Subject of the order is the delivery of electrical switchboards according to the list and drawings with unloading at the designated place for the task 51056 "CASA" Krakow.

Subject of the order will be brand new.

For the delivered order subject, the Contractor will provide the Ordering Party with the manufacturer's information on the material in accordance with theregulations in this area (declarations of conformity, certificates, approvals, approvals, guarantees, manuals in Polish, job instructions).

Place of delivery: J.W. 1155 Krakow-Balice, 30-901 Krakow.

The Ordering Party reserves the right of the option, i.e. the right to not make up to 30% of the scope of the order specified in the price form constituting Annex 2 to the ToR.or the possibility to increase up to 30% of the scope of the order specified in the price form constituting Annex 2 to the ToR. A detailed description of the subject of the order can be found in the price form attached as Appendix No. 2 to the Terms of Reference and in the documentation Annex 9 to the Terms of Reference. The completed price form should be submitted with the offer. 1. The Contractor may apply for the award of the contractorzy are not subject to exclusion pursuant to art. 24 sec. 1 point 12-23 of the Public Procurement Law and art. 24 sec. 5 points 1 Public Procurement Law.

2. In order to confirm in advance that the Contractor is not subject to exclusion, he must submit the current declaration on the day of submitting bids in the form of a Uniform European Order Document (EIN) - Annex 4 to the Terms of Reference, to the extent indicated by the Employer in the noticeand on the order and SIWZ. The information contained in the ERO will constitute a preliminary confirmation that the Contractor is not subject to the exclusion of -.

Done in accordance with the Form of the Single Order Document constituting. No. 2 to Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 laying down a standard form for a European order document (Official EU L 3/16) to the extent indicatedin the appendix No. 4 to

SIWZ.

In the proceedings for the award of a public contract and the access and storage of electronic documents (hereinafter referred to as "the Regulation") determines the acceptable format qualified electronic signature as:

EAT submitted by Contractors jointly applying for the order and by other entities and subcontractors should be in the form of an electronic document signed with a qualified electronic signature by each of them to the extent that they confirm the circumstances about whomentioned in the text of art. 22 ust. 1 of the Act

3. In the case of joint application by the Contractors of the EHF, referred to in item

2, each of the Contractors jointly applying for the order shall submit. This document is to confirm the lack of grounds for exclusion to the extent that each of the Contractors shows no grounds for exclusion.

4. Contractor who intends to entrust the execution of a part of the order pIn order to demonstrate the lack of existence of grounds for exclusion from participation in the proceedings, the contractors shall submit to the respondents, as referred to in point 2 for these subcontractors.

5. The ordering party shall call the Contractor whose tender has been the highest rated, to submit within the prescribed, not shorter than 10 days, the current date as of the day of submitting the documents listed in section III.1.2. ie.

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

2) excerpt from the relevant register or from central records and business information, if separate regulations require entry in the register or records, in order to confirmation of no grounds for exclusionand pursuant to art. 24 sec. 5 point 1 of the Act or will not call if it is obtained through free and publicly accessible databases of public registers;

3) the Contractor's statement that he has not issued a final court judgment or final administrative decision about defaulting on taxes, fees or insurance premiums social or

health or - in case ofSuch a decision or decision - documents confirming the payment of these claims together with possible interest or fines or conclusion of a binding agreement on repayment of these receivables - the model constitutes Attachment 6 to the ToR;

4) Contractor's statement about the lack of a ruling against him as a preventive measure applying for public orders - the model is attached toNo. 6 to SIWZ;

5) if the Contractor intends to entrust the execution of a subcontractor's part of the order (which is not an entity where the Contractor depends on the principles set out in Article 22a of the Act) - documents listed in points 1 - 4.

6. If the Contractor is established or resides outside the territory of the Republic of Poland, instead of the documents about whichreferred to in paragraph 1.

1) point 1 - submit information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence is the person concerned or a document, to the extent specified in art. 24 sec. 1 points 13, 14 and 21;

2) point 2 - itemany document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that: a) its liquidation has not been opened or bankruptcy has been declared. Documents referred to in point 6 subpoint 1) and point 2) letter a), should be issued not earlier than 6 months before the deadline for submission of tenders. If in the country in which the Contractor is established-or the place of residence or place of residence has the person the document refers to, the documents referred to in item 6 are not replaced by a document containing the Contractor's declaration, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to apply, before a notary or a judicial, administrative or administrative bodyabout the authority of the professional or economic self-government competent for the seat or place of residence of the Contractor or place of residence of that person. The provision of point 7 shall apply accordingly.

9. Contractor established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document referred to in paragraph 5 pkt 1, consists of the document referred to in paragraph 6 point 1), to the extent specified in art. 24 sec. 1 points 14 and 21 of the Act. If there is no such document in the country in which the person concerned has a place of residence, it shall be replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or self-regulatory bodyego or economic proper for the place of residence of that person. The provisions of point 7 shall apply accordingly.

1. The Contractor will be bound by the offer for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

2. The Contracting Authority informs that in the present proceedings Article 24aa paragraph 1 of the Act,

3. By entering into the proceeding, the Contractor is obliged to pay a bid bond in the amount of:

PLN 8, 000.00 (in words: eight thousand zlotys and 00/100) in the form and according to the rules determined in accordance with art. 45 Public Procurement Laws

4. According to art. 144 para. 1 point 1 PPL The Contracting Authority allows the possibility of amending the Agreement

W nthe following cases:

1) in case of necessity of delivery of an interchangeable object of the Contract, which does not violate the subject of the contract - the value of the subject of the Contract may change;

2) in case of significant changes to the project documentation resulting in the need to make corrections or additions if it makes it impossible or substantially stops delivery - can change udate of execution of the Contract or value of the subject of the Contract;

3) if it is necessary to change the manner of performance of the subject of the Agreement, with a view to its improvement to fulfill the intention of the parties to this Agreement, the value of the subject of the Contract or the Agreement may be subject to change; technical parameters of the subject of the Contract - the date of execution of the Agreement or inthe art of the object of the Agreement.

5) the occurrence of objective reasons, including due to the circumstances for which the Orderer is responsible or circumstances resulting from the tasks of the Investor, or in the event of extension of the contract performance period.
