The subject of the order is service and maintenance of the technological lineego devices included in the municipal water production system in the Jarocin commune, service of the water supply network (together with possessed connections) in the Jarocin commune and provision of collection services in the Jarocin commune. water production system in the Jarocin commune, obslye of the water supply network (together with owned connections) in the Jarocin commune and provision of collection services in the Jarocin commune.

Detailed description of the subject of the contract is included in the Description of the subject of the contract (OPZ).

1. Contractors who are not subject to exclusion from the contract award procedure in the circumstances referred to in Art. 24 paragraph 1 pkt 12-23 PZP, art. 24 paragraph 5 points 1, 5, 6 and 8 of the PZP and who meet the conditions for participation in the proceedings regarding and meet the conditions for participation in the proceedings referred to in Art. 21 paragraph 1 of the Public Procurement Law:

a) competences and powers to conduct a specific professional activity, provided that it results from separate provisions,

b) economic and financial standing,

c) technical and professional capacity.

2. In order to sweatdrilling the lack of grounds for exclusion from the procedure and to confirm compliance with the conditions for participation in the procedure, the Contractor shall be obliged to provide the Employer with the following statements and documents (within the deadlines indicated in the ToR): order document(hereinafter: "EAT"), the template of which is specified in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standardized single European procurement document (EU Official Journal L Series 2016, No. 3, p. 16) The EAT declaration shall be submitted together with the offer only in electronic form, accompanied by a qualified electronic signature;

b) an excerpt from the relevant register or from the Central Registerentity and Information on Economic Activity, if separate provisions require an entry in the register or the register, in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 item 1 of the Public Procurement Law;

c) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting offers orb another document confirming that the Contractor has concluded an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the decision of the competent authority;

d ) certificate of the relevant local organizational unitSocial Insurance Institution or Kasa Rolniczego Ubezpieczenia Społecznego or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions issued not earlier than 3 months before the deadline for submission of tenders or another document confirming that the Contractor has concluded an agreement with the competent authority regarding these repaymentstogether with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or distribution in installments of overdue payments or withholding in full the execution of the decision of the competent authority;

e) information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act and, regarding conviction for an offense to imprisonment, within the scope of definingon the basis of art. 24 paragraph 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

f) the Contractor`s statement regarding the lack of grounds for exclusion referred to in art. 24 paragraph 1 point 15 and 22 of the Public Procurement Law and in art. 24 paragraph 5 points 5-6 Public Procurement Law (Annex 4 to the ToR).

Documents concerning foreign Contractors have been described in detail in point 7.4.-7.7. TOR

1. In order to confirm the lack of grounds for exclusion from the contract award procedure in the circumstances referred to in art. 24 paragraph 1 item 23 of the PPL, the contractor will be obliged to submit a declaration of belonging or not belonging to the same capital group. The contractor should submit the said declaration within 3 days from the day of placing it by the contracting authority nand on the website, the information referred to in art. 86 section 5 Public Procurement Law A model declaration is included in Annex 3 to the ToR.

2. In the procurement procedure, communication between the Employer and the Contractors takes place via the e-Employer platform https://pwikjarocin.ezamawiacy.pl and e-mail to the following e-mail address: dawid.kucharzak@pwikjarocin.pl, with the proviso that PLNThe offer together with EAT is made only through the e-Ordering Party platform.

3. The Contractor by entering the procedure for the award of this public contract, i.e. by registering or logging in free of charge, in the case of having an account in the e-Ordering Party`s platform, accepts the terms of use of the platform specified in the Regulations posted on the https website://pwikjarocin.ezamawiacy.pl and consider it binding.

4. The details of the functioning of the e-Employer platform are described in the Contractor`s User Manual, constituting Annex 6 to the ToR.

5. The offer must be made in electronic form under pain of nullity. The contractor submits the offer on the e-Ordering Party platform.

6. The deadline by which the contractor will be bound by the submitted offer is 60days. In accordance with art. 85 Public Procurement Law, the period begins with the submission deadline.

7. The complete offer must include:

a) a completed Offer Form (Annexes 1 to the ToR), bearing a qualified electronic signature, 1 separate file is recommended

The form generated by the e-Ordering Party is the "technical tool" necessary to submit an offer on the platform, it is nothowever, he has the actual offer form. Failure to submit the Bid Form in accordance with Annex 1 to the ToR will constitute the basis for rejecting the bid, pursuant to the provisions of Art. 89 paragraph 1 item 2 of the Public Procurement Law

In the event of a discrepancy in content between the Bid Form (Annex 1 to the ToR) and the form generated by the e-Ordering Platform, the Ordering Party shall deem the content of Annex n as binding.r 1 to this ToR;

b) completed EAT in electronic form with a qualified electronic signature, 1 separate file is recommended;

c) in the case of signing the offer by a proxy and in the case of contractors jointly applying for the award of a contract, a power of attorney with a qualified electronic signature is recommended 1 separate file for each power of attorney;

d)in the event of relying on the capacity of another entity, the undertaking of that entity to provide the Contractor with the necessary resources for the needs of the contract, bearing a qualified electronic signature and a separate file for each obligation. electronic documents constituting the offer are recommended to be compressed into one archive file (e.g. ZIP).

8. The proceedings will be conductedin accordance with the rules provided for "Reverse procedure", referred to in Article 24aa (1) and (2) of the Public Procurement Law. in the proceedings.
