The object of the contract is to provide means of transport and equipment related to the project: "Green line of public transportc, using means of transport with electric motor, hybrid or reduced pollution norm ".

Main Site: Bistrita Municipality.

This acquisition refers to the acquisition of means of electric motor transport and charging stations, respectively to the purchase of the following products:

- electric buses: 10 pcs;

- fast charging station: 2 pcs;

- mobile charging station: 1 pcs;

- d stationis slow loading: 10 pcs

Requirement no. 1.

The bidders, the third party supporters (if any) and the subcontractors (if any) must not find themselves in the situations provided in art. 164, 165, 167 of Law no. 98 / 2016.

The method of fulfillment:

The DUAE will be completed in accordance with art. 193 para. (1) of Law no. 98 / 2016.

The supporting documents proving the fulfillment of the assumed onese by completing the DUAE will be presented, at the request of the contracting authority only to the bidder ranked first in the intermediate ranking drawn up at the end of the evaluation of the offers are:

- certifying certificates regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general budget consolidated (local budget, state budget, etc.) valid

- the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certificate a statement issued by the ONRC / the constitutive act;

- as the case may be, documents proving the deedl that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of the Law 98/2016 on public procurement;

- other supporting documents, as the case may be.

In case, in the country of origin or the country in which the bidder / supporting third party / subcontractor is established, no documents of the nature provided for above are issued above or the respective documentsdoes not cover all the situations provided in art. 164, 165 and 167, the contracting authority has the obligation to accept a declaration on its own responsibility or, if there is no legal provision in the respective country regarding the declaration on its own responsibility, an authentic statement given before a notary, an administrative or judicial authority or a professional association that has competenceit is in this sense.

Requirement no. 2.

Avoidance of conflict of interest: the bidders / third parties (if any) and the subcontractors (if any) must not find themselves in the situations provided in art. 60 of Law no. 98 / 2016.

The method of fulfillment:

The modality by which the fulfillment of the requirement can be demonstrated: the declaration regarding the failure to comply with the situations provided byt. 60 of Law no. 98/2016, will be completed and submitted by all participants to the procedure (tenderer / associate / third party supporter / subcontractor), once the DUAE has been submitted, filling in Form no. 2.

Details:

1. Failure to submit the DUAE document in the tender de to bidders / associates / third party supporters / subcontractors, as the case may be, it rejects the offer as unacceptable;

2. Failure to provide the offer and the documents accompanying it with an extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider, will lead to the rejection of the offer as unacceptable.prove a form of registration according to the law of the resident country, from which it can be seen that they are legally constituted, that they are not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract of public procurement. The requirement also applies to subcontractors and / or third party supporters who complstate the information related to their situation at the level of a separate DUAE

Compliance:

The DUAE will be completed by the economic operators participating in the procedure for awarding the public procurement contract with the information requested by the contracting authority information regarding the fulfillment of the requirements regarding the capacity of exercise of professional activity.

The supporting document proving the fulfillment of those assumed by completing the DUAE, is the certifying certificate issued by the ONRC or, in the case of the foreign legal / natural persons bidders, the equivalent documents issued in the country of residence, translated into Romanian. These documents are to be presented, at the request of the contracting authority, only by the tenderer ranked 1st andIn the intermediate ranking drawn up at the end of the evaluation of the bids.

In the case in which parts of the contract will be executed by the subcontractors, the proof of registration and the correspondence of the main / secondary activities within it with the object of the purchase will be presented by the subcontractors, for the part of contract they will make.

In the case of an offerif in association, each associate must submit the necessary documents to prove that he is authorized to perform his part of the contract. average annual business. The minimum level of the average annual turnover, achieved over the last 3 (trthey) financial years ended (2016, 2017, 2018), must be at least equal to 30 000 000 RON.

Other economic or financial requirements. A letter of credit issued by the bank where the bidder has opened the transfer account.

To complete the DUAE form: The bidders will fill in the SEAP, after authenticating, directly, in the dedicated section, the DUAE form already configured by the contracting authority for the procedure in Cause. Also, the answers to the DUAE of the economic operators participating in the procedure will be completed in SEAP directly, after authentication by each participant.

For the cases where the tenderer is an association of economic operators or for the cases in which the tenderer has subcontractors or third-party supporters, each economic operator will authenticate in the system and access the award procedure. of interest in order to complete the DUAE in the quality in which it was includedof the procedure (associate, subcontractor, third party supporter).

In accordance with the legislation in force (GEO no. 146/2002, as subsequently amended, regarding the formation and use of the resources carried out by the State Treasury), the operations of collection and payments between public institutions and economic agents will only run through accounts opened with the State Treasury, being obligatory for the contraryhow much to have such an account opened at the treasury in whose territorial area it has its headquarters.
