1. The subject matter of the order is granting a long-term loan in the Polish currency to the Commune of Dywity, in the amount of PLN 9, 600, 000.00 (nine million six hundred thousand zlotys) to cover the planned budget deficit and repayment of the previously contracted liabilitiesbonds due to loans taken out and service related to the repayment of loans and interest installments.

1. The subject matter of the order is granting a long-term loan in the Polish currency to the Commune of Dywity, in the amount of PLN 9, 600, 000.00 (nine million six hundred thousand zlotys) to cover the planned budget deficit and repayment of previously incurred loan liabilitiesloans and service related to the repayment of loans and interest installments.

1. The Contractors who are not subject to exclusion from the procedure for awarding the order in the circumstances referred to in art. 24 sec. 1 of the Act of 29.1.2004. The Law of Public Procurement and fulfill the condition of participation in the proceedings.

Condition for participation in the proceedings:

Competences or entitlements to conduct a specific professional activity, if it results from separate regulations: - Determining the condition: Contractors who have valid (valid) entitlements to perform banking activities in the scope of services covered by the subject of the order may apply for the order, in accordance with the Act of 29.8.1997 Banking law (single text Journal of Laws of 2018, itemz. 2187 z o. In the case of Contractors jointly applying for the award of a contract, the condition must be met by at least one of the Contractors.

List of statements or documents confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion:

1. Contractor for the preliminary confirmation that he is not subject to exclusion and meets the conditions for participation in the proceedingsis to submit together with the offer:

- valid as of the date of submitting offers. Single European Order Document (EAT).

2. List of statements or documents submitted by the contractor in the proceedings at the request of the Employer to confirm the circumstances referred to in Article 25 para. 1 point 3 of the Public Procurement Law:

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 points 13, 14 and 21act, issued no earlier than 6 months before the deadline for submitting bids;

2) a statement by the contractor about the lack of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums; such a judgment or decision - documents confirming the making of a paymentincluding any interest or fines, or a binding agreement on the repayment of such claims; - 3) a statement by the economic operator about the lack of a ruling against him as a preventive measure for the prohibition of applying for public orders.

3. List of statements or documents submitted by the contractor in the proceedings at the request of the Employer to confirm the circumstancesbones referred to in art. 25 para. 1 point 1 of the Public Procurement Law in respect of meeting the conditions for participation in the proceedings: - authorization to start banking activity (permission of the Polish Financial Supervision Authority to start banking operations, referred to in Article 36 of the Banking Act of 29.8.1997 (Dz. U. of 2018, item 2187, as amended) or other relevant document authorizingbanking activity in accordance with applicable law.

4. Other documents:

1) Contractor`s statement about belonging or not belonging to the same capital group. In the case of belonging to the same capital group, the contractor may submit together with the statement documents or information confirming that connections with another contractor do not lead to distortion of competition in the posfor contracting the order.

In the case of Contractors jointly applying for the ordering of the above-mentioned the statement is submitted by each of the Contractors on their own behalf.

The statement should be submitted within 3 days from the date of placing the information on opening the offers on the Contracting Authority`s website. 2) Power of attorney to sign and submit the offer - if the authorization does not result from the documentsappropriate for the Contractor`s organizational form (eg: court register, entry in the business register).

3) Power of attorney to represent the Contractors referred to in art. 23 par. 2 of the Public Procurement Law - in the case when the Contractors jointly apply for the award of the order.
