Reference Number: 196 / PN / 2019

1. The subject of the order is the delivery of medical equipment for the Employer, with technical parameters specified in Annexes 3a, 3b, 3c and 3d to the ToR, hereinafter referred to as "apparatus", together with the installation and training of employeesego.

1. The subject of the order is the delivery of medical equipment for the Ordering Party, with technical parameters specified in Annex 3a to the ToR, hereinafter referred to as "apparatus", together with the installation and training of the Employer`s employees.

2. The subject of this order includes the following parts:

part 1 ultrasound apparatus ( 1 item)

with technical parameters approxspecified in Annex 3a to the ToR.

3. The above-mentioned apparatus must meet the limit parameters set out in Annex 3a to the ToR. Failure to meet at least one of the limit parameters set out in Annex 3a to the ToR will result in rejection of the offer.

4. The apparatus referred to in point 2 will be provided with the equipment necessary for its proper functioning.

5. Supply of apparatusreferred to in item 2 will take place in the place indicated by the Employer in Gdańsk, at ul. Smoluchowskiego 17, POLAND - at the expense of the Contractor.

6. The contractor will deliver and install the apparatus within a period of not more than 15 days from the date of the contract, but not later than on 1/12/2019

7. The contractor will train a minimum of 2 Employers of the Employer (applies to each of the parts) in the field of basic operation apfittings, within the period specified in the draft contract.

8. The Contractor shall be obliged to notify the Employer in writing 5 business days in advance about the exact date of training.

9. The contractor will be obliged to guarantee that the apparatus supplied is brand new, complete, of a high standard, both in terms of quality and functionality, as well as free of material defects, the constructorlegal and legal regulations and approved for use in public health care institutions.

10. The contractor will be required to provide copies of the documents confirmed as true to the original within the time of delivery of the apparatus, which show that the apparatus offered has been authorized for trading and use in the territory of the Republic of Poland.

11. The apparatus offered must be brand newcommenced after 1/1/2019

1. The Awarding Entity does not allow submitting variants.

2. The Awarding Entity allows partial bids.

3. The awarding entity does not envisage the award of contracts referred to in art. 67 section 1 point 7 Public Procurement Law

4. The contracting authority allows the amendment of the contract in accordance with Annex 4 to the ToR.

5. In the event that the values provided by the Contractors on the statements and documents referred to in point VII of the ToR will be given in a currency other than PLN, the Awarding Entity will convert these values to PLN assuming the average NBP exchange rate of the given currency as at the date of initiating the proceedings.

6. All activities, rights and obligations of Contractors and the Employer not regulated in these ToR, which are not ordered by lawIt should include the Employer in the Terms of Reference, which may contribute to the proper conduct of the proceedings, is regulated by the Act Pzp.

7. The contracting authority envisages making changes to the contract during its implementation in the event of circumstances referred to in art. 144 (Journal of Laws of 2018, item 1986, as amended).

8. The contract in question is co-financed by the Ministry of Health under the program: Retrofittingand hematooncology clinics and departments in equipment for the diagnosis and treatment of leukemia for 2019.
