1. The subject of the order is the delivery of the assortment of small equipment for the A-piece of the workshops of the School of Power and Energy in Olsztyn, al. M. J. Piłsudskiego 61.

The subject of the order is the supply of the assortment of small equipment for the A-piece of the workshops of the School of Power and Energy in Olsztyn, al. M. J. Piłsudskiego 61 in the scope of: hand tools, measuring tools, assortment of health and safety, meters, power tools equippede laters. The official description of the subject of the order has been specified in Annex 4 to the ToR. The description of the subject of the order should be treated as the minimum requirements of the Ordering Party, with the exception of parameters, which fulfillment is required in certain ranges of values. Each assortment (in quantity greater than one) covered by a given part of the order must be of the same type

1. For orderingia Contractors who are not subject to exclusion can apply to the public.

2. The contractor is excluded from the contract award procedure in respect of which any of the circumstances referred to in Article 24 sec. 1 point 12-23 of the Act. The ordering party does not specify the conditions for participation in the proceedings in question.

3. Additionally, pursuant to art. 24 sec. 5 points 1, and point 8 of the Act, Zathe speaker will exclude from the proceedings the Contractor:

1) in relation to which the liquidation has been opened, the court approved in the restructuring proceedings is expected to satisfy the creditors by liquidating his property or the court ordered the liquidation of his property pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (ie, Journal of Laws of 2017, item 1508, as amended)b whose bankruptcy was announced, with the exception of the Contractor who, after the bankruptcy, concluded an arrangement approved by a final court decision, if the arrangement does not provide for satisfying the creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of his property pursuant to art. 366 para. 1 of the Act of 28 February 2003 on Bankruptcy Law (consolidated text: Journal of Laws of 2017, item 2344, as amended);

2) kthe course has violated obligations regarding tax payments, fees or social security or health insurance premiums, which the Employer is able to demonstrate by means of appropriate evidence, except in the case referred to in paragraph 1 point 15 of the Act, unless the Contractor has paid the due taxes, fees or social security or health insurance contributions with interest or finesor entered into a binding agreement regarding the repayment of these claims.

4. In order to confirm initially that there are no grounds for exclusion, the Contractor shall submit relevant declarations in the Single European Order Document (Appendix 3 to the Terms of Reference) drawn up in accordance with the standard form set out in the European Commission Implementing Regulation issued on the basis of art. 59 par. 2 d2014/24 / EU, hereinafter referred to as "EAT." The Contractor is obliged to submit an E-mail and an offer in an electronic form with a qualified electronic signature.

5 The Ordering Party will exclude from the public procurement procedure pursuant to Article 24 (1) point 23 of the Act. Contractors who belong to the same capital group within the meaning of the Act of 16.2.2007 on competition protectionand consumers (Journal of Laws of 2018, item 798) have submitted separate offers, unless they prove that the relations between them do not lead to distortion of competition in the procurement procedure. In the event of joint application by the Contractors for the award of the order, the Ordering Party must receive a single document of the EAT of each of the Contractors jointly applying for the award of the contractpublic interest. Each of the Contractors appearing jointly prepares JEDZ only in electronic form, under pain of nullity and provides it with a qualified electronic signature. In the case of Contractors jointly applying for the award of an offer to the offer must be accompanied by a document in the form of an original establishing the Proxy to represent them in the proceedings for grantingordering or representing in the proceedings and entering into an agreement regarding this public order

1. The Contractor is obliged to attach to the Bid Form constituting Annexe No. 1 to the Terms of Reference, valid as of the day of submitting bids the statement referred to in art. 25a para. 2 of the Act (EIN) constituting preliminary confirmation that the Contractor is not subject to exclusion from the proceedings for grantingpublic procurement within the scope of art. 24 sec. 1 and par. 5 points 1, and points 8 of the Act and meets the conditions for participation in the proceedings specified in the ToR. The Contractor is obliged to attach to the offer also Price Forms suitable for individual parts of the order according to the template constituting Annex 2 to the ToR.

2. At the request of the Employer, the Contractor whose offer will be evaluated as the most expensivemore is obliged to submit in electronic form, via the ePUAP platform or e-mail, to the address of the Ordering Party indicated in Chapter I of the ToR, the following statements or documents valid as of the date of their submission:

In order to confirm the absence of grounds for exclusion of the Contractor from participation proceedings:

1) copy from the relevant register or from the Central Register and Informationand on Economic Activity, if separate regulations require an entry in the register or records, in order to demonstrate the absence of grounds for exclusion based on Art. 24 sec. 5 points 1 of the Act,

2) information from the National Criminal Record in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

3) current certificate ofthe head of the Tax Office confirming that the Contractor is not in arrears with the payment of taxes, issued no earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has concluded an agreement with the competent tax authority regarding the repayment of such receivables with possible interest or fines, in particular he obtained the law provided forfreeing, postponing or spreading overdue payments into installments or suspending in full the decision of the competent authority;

4) valid certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security contributions or health, issued not earlier than 3 months before the deadline for submission of tenders or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables together with any interest or fines, in particular obtained legally permissible, postponement or installment payment of overdue payments or suspension in full of the implementation of the decision in- 5) declaration of the Contractor about the lack of issuing to him a final court judgment or final administrative decision on the arrears of taxes, fees or social security or health insurance premiums or in the event of issuing such a verdict or decision documents confirming the payment of these claims together with possible interest or fines or afterconfirming the conclusion of a binding agreement regarding repayment of such receivables; - 6) declaration of the Contractor about the lack of a ruling against him as a precautionary measure prohibiting applying for public orders; - 7) Contractor's statement on non-payment of taxes and local fees, referred to in the Act of on 12.1.1991 on local taxes and charges (ie OJ of 2018, item 14)45 from late d.).

3. If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, he submits the documents described in chapter VII of the ToR.

4. According to art. 10a para. 5 of the PZP Act, the above-mentioned documents and statements are prepared, under pain of nullity, only in electronic form and are provided with a qualified electronic signature of

5. Each Contractor is obliged to do sost to secure its bid bond in the amount of: Part 1 27 900.00 PLN; Part 2 PLN 200.00.

1) In the procedure for awarding a public order, communication between the Employer and the Contractors is carried out using means of electronic communication within the meaning of the Act of 18.7.2002 on the electronic provision of services (ie Journal of Laws from 2017 item 1219 and 2018 item 650):

2) The Contractor intending to take part in the public procurement procedure must have an ePUAP account. Registration and use of ePUAP is free. Contractor having an account on ePUAP hasaccess to the following forms:

a) submission form, changes, withdrawal of the offer,

b) form for communication.

3) The maximum size of files sent via dedicated forms for submission, modification, withdrawal of the offer and for communication should not exceed 100 MB,

4) For the date of submitting the offer, applications, notifications, electronic documents, statements or electroniccopies of documents or declarations and other information are taken as the date of their transfer to ePUAP,

5) Identification of the proceedings and public key for a given order award procedure are available on the list of all proceedings on the miniPortal, the ID is also available on the Ordering Party's website, on which the Specification I is postedThe Public Key to the encryption of offers is available only in electronic form and constitutes Attachment 5 to this ToR.

6) The Contractor conducts communication with the Employer using dedicated forms available on the ePUAP Platform. 7) To support the miniPortal system and ePUAP, any PC with a Windows operating system and access to the guaranteed Internet network is necessary bandwidth not less than 2 mb / s and JavaScript enabled. The application works only on the Windows platform and requires .NET Framework4.5. In caseu using the mobile devices and MAC or Linux, access to all functionalities of the miniPortal system may be limited. In addition, software for handling documents in PDF format must be installed.
