The Environment Fund grants to Brasov Municipality 80% non-refundable financing for the purchase of 32 electric busesu 12 m long and 20 electric-18-meter electric buses that will operate on the public transport routes of the city of Brasov.

Tenderers, supportive third parties and subcontractors should not find themselves in situations referred to in art. 164, 165, 167 of Law no. 98/2016. The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with information related to their situation for each lot. DUAE astfThe completed documents will be submitted electronically in the SEAP with extended electronic signature.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings completed at the completion of the evaluation bids for each batch. These documents canfi:

1) Finding certificates regarding the lack of debts, taxes or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation; 2) The judicial record of the economic operator and each member of the body administration, management or oversight of that economic operator or those with powers of representation(3) Where appropriate, documents proving that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement; 4) Other editing documents, as the case may be.

Note 1. For foreign legal persons, the economic operator will provide enforceable documents (certificates, criminal records, other equivalent documents) proving that he has fulfilled his obligations to pay taxes, duties and contributions to the budget. Documents will be presented in Romanian, by authorized translation. Note 2. If in the country ofor in the country where the bidder is established, there are no legal provisions concerning the declaration on own responsibility, an authentic declaration is accepted before a notary, an administrative or judicial authority or a professional association with powers in this respect. Note 3. Foreign and Romanian bidders will present certificates of debtor outstanding at the moment of their submission, to the payment of taxes, duties or contributions to the consolidated general budget (local budget and state budget) to be submitted following the request of the contracting authority addressed to the first ranked bidder in the interim ranking for each lot in part.

If in the country of origin or in the country in which the operator ec is establishedonomic documents are not issued as requested or do not cover all the situations covered by art. 164, 165 and 167, any document deemed to be enforceable by the competent authorities of that country shall be accepted.

In the case of foreign legal / physical persons, the documents shall be transmitted in the language in which they were issued, certified copy "according to the original" signed bythe legal representative, accompanied by a certified translation in Romanian.

The bidders will complete the DUAE for each lot. For the tenderer ranked first in the interim evaluation, at the request of the contracting authority, the following shall be accepted: equivalent certificates, equivalent legal record, own-account statements given to a notary, administrative authoritiesor court or professional associations.

Note 4. The requirement for non-compliance with the situations provided in art. 164, 165 and 167 are addressed to subcontractors and third party supporters according to art. 170 par. (1) and art. 183 par. (1) of the Law no. 98/2016, to be presented to the DUAE according to art. 170 par. (3) of the Law no. 98/2016 for each lot.

The participation guarantee is returned under the conditions of art. 38 of GD no. 395/2016. The bidder will specify in his offer what information he / she regards as confidential. DUAE related documents, as well as the Mentiothe data sheet requested by the contracting authority will be posted to the SEAP together with the DUAE, signed with the electronic signature and will be presented at the request of the contracting authority only by the first ranked bidder in the interim ranking completing the bid evaluation.
