The subject of the order is the delivery of computer equipment for the University of Nicolaus Copernicus in Toruń.Szczegołowo subject of the orderia is specified in Annex No. 5 to the ToR.

1. The subject of the order is the delivery of computer equipment for the University of Nicolaus Copernicus in Torun.

2. In particular, the subject of the order is specified in Annex No. 5 to the ToR.

3. The Contractor is obliged to execute the order on terms and conditions described in the contract template constituting Annex No. 6 to the ToR.

NOTE:

Form fields aboutpreaching is limited to 4000 characters, therefore the Employer publishes information about the conditions of participation in the proceedings and required documents in the points: III.1.1), III.1.2) and III.1.3) announcements. * The following numbering is identical with the provisions of the ToR:

V. Conditions for participation in the proceedings.

1. The contractors who can apply for the order are:

1) are not subject to exclusion,

2) they meet the conditionthe following: - a) financial situation: - the Contractor must document his financial situation by submitting information from a bank or a social savings and credit union confirming the amount of funds held or the creditworthiness of the contractor in the amount of at least 100, 000.00 (say: one hundred thousand, 00/100) PLN, in a period not earlier than 1 month(b) professional capacity: - the Contractor meets the condition if he shows that he has completed within the last three years before the deadline for submission of tenders, and if the period of business is shorter - at least two deliveries of computer equipment during this period with a value not less than 100, 000.00 (say: one hundred thousand, 00/100) PLN gross each.

To-assessment of this condition, the Ordering Party will accept only such deliveries, the complete implementation of which was within a maximum period of 2 months. This requirement is dictated by the complex logistics of a fragmented delivery to many objects of the Ordering Party.

2. The contracting authority may, at any stage of the proceedings, consider that the contractor does not have the required capacities if the involvement of professional resources of the contractor in other projectscontractor's economic operations may have a negative impact on the order's performance.

3. In the case of contractors jointly applying for the award of the contract, the conditions referred to in Chapter V. paragraph 1. point 2 of these SIWZ will be fulfilled only if:

1) in the case specified in V.1.2.a) one of the contractors will meet the condition independently or contractors meet the condition in total,

2) in thespecified in V.1.2.b) at least one of the contractors will fulfill the condition on their own.

4. The Contractor may, in order to confirm fulfillment of the conditions referred to in Chapter V. paragraph 1 point 2 of this SETC, in relevant situations and in relation to a specific order, or a part thereof, rely on the professional abilities or financial situation of other entities, regardless of the legal nature-his legal relations with him.

5. The Employer at the same time informs that the "relevant situation" referred to in Chapter V, paragraph 4 of this SIWZ will occur only when:

1) the contractor, which relies on the abilities or situation of other entities, will prove to the Ordering Party that by completing the order, he will had the necessary resources of these entities, in particular presenting

2) The Employer will assess whether or not the professional capacities made available to the contractors by other entities allow the Contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether the entity is subject to this exclusions referred to in art. 24 sec. 1 item 13 22 and par.5 points 1 and 8 of the Public Procurement Law, therefore the Employer requests from the contractor, which relies on the capacities or situation of other entities on the principles referred to in art. 22a of the Public Procurement Law Act, to present documents referred to in art. 24 sec. 1 item 13 22 and par. 5 points 1 and 8 of the Public Procurement Law - grounds for exclusion.

1. Apart from obligatory exclusion clauses referred to in art. 24 sec. 1 point 12-23 of the Public Procurement Law, the Orderer additionally provides for the exclusion of the contractor pursuant to art. 24 sec. 5 points 1 and 8 of the Public Procurement Law, ie: -1) contractors in relation to which the liquidation has been opened, in the court-approved system. In the restructuring proceedings, the creditors are expected to liquidate their assets or the court ordered the liquidation of its assets inin art mode 332 par. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2015, item 978, 1259, 1513, 1830 and 1844) or whose bankruptcy was announced, with the exception of the contractor who, after the bankruptcy, concluded an arrangement approved by a legally binding decision court, if the arrangement does not provide for the satisfaction of the creditors by liquidating the assets of the bankrupt, unless the court ordered its liquidation-property pursuant to art. 366 para. 1 of the Act of 28.2.2003 Bankruptcy Law (Journal of Laws of 2015, item 233, 978, 1166, 1259 and 1844 and of 2016 item 615),

2) which breached duties regarding tax payments, fees or social security or health insurance premiums, which the contracting authority is able to demonstrate by means of appropriate evidence, - Unless the contractor has made a payment dueh taxes, fees or social security or health contributions with interest or fines, or have entered into a binding agreement regarding the repayment of such claims.

VI. A list of statements or documents confirming fulfillment of the conditions for participation in the procedure - And no grounds for exclusion and confirming that the deliveries offered comply with the requirements specified by the ordering party. DownEach contractor must include a statement, valid as of the day of submitting bids, in the scope indicated in Annex 2 to the Terms of Reference (Uniform European Order Document, abbreviation: EAT). The information contained in the statement will constitute preliminary confirmation that the contractor is not subject to exclusion and fulfills the conditions for participation in the procedure.

The Contracting Authority informs that the Contractor on completing the axisThe EAS form may also be used by the tool available at ec.europa.eu/growth/tools-databases/espd. The contractor may confine himself to completing section α of part IV of the EAT form and does not have to fill in any of the other sections in Part IV.

2. In the case of joint application for contracting by contractors, the statement referred to in Chapter VI. 1 of this SIWZ compositionwill give each of the contractors jointly applying for the order. This statement is to confirm the fulfillment of the conditions for participation in the proceedings, no grounds for exclusion to the extent that each of the contractors demonstrates fulfillment of the conditions for participation in the proceedings. Contractor who refers to the resources of other entities in order to demonstrate the lack of grounds for exclusion and fulfillment in themthe extent to which they refer to their resources - the conditions for participation in the proceedings are also submitted by the statement referred to in Chapter VI. 1 of these SIWZ regarding these entities

4. The contracting authority will apply the procedure referred to in art. 24aa paragraph 1 of the Public Procurement Law. This means that the Purchaser, prior to the order being awarded, will call the contractor whose offer has been rated the most from the point of view ofh criteria for the evaluation of bids, to submit within the prescribed period, not shorter than 10 days, valid as at the date of submission of the following documents:

1) In the scope of demonstrating compliance by the Contractor with the terms of: a) list of deliveries - attachment No. 4 to the ToR - made in the last three years before the deadline for submission of offers, and if the period of business is shorter - in this periodtogether with the specification of their value, subject, dates of completion and entities for which these deliveries were made and the inclusion of evidence determining whether these deliveries were made duly, the evidence referred to is references or other documents issued by the entity for the benefit of which deliveries were made, and if for a justified reason about the objective nature of the lecturethe marketer is not able to obtain these documents, the contractor's statement
