The bidders, third-party supporters and subcontractors must not find themselves in the situations provided in art. 177, 178 of (1) and (2) as well as of art.180 par. (1) of Law 99/2016 on sectoral procurement.

The method by which the requirement can be demonstrated: the DUAE will be completed by the opeeconomic rats participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting entity, only by the tenderer ranked on the first place in the intermediate ranking replaced at the end of the evaluation of the offers.

These documents can be:

- certificatefindings regarding the lack of debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation; they must attest the absence of the outstanding debts at the time of their submission,

- the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the resp.to the economic operator or those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document,

- as the case may be, documents demonstrating that the economic operator can benefit of the derogations provided in art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 on acquisitions

The economic operators submitting the offer must prove a form of registration according to the law of the country of residence, to show that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution and that it has the capacity professional to carry out the activity that is the object of the contract. The way you canthe fulfillment of the requirement will be completed by the DUAE by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by the ONRC, or in the case of the foreign bidders, equivalent documents issued in the country of residence will be presentonly, at the request of the contracting entity, only by the bidder ranked in the first place in the intermediate ranking prepared at the end of the evaluation of the bids.

All communications between the contracting entity and bidders during the procedure are made in SICAP, by electronic means. Any request for clarifications to the tender documentation from the bidders will be sentit`s through SICAP. Clarifications received by other means will not be taken into account. During the evaluation of the offers, the contracting entity will send the clarifications to the bidders, also in SICAP. If 2 or more offers have the same score and are the lowest, the contracting entity will ask the bidders in this situation for clarification through SICAP, inview of electronic uploading by economic operators of documents containing new prices.
