CPV Description: The scope of the framework agreement is the supply of motor fuel from the suppliers' warehouses, payable within the time limit set by the purchase contract, ie Euro 5 diesel. The quantity that is intended to be purchased is at least 330 000 liters - maximum 660 000 liters - in liquid form, at the headquarters of the contracting authority.ite: S.C.D.A. Teleorman.

The scope of the framework agreement is the supply of motor fuel from the supplier's warehouses, with payment within the term stipulated in the purchase contract, ie Euro 5 diesel. The quantity to be purchased is of minimum 330 000 liters - maximum 660 000 liters - in liquid form, at the headquarters of the contracting authority.

The estimated value of the smallest contractt below: 88 660 RON.

Estimated value of the largest subsequent contract: RON 709 280. The lowest amount of the framework agreement will be 330 000 liters.

The largest amount for the framework agreement will be 660 000 liters

The largest quantity of a subsequent contract will be 160, 000 liters

The smallest quantity of a subsequent contract will be 20, 000 liters

The value of ewithout VAT: between 1 462 890 and 2 925 780 RON. Note: The deadline for the contracting authority to respond clearly and completely to all requests for further clarifications or additional information is 10 days before the deadline for the submission of tenders, to the extent that these requests will be addressed within the deadline provided in section I of the data sheet, respectively 13 z(s) before the closing date for submission of tenders.

Frequency and value of the contracts to be awarded: The quantities stipulated in the tender specifications are indicative and do not constitute a contractual obligation. These quantities were estimated at the level of average consumption in previous years. It is estimated that at least 12 subsequent contracts will be concluded.

The quantities to be fand tendered within the framework of subsequent contracts, will be in accordance with the contracting authority's own needs.

Tenderers, third parties and subcontractors shall not be in the situations provided for in art. 164, 165 and 167 of Law no. 98 / 2016.

The economic operator (leader, associate, third party, subcontractor) will fill in the appropriate requirement in the DUAE form, withinformation related to their situation, from the awarding documentation.

Incorporation in the situation stipulated in art. 164, 165, 167 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.

The supporting documents proving the fulfillment of the assumed by completing the DUAE form must be presented, at the request of the contracting authority, only by the tenderers placed on the first three places at the completion of the evaluation of the tenders. These documents may be: - Romanian legal / natural persons: - - Fiscal attestation certificate for legal persons issued by MFP or subordinated subunits have the status of a budget lender (this certificate must show that the bidder does not have a yes(- this certificate must show that the tenderer has no overdue debts at the time of their deposit),

- The record of the local taxes and fees in case of the legal persons, issued by the Local Council judiciary of the economic operator and of the members of the administrative, management or supra administration bodythe watch of the economic operator or those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act.

Foreign legal / natural persons:

Editorial documents, issued by the authorities competent in the country where they are resident, proving the lack of outstandingof their presentation, obligations regarding the payment of taxes to the state budget and the local budget, according to the legislation of the country of residence.

The documents shall be accompanied by their authorized translation into Romanian. demonstrates that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 regarding the public acquisitions, as the case may be, other editing documents.

The persons holding decision-making positions within the contracting authority regarding the organization, carrying out and finalization of the awarding procedure are the following:

1) The economic operators submitting the tender must prove a registration according to the law of the country of residence, from which the operator economic is legally constituted, that he is not in any of the situations of cancellation of the constitution and that he has the headthe professional capacity to perform the activities that are the subject of the contract

1) If it is found that the first ranked offers have equal scores, the contracting authority will request the re-embossing in a closed envelope, in the the view of the distribution of the bids on the basis of a new financial proposal, in which case the contract will be awarded to the ranked bidder; 2) According to the provisions of art. 193 of Law 98/2016, esyou are required to complete the DUAE for all participants in the procedure (bidders, associate bidders, third parties, subcontractors), with the confirmation documents being submitted only by the bidders placed on the first three places in the ranking of the bid evaluation. In the process of evaluating offers, we will consider rejecting an offer in the-which the tenderer does not file DUAE - art. 104 par. (3) in conjunction with art. 60 from H.G. 395/2016 and art. 137 par. (2) lit. b) from H.G. 395/2016. 3) The framework agreement will end with three opseconomic operators, ranked in the order of the offered price, if there are three declared economic operators (they meet the required conditions according to the awarding documentation). If there are not at least three economic operators, the framework agreement will be concluded with all qualified economic operators.

(The way in which any bid with equal scores will be settled will be achievedby re-fermentation. The contracting authority will request clarification in a closed envelope. (4) Contracts awarded under the framework agreement may only be concluded between the contracting authority and the economic operators that are party to the agreement by resuming the competition. Reflection elementThe request of the contracting authority, addressed to the economic operators to provide, materializes by concluding contracts following the framework agreement, which is a legal basis for payment.

Information related to the resumption of the competition:

The elements / conditions which are the subject of the resumption competition and award criteria / evaluation factors to follow-to be applied for the establishment of the economic operator to which the subsequent contract will be awarded: the lowest price.

The assignment of the subsequent contracts will be done by resuming the competition, during which the contracting authority will concomitantly send an invitation to participate in the re-submission to all the signatory economic operators of the framework agreement. Deadline for submission ofthe new offers will be communicated in the invitation to participate in the reopening.

The signatories of the framework agreement have the obligation to present at the date of the request, in the closed envelope, the value of the offer / financial proposals (lowest price). Items that remain unchanged:

1) the award criterion set at the start of the public procurement procedure - the highest price(2) the award of subsequent contracts only on the basis of the rules and conditions set out in this framework agreement, 3) the technical offer, 4) the payment of the products to be subject to the subsequent contracts, II. The items that are subject to re-listing, in compliance with the provisions of art. 118. Law 98, 1. the price of the offer.

If, following the invitation to re-offer, two suppliers present-the same price will resume the competition only with the two operators, they have to improve their offer, in the sense of diminishing it.

After analyzing the submitted offers, the contracting authority will establish the winning economic operator, will transmit the result of evaluating the offers of all the participants to the re- and will award the contract subsequently to the one who offered the price-lower.
