It is estimated that a minimum number of 16 will be assigned of subsequent contracts for the entire period of the framework agreement, the first subsequent contract is estimated to be awarded within the first 6 months from the datethe estimated agreement for the framework agreement due to the lack of space see Annex no. 1 to this data sheet

Estimated value min./max. per framework agreement: VEmin = 22 718 625 RON, VEmax = 346 003 000 RON.

Requirement no. 1. Failure to comply with the situations provided in art. 177 of Law 99 / 2016.

Requirement no. 2. Failure to comply with the situations provided in art. 178 and 180 of Law 99 / 2016.

Requirement no. 3. Failure to comply with the situations provided in art. 73 of Law 99 / 2016.

For the purposes of the provisions of art. 76 paragraph (1) of Law 99/2016, the contracting entity specifies thatthe persons with decision function within the contracting entity involved in the award procedure are:

- Adriana Voicu director of the Procurement and Government Department Petrman (the procurement unit responsible for carrying out the public procurement procedure)

Failure to comply with the situations provided for in requirements 1, 2 and 3 will be requested both to the single tenderer, and in the case of an association of each member of the association, the subcontractor and the third party by completing in DUAE of Part III: "Reasons for exclusion", chapter A: "Reasons regarding the criminal convictions", ch. B:" Reasons for paying taxes or social security contributions "and ch. C "Reasons related to insolvency, conflict of interest or professional misconduct".

Fulfillment mode: the DUAE will be presented by the economic operators participating in the award procedure, according to article 202 paragraph (1) of Law 99/2016, completing the sections related to the requirements requested moretop.

The supporting documents proving the fulfillment of those assumed by completing the DUAE, will be presented, at the request of the contracting entity, only by the bidders ranked on the first 3 places after the finalization of the evaluation of the bids. lack of outstanding debts regarding the payment of taxes, taxes or contributionsto the general consolidated budget (local budget, state budget, etc.). They will be presented only for the registered offices for which there are payment obligations. From these documents it must be shown that the tenderer does not have outstanding debts at the time of their presentation;to the economic operator or to those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document, valid at the time of their presentation;

3) as the case may be, documents by which demonstrates that the economic operator can benefit from the derogations provided in art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 on sectoral acquisitions;

4) other edifying documents, as the case may be.

For the demonstration of the capacity of exercising the professional activity the contracting entity requests the offeror:

Requirement no. 1.

Natural / legal persons, Romanian / foreign:

The economic operators submitting the offer must prove a form of registration under the law of the country of residence inthat it turns out that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution, as well as the fact that it has professional capacity to carry out the activities that are the subject of the subsequent contract / framework agreement.

Specify the average annual turnover. Requirement no. 1. The average annual turnover for the last 3 financial years (2016, 2017, 2018) must be a minimum: RON 22 500 000 (excluding VAT).

All the award documentation is available in SEAP. We mention that for the visualization of the documentation of attribution uploaded in SEAP, the economic operators muste have installed a program necessary to view the electronically signed files, this program being available on the websites of the electronic signature providers. The economic operators who download the present attribution documentation directly from the attachment to the participation announcement published in the SEAP have the obligation to follow in the SEAP the various communications made by the entityof the contracting party, as a result of clarification requests requested by some potential bidders.

To the extent that requests for clarifications or additional information were addressed within the deadline stipulated in the participation notice, respectively at the latest 19 days before the deadline for submission of the tenders, the contracting entity will respond clearly and completely to all requests forclarifications or additional information on the 10th day before the deadline set in the participation notice for the submission of tenders, according to the provisions of art. 172 of Law no. 99/2016. The contracting entity will only respond to the requests for clarifications addressed by the economic operators until the established deadline, according to the provisions of art. 29 paragraph (3) of GD 394 / 2016.

Requests forclarifications regarding the attribution documentation from the interested economic operators and implicitly the corresponding answers from the contracting entity, will be transmitted exclusively through SEAP, according to art. 172 para. (3) of Law 99/2016 and of the Notification issued by ANAP on 6.9.2016.

Non-resident bidders will submit authorized translations in Romanian of all documentariesor requested in the present award documentation.

The DUAE will be presented in .xml and .pdf format (for the single tenderer, each member of the association / subcontractor / third party supporter, as the case may be). In order to complete the DUAE, the economic operator (individual or member of the association; third party (s) and / or subcontractor (s) must have an active account in SEAP (respectively each participant in the procedure): the members of the association, the third party (s) and / or the subcontractor (s) must have this active account). In order to complete the DUAE, the instructions provided in the DUAE user guide "Information for Economic Operator", available on the SEAP platform, will be observed.
