Car fuel - gasoline and gasoline delivered on the basis of value cards and vouchers, according to specifications in the specifications.

1) Exclusion reasons. Subcontracting biddersanti-supporters and third-party supporters should not be found in the situations provided for in art. 177, 178 and 180 of Law no. 99/2016 regarding sector acquisitions.

Way of accomplishing: initial completion and presentation of the DUAE, by the economic operators participating in the award procedure (tenderers, including associates / subcontractors and third parties) as the first proof of non-compliance• The tenderer ranked first after application of the award criterion for admissible tenders will prove non-compliance in the exclusion situations by submitting, at the request of the contracting entity, the following information and documents: (a) Certificate of tax certification regarding fiscal / budgetary obligations and tax certificate attestation(b) The criminal record certificate of the economic operator and of each member of the administrative, management or supervisory body of the respective economic operator or of those having the power representation, decision-making or control within it, as evidenced by the certificate(c) Where applicable, documents demonstrating that the economic operator may benefit from the derogations provided for in Art. 179 par. (2), art. 180 par. (2), art. 184 of the Law no. 99/2016 regarding public procurement, (d) Other documents requested by the contracting entity, as the case may be.

Non-resident economic operators (foreigners) have the right to presentany supporting documents to demonstrate that they have fulfilled their obligations to pay taxes, duties and contributions to the general consolidated budget in accordance with the requirements of the country of origin or country where the tenderer / candidate is established, issued by the competent authorities of the country of origin (such as certificates, tax records or other documentsequivalent). The documents shall be accompanied by their authorized translation into Romanian; 2) Declaration on own responsibility regarding the non-existence of the conflict of interest, as regulated by the exemplary title in art. 73 of the Law no. 99 / 2016.

Way of fulfillment: Form no. 3.

Form no. 3 will be presented by all economic operators (ofcontractors / subcontractors / third-party supporters) with the DUAE. In the case of a group of economic operators who submit their joint offer, each member of the group has the obligation to submit this statement (each member of the association, as well as each proposed subcontractor and supportive third parties.)

Note 1. Any economic operator in any of the situations provided by art. 177, 178and 180 of the Law no. 99/2016, which draws the exclusion from the award procedure, may provide evidence to show that the measures taken by it are sufficient to demonstrate its credibility in relation to the grounds for exclusion in accordance with the provisions of Art. 184 of the Law no. 99 / 2016.

Note 2. The forms and / or documents requested above will be submitted by the bidder(in the case of an association) and, if appropriate, by the subcontractor and by the supporting third party.

Tert supporter. In case ofethe ratant demonstrates his economic and financial situation by invoking the support given by one or more third parties, then the tenderer has the obligation to prove to the contracting entity that he has taken all the necessary measures to have at any time access to the necessary resources by presenting a commitment in this respect from the third party / third parties

General information on the average figure aeconomic operator for the last 3 years (2016, 2017, 2018). The average of the total business turnover must be greater than or equal to RON 3, 900, 000.00. Where more than one economic operator participates in the award procedure, the fulfillment of the economic and financial criteria is demonstrated by taking into account the resources of all the members of the group. Whetherwhich economic operator (single bidder / affiliate bidder) will fill in the appropriate fields from the DUAE regarding the economic and financial capacity.

It will complement the DUAE, in accordance withNotification no. 240 / 2016.

Instructions on DUAE completion are available at https://sicap-prod.e-licitatie.ro The failure of DUAE, with the offer, will lead to the rejection of the offer as unacceptable, in accordance with the provisions of art. 143 para. (2) lit. b) from H.G. no. 394 / 2016.

According to art. 205 paragraph (1) of the Law no. 99/2016, the contracting entity has the right to request at any timetenderers to submit all or some of the supporting documents as proof of the information contained in the DUAE at any time during the course of the procedure. 205 paragraph (2) of the Law no. 99/2016, prior to awarding the sectoral contract, the contracting entity shall request the tenderer ranked first, after applying the award criterion, up-to-date templates to demonstrate that all the qualification and selection criteria are met, according to the DUAE information. Those relevant documents shall be valid on the date of their request by the contracting entity. For viewing the awarding documentation uploaded in SEAP, it is necessary to install a program to view the electronically signed files (this program being available free of charge on the websites of the electronic signature providers).

Documents issued in a language other than Romanian will be accompanied of the authorized translation in Romanian.

The winner of the car offer is declaredis the lowest price, following the application of the "lowest price" award criterion.

The answer to the clarification requests will be posted in SEAP, in a document attached to the awarding documentation. The answers to the clarification requests are an integral part of the Attribution documentation

The maximum allowed file size of SEAP uploaded is 40Mb, their number isunlimited.
