1. The subject of the order is the supply of diesel oil depending on the season and ambient temperature, respectively standard and with improved low temperature properties, meeting the conditions set by the current standardPN-EN 590 and the Regulation of the Minister of Economy of 9/10/2015 on quality requirements for liquid fuels.

1. The subject of the order is the supply of diesel oil depending on the season and ambient temperature, respectively standard and with improved propertiesh low temperature, meeting the conditions specified by the current PN-EN 590 standard and the Regulation of the Minister of Economy of 9/10/2015 on quality requirements for liquid fuels.

2. A detailed description of the subject of the order is included in the Specification of Essential Terms of Orders.

1. For preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation inThe contractor shall attach to the tender a statement valid as of the day of submitting the offers in the form of a single document drawn up in accordance with the specimen of the standard form set out in the European Commission`s implementing regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU and art. 80 par. 3 of Directive 2014/25 / EU, hereinafter referred to as the Single European Order Document or "ITDZ.. The document should be submitted in an electronic form with a qualified electronic signature.

2 In the case of joint application for contractors, JINDE is submitted by each of the contractors jointly applying for the order.These documents confirm the fulfillment of the conditions for participation in the proceedings and no grounds for exclusion in the scope in which each of the contractors shows meetsno conditions for participation in the proceedings or no grounds for exclusion.

3. The Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them, in so far as it relies on their resources, the condition of participation in the proceedings also consists of EED regarding these entities

4. The contracting authority allows it to meet the initial confirmationconditions for participation in the procedure, the contractor in Part IV. The qualification criteria only completed section α. In this case, the contractor does not have to fill in any of the other sections in Part IV, ONE

5. The ordering party will call the contractor, whose offer has been rated the highest, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting: liquid fuel concessionsmi;

In the case of a joint offer, the abovementioned the document is submitted by the contractors who submit a joint offer, which within the consortium is responsible for fulfilling this condition.

Ww. the document should be submitted in the original in the form of an electronic document or in an electronic copy of a document certified as a true copy.

6. Other information is included in the order documents.

Minm capacity:

- the condition will be considered fulfilled if the Contractor proves that he has a license for trade in liquid fuels valid during the conclusion of the contract with the Employer. the condition must meet at least one of the contractors in full. For preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the enforcement proceedingsawca attaches to the offer valid as of the day of submitting bids a statement in the form of a single document drawn up in accordance with the standard form provided for in the European Commission executive regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU and art. 80 par. 3 of Directive 2014/25 / EU, hereinafter referred to as the Single European Order Document or "EAT"it should be submitted in an electronic form with a qualified electronic signature.

2. In the case of joint application for contractors, JINS shall submit each of the contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the contractors demonstrates compliance with the conditionsin the proceedings or no grounds for exclusion.

3. The Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them, in so far as it relies on their resources, the condition of participation in the proceedings also consists of EED regarding these entities

4. The Ordering Party allows for the preliminary confirmation of compliance with the conditionsin the proceedings, the contractor in Part IV. The eligibility criteria only completed section α. In this case, the contractor does not have to fill in any of the other sections in Part IV, ONE

5. The ordering party will call the contractor whose offer has been rated the highest, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting:

1) the contractor`s statement on the annual turnover of the contractin the area covered by the contract, for the last 3 financial years, and if the period of business is shorter for this period; - in the case of a joint bid, the statement consists of the contractors who submit a joint bid, who / who will be / will be responsible for fulfilling this condition under the consortium; the statement should be submitted in the original in a post(c) information from a bank or cooperative savings and credit union confirming the amount of funds held or the creditworthiness of the contractor, in a period not earlier than one month prior to the expiry of the submission of bids; - in the case of an electronic document or an electronic copy of a certified statement; the joint offer of the above-mentioned the document consiststhose from contractors who submit a joint bid, who / who will be / will be responsible for fulfilling this condition under the consortium; the document should be submitted in the original in the form of an electronic document or in an electronic copy of a document certified as a true copy of the original;

3) documents confirming that the contractor is insured against civil liability in the scope ofactivities connected with the subject of the order for a guarantee sum determined by the ordering party; - in the case of a joint bid, the document consists of the contractors who submit a joint offer, who / who will be / will be responsible for fulfilling this condition; the document should be submitted in the original in the form of an electronic document or in an electrican original copy of the document certified as true copy.

6. Other information is included in the order documents. 1. Contractors who are not subject to exclusion from the proceedings in the circumstances referred to in: - 1) art. 24 sec. 1 point 12) 23) of the Act, subject to art.133 par. 4 acts,

2) art. 24 sec. 5 points 1), 2), 4) and 8) of the Act

2. On the monsterverifying that the contractor is not subject to exclusion from the proceedings should be submitted: documents and declarations referred to in Chapter V: point 5 point 1 lit. from a) to g) and point 8 of the SIWZ, ie: -1) certificate of the competent head of the tax office;

2) b) certificate of the relevant local organizational unit of the Social Insurance Institution;

3) copy from the relevant register or from the Central Register and Informationon economic activity;

4) information from the National Criminal Record in the scope specified in art. 24 sec. 1 items 13, 14 and 21, subject to art. 133 ust. 4 acts;

5) the contractor`s statement that the court has not been the subject of a final court decision or a final administrative decision on default of taxes, fees or social security or health insurance premiums orin the event of the issuance of such a judgment or decision, documents confirming the payment of these claims together with any interest or fines or the conclusion of a binding agreement regarding the repayment of such debts;

6) the contractor`s statement about the lack of a ruling against him as a preventive measure for the prohibition of applying for a public order;

7) the contractor`s statement about not paying a premiumtax and local fees, referred to in the Act of 12.1.1991 on local taxes and fees;

8) statement on belonging to or lack of belonging to the same capital group.

3. Documents required by the contracting authority, which must be attached to the offer:

1) the offer form in accordance with Chapter I point 3 of the ToR;

2) EED in accordance with Chapter V point 3 of the ToR;

3) the statementthe offeree about the application of EU preferences; - 4) the obligation of the third party in accordance with Chapter V, point 4, point 2 of the ToR if the contractor intends to rely on the technical or professional capacity or financial or economic standing of other entities to confirm compliance with the conditions for participation in the proceedings; 5) appropriate power of attorney;

6) declaration according to the template attachedno. 1 to siwz indicating the part of the order the execution of the contractor will entrust to subcontractors and subcontractors (if the contractor anticipates the participation of subcontractors).

4. The detailed list of documents to be submitted in the procedure and rules for their submission are specified in Chapter V of the TOR.

5. If the contractor has a registered office or place of residence outside the territories, RP shall submit documents in accordance with Chapter. VI SIWZ.

7. Based on Article. 24aa of the Act, the contracting authority may first evaluate the offers and then examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. The ordering party will reject the offer if it occursits premises specified in art. 89 of the Act, as well as pursuant to art. 138c par. 1 point 4 of the Act, the Ordering Party will reject the offer in which the share of goods originating from Member States of the European Union, countries with which the European Union has entered into agreements on the treatment of entrepreneurs or countries to which the provisions of Directive 2014/25 / EU are applicable under the Council Decision, does not exceed 50%.

9.
