject to the provisions of Art. 24 paragraph 7 11 of the Act.

2. The Awarding Entity will exclude Contractors referred to in Art. 24 paragraph 5 point 1 8 of the Act, subject to the provisions of Art. 24 paragraph 8 9 of the Act.

3. The Awarding Entity, before awarding the order, will call the Contractor, whose tender will be the highest, to submit within the prescribed period, not shorter than 10 days, the following statements or documenttow (valid as at the date of submission) confirming that the conditions for participation in the procedure have been met and no grounds for exclusion, subject to points 9 and 10 in Part VIII of the ToR.

III. EAT:

1. In order to initially confirm that the conditions for participation in the procedure have been met and there are no grounds for exclusion, the Contractor is required to submit a declaration in the form of a uniform European documentorder. EAT submits in electronic form with a qualified electronic signature.

2. The Employer indicates that the Contractor may limit himself to completing only section α in Part IV of the EAT and does not need to complete any of the other sections in Part IV of the EAT.

The contracting authority, before awarding the contract, will call the Contractor whose tender is best rated to submit within the prescribed period, not less than 10 days, the following statements or documents confirming the fulfillment of the conditions for participation in the procedure and no grounds for exclusion:

W regarding no grounds for exclusion:

a) information from the National RegisterCriminal within the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act and regarding conviction for an offense against imprisonment, to the extent specified in art. 24 paragraph 5 point 5 or 6 of the Act, issued not earlier than 6 months before the deadline for submission of bids;

b) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with tax payments, issued not inmore than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the relevant tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or suspension of execution of the decision in fullthe authority;

c) a certificate from the competent organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting offers, or another document confirming that he will performwca entered into an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments provided for by law or withholding in full the execution of the decision of the competent authority;

d) an excerpt from the relevant register or from Central Business Register and Information, ifseparate provisions require an entry in the register or records to confirm the absence of grounds for exclusion under Article 24 paragraph 5 point 1 of the Act;

e) the Contractor`s statement on the lack of a judgment against him as a preventive measure of the prohibition to apply for public procurement;

f) the Contractor`s statement on the lack of a final judgment of the convicting court for the offenseamount or a fine to the extent specified in art. 24 paragraph 5 point 5 or 6 of the Act;

g) a statement of the Contractor about the lack of issuing to him the final administrative decision on violation of obligations arising from the provisions of labor law, environmental protection law or social security provisions in the scope specified in art. 24 paragraph 5 point 7 of the Act;

h) the Contractor`s statement of non-paymentlocal taxes and fees, referred to in the Act of 12.1.1991 on local taxes and fees (Journal of Laws of 2016, item 716);

i) the Contractor`s statement that he has not issued a final court judgment or final decision administrative settlement of arrears with the payment of taxes, fees or social security or health insurance contributions or in the event of such a judgment or decisiondocuments confirming the payment of these receivables together with any interest or fines or conclusion of a binding agreement regarding the repayment of these receivables;

j) the Contractor`s statement on belonging or not belonging to the same capital group; in the case of belonging to the same capital group, the Contractor may submit, together with the declaration, documents or informationit confirms that links with another Contractor do not lead to a distortion of competition in the proceedings.
