The contract is awarded to a competent, efficient and reliable (suitable) undertaking (tenderer / consortium / third parties in the case of suitabilityloan), - 122 GWB. Suitability must be demonstrated by the bidder / consortium of each member / third party in the case of the suitability lending separately by self-declaration by means of Form L 124 EU. The self-declaration relates to the absence of exclusion reasons (exclusion in accordance with - 44 VGV in connection with -- 123, 124 GWB), information on the payment of taxes, dutiesand contributions to the statutory social security system as well as information on insolvency proceedings and liquidation.

Tenderers or members of a consortium must have adequate reinsurance coverage with German and / or international reinsurance companies with a high credit rating. The same applies to the third party in the case of the suitability lending. The bidder / members of a biddercompany / third party in the case of a qualifying loan has / have to declare the existence of the reinsurance protection in the attachment "0239_Branch" on the sheet "Confirmations". Upon special request of the awarding authority, the reinsurance cover must be proven.
