The subject of the order is the delivery of computer equipment for the University of Nicolaus Copernicus in Toruń. The object of the order is specified in Annex No. 5 to the ToR.

1. The subject of the order is the delivery of computer equipment for the University of Nicolaus Copernicus in Torun. 2. Harerowthe subject of the orders is specified in Annex No. 5 to the ToR. 3. The Contractor is obliged to execute the order on the terms and conditions described in the contract template constituting Annex No. 6 to the ToR.

Note:

V. Conditions for participation in the proceedings.

1. The contractors who are:

1) are not subject to exclusion,

2) they meet the conditions for participation in the proceedings regarding:

a) financial situation: - The contractor must document his financial situation by submitting bank or cooperative informationj a savings and credit union confirming the amount of financial resources held or the creditworthiness of the contractor in the amount of at least PLN 10, 000.00 (in words: ten thousand, PLN 00/100) in a period not earlier than one month before the deadline for submission of bids. professional ability:

The Contractor will fulfill the condition if he proves that he has completed within the last three years before expiry-the deadline for submission of bids, and if the period of business is shorter - during this period, at least two deliveries of computer equipment with a value of not less than 10, 000.00 (in words: ten thousand, 00/100) PLN gross each.

To assess this condition, the Ordering Party it will accept only such deliveries, the complete implementation of which was within a maximum period of 2 months. This requirement is dictatedcomplex logistics of a fragmented delivery to many objects of the Employer.

2. The contracting authority may, at any stage of the procedure, consider that the contractor does not have the required capacities, if the involvement of professional resources of the contractor in other economic undertakings of the contractor may have a negative impact on the implementation of the order. In the case of contractors jointly applying for the contractand the conditions referred to - In ch. V. paragraph 1. point 2 of these SIWZ will be fulfilled only if:

1) in the case specified in V.1.2.a) one of the contractors meets the condition alone or the contractor will meet the condition in total,

2) in the case specified in V.1.2.b) at least one of the contractors will fulfill the condition on their own.

4. The Contractor may, in order to confirm fulfillment of the conditions referred to in-Chap. V. paragraph 1 point 2 of these SIWZ in appropriate situations and with reference to a specific order, or a part of it, rely on the financial situation of other entities, regardless of the legal nature of its legal relationship.

5. The Employer at the same time informs that the "relevant situation" referred to in Chapter V, paragraph 4 of this ToR will only occur if:

1) contractor, which relies on the financial situation of other entities, proves to the orderer that, when performing the order, he will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary resources for the order;

2) Ordering will assess, whether professional skills are shared by contractors, allow the contractor to demonstrate fulfillment of the conditions for participation in the proceedings and examine whether there are any grounds for exclusion referred to in art. 24 sec. 1 item 13 22 and par. 5 points 1 and 8 of the Public Procurement Law, therefore the Employer requests from the contractor, which relies on the ability or situation of other entities under the rules laid down in Article. 22a of the PZP Act, performanceswith respect to those entities of the documents listed in art. 24 sec. 1 item 13 22 and par. 5 points 1 and 8 of the Public Procurement Law

Va. The grounds for exclusion.

1. Apart from obligatory exclusions, referred to in art. 24 sec. 1 point 12-23 of the Public Procurement Law, the Orderer additionally provides for the exclusion of the contractor pursuant to art. 24 sec. 5 points 1 and 8 of the Public Procurement Law, ie respectively:

1) contractors in relation to which-liquidation was opened, in the system approved by the court. In the restructuring proceedings, the creditors' satisfaction is foreseen by the liquidation of their assets or the court ordered the liquidation of its assets pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2015, item 978, 1259, 1513, 1830 and 1844) or whose bankruptcy was announced, except for the contractor who-the bankruptcy agreement has been concluded by a legally valid court decision if the arrangement does not provide for satisfying the creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of its assets pursuant to art. 366 para. 1 of the Act of 28.2.2003 Bankruptcy Law (Journal of Laws of 2015, item 233, 978, 1166, 1259 and 1844 and of 2016 item 615);

2) which breached the duties concernce of payment of taxes, fees or social security or health insurance premiums, which the contracting authority is able to demonstrate by means of appropriate evidence, - Unless the contractor has made payments of taxes due, fees or social security or health contributions with interest or fines or has included binding agreement on repayment of these receivables

VI. List of statements or dokument-w, confirming compliance with the conditions of participation in the proceedings - and the lack of grounds for exclusion and confirming that the offered deliveries meet the requirements specified by the ordering party.

1. Each contractor must enclose with the offer a statement, valid as of the day of submitting bids, in the scope indicated in Annex 2 to the Terms of Reference (Uniform European Order Document, in the words of: EAT). informations included in the statement will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure.

The Contracting Authority informs that the Contractor, when completing the declaration on the EAT form, may also use the tool available at ec.europa.eu/growth/tools- databases / espd.

The contractor may confine himself to completing the section α of part IV forMILLIER EAT and does not have to fill any of the other sections in Part IV.

2. In the case of joint application for contractors, the statement referred to in Chap. VI. paragraph. 1 of this SIWZ is submitted by each of the contractors jointly applying for the order. This statement is to confirm the fulfillment of the conditions for participation in the proceedings, no grounds for exclusion to the extent to which everyonethe contractors demonstrate compliance with the conditions for participation in the proceedings.

3. The Contractor who relies on the resources of other entities in order to demonstrate the absence of grounds for exclusion against them and fulfill - in the scope in which he refers to their resources - the conditions for participation in the proceedings also include the statement referred to in Chapter. VI. paragraph. 1 of these SIWZ regarding these entities

4. ZamawThe President shall apply the procedure referred to in Article 24aa paragraph 1 of the Public Procurement Law. This means that the Purchaser, prior to the order being awarded, will call the contractor whose offer was the highest assessed from the point of view of accepted evaluation criteria, to submit within the prescribed period, not shorter than 10 days, valid as of the date of submitting the following documents: fulfilled by YouContractor of the terms of participation:

a) list of deliveries - Annex No. 4 to the ToR - made in the last three years before the deadline for submission of tenders, and if the period of business is shorter - in this period together with their value, subject, dates of completion and entities for which these deliveries were made and the inclusion of evidence determining whether these deliveries were madeproperly dated, whereby the evidence referred to are references or other documents issued by the entity for which the supplies were carried out, and if for a justified reason of an objective nature the contractor is unable to obtain these documents Experience of the contractor.
