Bavarian State Criminal Police Office: Procurement of an Infotainment System Police (ISP)

Fuer the @car area is the conception / development and introduction of an infotainment system police (ISP) as an "ICT anchor point" (Bordrechner) in official vehicles of the Bavarian police. This should include a simplified and integrated application, in particular the functions of digital radio and special signal control, mission data transmission and navigation.

For the @car area, the concept / development and introduction of an infotainment system police (ISP) is as "ICT anchor point" (on-board computer) in Dieoriginal vehicles of the Bavarian police intended. This should include a simplified and integrated application, in particular the functions of digital radio and special signal control, application data transmission and navigation.

Likewise, further innovations in the field of vehicle and communication technology are advised to ensure continuous development based on the tacticaltechnical and operational requirements. The high ICT security standards, as with all ICT systems in use by the police, must also be guaranteed in this context.

As part of the Police 2020 initiatives, the federal and state police are cooperating and consolidating in many facets of police work fieldsthereby also requirements for management and operational resources. The Free State of Saxony has long been using technology similar to the ISP in its core functions in the sense of an interactive radio patrol car. The future-oriented further development of interactive components at the Sachsen police is to be achieved through a cooperation between the Bavarian and Saxon police through the procurement of ISP eand implemented both in the Free State of Bavaria and in the Free State of Saxony.

The aim of this procurement measure is to procure uniform ISPs for the police forces of the Free State of Bavaria and the Free State of Saxony on the basis of a framework agreement.

Evaluation:

For each 1 000 000 EUR higher coverage sum, the applicant receives one (1) evaluation point (BP).

A maximum of 10 BP can be achieved.

In the negotiation process, an "evaluation test" of the offered ISP will take place.

"Implications under public procurement law andInformation ":

The purpose of the following explanations is to enable the bidders to be able to assess the proposed valuation procedure in its entirety and its admissibility in terms of procurement law.

As already mentioned, user acceptance has an outstanding significance for the current procurement measure the beneficiaries. For this it is overIt is essential for the client to involve not only a few, but rather a representative number of future users in the procurement measure. This is done by the approximately 100 test users made up of patrol officers (m / f / d) in the course of the evaluating test for the ISP in the operational vehicles used in real operation at the test service centers.

Durch This high number of test users and their "unprejudiced" in the matter of "ISP" combined with the chosen scientifically established procedure (see section 3.4.4.1 of document 6.2_FSBayern_ISP_Bewerbungsbedingungen_VHV), which is supervised by an independent third party, the UniBw, the objective is, Resilience and traceability of the results of the evaluatingDue to this high number of test users, it is actually not possible for the client, in addition to filling out the questionnaires by the testers (= answering the questions asked by ticking the intended check options), and a justification in text form (prose ) for each cross marked in the questionnaire.

SomIt is the respective inner motivation for placing a cross for the PG vehicle IUK or the client is not apparent and ultimately verifiable. However, due to the large number of test users, this fact is weighed from the perspective of the client.

In the light of Section 8 (1) VgV and the recent higher judicial ruling on public procurement law, in particular that of the Federal Gerichtshofs, one could possibly come to the opinion that this lack of justification in text form (prose) represents a lack of documentation for each cross placed in the questionnaire and feasibility of an award procedure must and is permissible, with stown number of evaluators (here: test users) to lower the requirements for the documentation of the evaluation procedure; at least with a very high number of evaluators / testers, as is the case here with around 100 peopleng the bidders have a claim (Section 97 (6) in conjunction with (1) sentence 1 GWB). If a bidder is of the opinion that his rights have been violated, he can object to the client and, in the event of non-remedy, submit a review request to the competent public procurement tribunal. Reference is made to sections VI.4.1) and VI.4.3) of this contract notice. The rueagainst alleged violations of public procurement law also represents an obligation of the bidder towards himself.

By submitting his indicative initial offer, the bidder agrees with the procedure described in the tender documents, in particular these application conditions, for the evaluation of the test and its documentation as a whole.
