Delivery of buried container - 67 pcs. (1) Bidders (including associates), supporting third parties and subcontractors shall not be present in the situations referred to in art. 164, art. 165 and art. 167 of Law no. 98/2016 on Procurement - How to demonstrate the fulfillment of the requirement: DUAE will be completed-by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted at the request of the contracting authority only to the bidder ranked first at the completion of the tender evaluation.

These documents may be, but are not limited to:(a) the certificates showing the absence of debts in respect of the payment of taxes, taxes or contributions to the state, including the local taxes, that the bidder does not have outstanding debts at the time of presentation. the general consolidated budget (state budget, local budget, etc.) at the time of presentation.

Certificates(b) where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in Article 3 (1). 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement, (c) non-resident economic operators (foreigners) have the right to present any editorial documents, issued by the authorities of the country in which they are resident, proving the fulfillment of the outstanding obligations to pay the taxes to the state budget and the local budget in accordance with the legislation of the resident country. Documents shall be submitted accompanied by their authorized translation into the Romanian language, (d) other editing documents, as appropriate, - the criminal record of the operatothe economic operator and the members of the administrative, management or supervisory body of the respective economic operator or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act.

The way to demonstrate that the requirement is met: The operators will be complemented by the DUAEeconomic operators participating in the award procedure with the information related to them. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, only to the bidder ranked first in the evaluation evaluation of the tenders; 2) The bidders (who participate in the awarding procedure individually or in common with other companieseconomic agents), third parties and subcontractors must not find themselves in conflict with any of the following persons holding decision-making positions within the contracting authority:

If two or more ranked first rankings with equal scores are scored, the score will be based on the score obtained in the assessment factors in decreasing order of their weight.
