The contracting authority does not specify the condition of participation in the proceedings.

Information of the bank or cooperative savings and credit union confirming the amount of financial resources or the creditworthiness of the Contractor (in accordance with point 6.1.2.2. SIWZ ) issued within a period not earlier than 1 month before the submission deadlineand offers.

If, for a justified reason, the Contractor cannot submit documents regarding the financial or economic situation required by the Employer, he may submit another document which sufficiently confirms the fulfillment of the condition of participation in the Procedure described by the Employer in accordance with art. 26 section 2c of the Act.

1. Under the offer binding period of 2 months, 60 days should be understood.

2. The Contractor, within 3 days from the date of posting on the website information from the opening of offers

Submits (via the Electronic Communication Module with PGNiG SA Suppliers) a statement on belonging or not belonging to the same capital group as referred to in Art. 24 paragraph 1 point 23.

When submitting a statement, the Contractor may provide evidence that links with othersContractor

They do not lead to distortion of competition in the Procedure - prepared according to the model constituting the ToR.

3. The Contractor submits the offer with attachments through the Electronic Communication Module with Suppliers

PGNiG SA.

4. The contents of the offer are the documents listed in point 12.6 SIWZ.

5. In the absence of grounds for exclusion, the Employer will call Contractors whose offers will be

Rated asmost favorable, for submission within a specified period, not shorter than 10 days, of current

submission fillings, relevant statements or documents confirming the lack of grounds for exclusion from the

Proceedings referred to in par. 5 points 1-9 of the Regulation on the types of documents which may

be required by the Employer from the Contractor in the procurement procedure and indicated in the ToR.
