3.1. The subject of the order is:

A detailed description of the subject of the contract is contained in Annex 2b and Annex 5 to the ToR.

3.3. The contracting authority requires the implementation of the subject of the contract on the terms set out in the contracts, which form attachments to the ToR.

3.4. The Employer allows the use of equivalent solutions in relation to the standards indicated in the ToR.

REquivalent solution means a solution that allows achieving the effect assumed by the Employer and specified in the SIWZ by other solutions. - Description of the criteria that the ordering party will be guided when choosing the offer, including the weightings of these criteria and the way of assessing offers

13.1. The evaluation of offers will be carried out on the basis of the criteria set out in the Terms of Reference and their weightingsu to Task No. 1 - Criterion price weight: 60%

5.1 The contractors who are: - 1) can not be excluded,

2) meet the conditions for participation in the proceedings, how many of them have been specified by the ordering party in the contract notice or in the invitation to confirm interest.

5.1.1. Contractors applying for grantingof the subject's order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 item 13 and 14 and 16-20 of the PPL, art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient-to prove its reliability, in particular to prove compensation for damage caused by a crime or fiscal offense, financial compensation for damage suffered or remedied, an exhaustive explanation of the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources that are appropriate to prevent dalsfiscal offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court ruling against applying for the order and the period of validity of the ban has not expired. None of the Contractors jointly applying for the awardthe provisions referred to in Article 23 Pzp, may not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 of the Pzp and art. 24 sec. 5 point 8 of the Public Procurement Law.

The Contracting Authority will examine whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp Employer-determines the following conditions for participation in the proceedings:

1) the condition of competences or entitlements to conduct a specific professional activity, if it results from separate regulations, i.e.: In relation to all Tasks:

a) the Ordering Party does not specify the condition of participation in the proceedings in scope - Contractors jointly applying for granting orders, referred to in art. 23 Pzp, must collectively-fulfill the condition mentioned in art. 22 ust. 1b point 1 of the PPL,

6. A list of statements or documents confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion, and documents or declarations confirming that the offered deliveries meet the requirements specified by the ordering party

6.1. Each contractor is obliged to attach to the offer:

1 current as of the day of submitting the offerert statement of the Contractor (Uniform European Order Document) - - prepared in accordance with the template attached to the ToR, - - submitted in electronic form, with a qualified electronic signature.

The information contained in the declaration will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions participation in the proceedings.

Statements of the entities submittingh the offer jointly and entities making the potential available on the JEDZ form in the form of an electronic document should be signed with a qualified electronic signature by each of them in the scope in which they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. The same requirement applies to EAT submitted by a subcontractor, pursuant to art. 25a para. 5 points1 of the Public Procurement Law - In the case of Contractors jointly applying for the award of the contract, this document shall be submitted by each of the Contractors jointly applying for the order or on behalf of the Contractor - the Contractor who intends to entrust the execution of a part of the contract to subcontractors in order to demonstrate absence of grounds for exclusion from participation in the proceedings-make a statement referred to in this point of the specification, refer to the contractors who are:

1) are not subject to exclusion;

2) meet the conditions for participation in the procedure, if they have been specified by the awarding entity in the announcement of order or invitation to confirm interest.

5.1.1. Contractors applying for a subject-related award-the orders can not be subject to exclusion from the public procurement procedure based on Art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 item 13 and 14 and 16-20 of the PPL, art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to be demonstratedia its reliability, in particular to prove compensation for damage caused by a crime or fiscal offense, financial compensation for damage suffered or reparation, an exhaustive explanation of the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources that are appropriate to prevent further offenseor fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court ruling against applying for the order and the period of validity of the ban has not expired. None of the Contractors jointly applying for the order, referred to in art. 23 Pzp, may not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 of the Pzp and art. 24 sec. 5 point 8 of the Public Procurement Law.

The Contracting Authority will examine whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp. The Ordering Party specifies onthe following conditions of participation in the proceedings:

2) the condition of the economic or financial situation, i.e .: for all Tasks:

a) the Ordering Party does not specify the condition of participation in the proceedings in this respect. Contractors jointly applying for the award of contracts referred to in art. 23 PPL, must jointly meet the condition specified in art. 22 ust. 1b point 2 of the PPL - 6.2. According to art. 24aa paragraph 1-Pzp The Awarding Entity will first evaluate the offers and then examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.

6.3. The ordering party, before the order is awarded, will call the contractor whose offer has been rated the most, to submit within the prescribed period, not shorter than 10 days, valid as at the day of submitting the orderia following statements or documents:

List of statements or documents confirming no grounds for exclusion of the Contractor from participation in the proceedings

1 Current extract from the relevant register or from central records and business information, if separate regulations require entry in the register or records in order to demonstrating the lack of grounds for exclusion based on art. 24 sec. 5-point 1 of the Act,

2 Current information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids,

3 Current certificate of the competent head of the tax office confirming that the contractor is not in arrears with paying taxes or a certificate that he obtained the legally required exemption, -postponing or spreading into installments of overdue payments or suspending in full the execution of the decision of the competent authority - issued not earlier than 3 months before the deadline for submitting bids;

4 Current certificate from the relevant branch of the Social Insurance Institution or Agricultural Social Insurance Fund confirming that the contractor is not in arrears insurance premiumsnot health and social, or confirmation that he obtained the lawful exemption, postponement or spreading into installments of overdue payments or suspension in full of the implementation of the decision of the competent authority - issued not earlier than 3 months before the deadline for submission of tenders;

W / wym. dock. The Contractor shall submit in the form of the original or a copy certified as a true copy by the Contractor;

In the case of Contractors jointly applying for the order, these documents shall be submitted by each of these Contractors, in the form of the original or a copy certified as a true copy by the Contractor to whom they refer; - Contractor who refers to the resources of other entities, in order to demonstrate fulfillment in to the extent to which they refer to their resources, the conditions for participation in the proceedings are also submitted bythe document referred to in this point of the specification concerning these entities.

If the Contractor submits an offer for more than one Task, the Ordering Party will consider that this document, filed to confirm that the Contractor is not excluded from the procurement procedure, is part of offer referring to these Tasks;
