Providing dairy products for pupils in primary and secondary educationstate and private as well as preschool children from state and private kindergartens with a normal 4-hour program on the territory of Buzau County during the school years 2017 2018, 2018 2019, 2019 2020, according to the provisions of O.G. no. 13/2017 and H.G. no. 640/2017, as well as the Common Order of A.N.A.P. and the Ministry of Agriculture and Rural Development no. 19 / 2018.

Dairy supply for pupils in primary and secondary education of state and private as well as preschool children from state and private kindergartens with a normal 4 hours program in Buzau county within the Program for schools during the years school pupils 2018 2019, 2019-2020, 2020-2021, in accordance with the provisions of the OG no. 13/2017and H.G. no. 640/2017, as well as the Common Order of A.N.A.P. and the Ministry of Agriculture and Rural Development no. 19 / 2018.

Delivery of milk and dairy packages in the terms of the specification and the annex to the tender specifications will be as follows: - The minimum and maximum amounts estimated on the framework agreement are as follows: Lot 1: minimum 2, 829, 645 - maximum 3.717 million; Minimum and maximum quantitiesestimated on the contracts following the framework agreement are: Lot 1: minimum 431, 184 - maximum 566, 400. The estimated value of the largest subsequent contract is RON 453, 120.00 without TVV.

The bidders, the third parties and the subcontractors MUST NOT find themselves in the situations provided by art. 164, 165 and 167 of Law no. 98/2016

The DUAE will be completed by all participating economic operators(tenderers / associate tenderers / subcontractors / third-party supporters) with the information that characterizes their capacity. The supporting documents shall be submitted under the conditions of art. 196 par. 2 of Law 98/2016 by the bidders placed on the first three places after the application of the award citation, respectively after the application of the electronic auction stage. Documents justified• These documents may be: a) Certificate of absence of debts regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment b) The judicial record of the economic operator, or those having the power of representation, (c) where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in Art. 166 par. (2), art. 167 par. The average of the tenderer's global turnover for the last 3 years, respectively 2015, 2016, 2017, must be at least equal to : 453, 120.00 RON, VAT excluded, for Lot 1- representing the estimated value of maand a large subsequent contract (excluding VAT); RON 183, 552.00 excluding VAT, for Lot 2- representing the estimated value of the largest subsequent contract (excluding VAT); RON 379, 161.60 excluding VAT, for Lot 3 - representing the estimated value of the largest subsequent contract (excluding VAT); RON 347, 020.80, excluding VAT, for Lot 4 - representing the estimated value of the largest subsequent contract (excluding TVA); 415.564, 80 RON, without VAT, for lot 5 representing the estimated value of the largest subsequent contract (excluding VAT).

Since the contracting authority will sign the framework agreement only with economic operators placed on the 1st, 2nd, 3rd, as the case may be, the way of bidding with equal prices will be as follows:

1) If the commission finds that they have been deposited / entered in SICAP more than 2 admissible tenders with equal prices to the 1st rank bidders, the contracting authority will request the submission of new improved financial proposals (with 2 decimal places) and the economic operators will send their reply in a closed envelope, in which case the framework agreement will be awarded to the first three bidders who have the lowest price; 2) If the commission finds that they havemore than 2 admissible tenders with equal prices were submitted by the second rank bidders, the way of their distribution will be made by requesting enclosed new implied financial proposals (with 2 decimal places) and the economic operators will submit the answer so that the bidder ranked first is not affected, ie the new financial proposal will beu is equal to or less than the ranked first place. If the new financial proposal that is improved as a result of the request of the contracting authority will influence the rankings of senior positions, this will not be taken into account, keeping in mind the initial offer submitted to SEAP, 3) If the commission finds that more than 2 admissible offers have been submitted to theequal opportunities by the third-placed bidders, the way of their distribution will be made by applying for a new financial proposal (with 2 decimal places) in a closed envelope, and the economic operators will send their answer so that the bidders placed on the place I and II are not affected, ie the new financial proposal is not equal to or less than the offerranked I and II respectively.
