The subject of the contract includes the execution of Robot bfor sanitary sewage system construction in the Masłow commune under Contract 1: Task 3 "Construction of the sanitary sewage system in the Masłow commune. Gravity channels in the Barcza village ", implemented as part of the Project entitled" Improvement of sewage management in the Kielce metropolitan area "co-financed from the Cohesion Fund under the Operational ProgramInfrastructure and Environment 2014 2020, Measure 2.3 "Water and wastewater management in agglomerations" according to the Contract Conditions for construction for engineering and construction works designed by the Employer, the first edition in English 1999 published by the International Federation of Engineers and Consultants (Federation Internationale des Ingenieurs-Conseils - FIDIC) PO Box 311, CH-1215 Geneva 15, Switzerland, and the fourth English-Polish edition 2008, (red FIDIC).

Main Site: Gmina Masłow, Barcza village

1. Implementation of the subject of the contract includes:

- construction of gravity sanitary sewers with a length of approx. 2.17 km from solid PVC SN12 socket pipes connected with elastomer seals with a diameter of 0 200x6.5mm,

- construction of a pressure pipeline with a length of approx. 0.4 km with PE 0 110 pipes,

- construction of one PL8.1 sewage pumping station,

- construction of sections of connections belonging to the network (ONS-y):

• length of about 0.43 km from PVC SN8 solid pipe pipes connected with elastomer seals with a diameter of 0 160 x 4, 7 mm.

2. The Employer informs that the bill attached to the ToR serves solely as an auxiliary material and does not constitute the basis for preparing the offer by the Contractor. The basis for obcalculating the flat-rate price of the offer is the Description of the subject of the contract, which includes Construction and Executive Projects with attachments, which are part of the Design Documentation attached to the ToR and STWiORB. When determining the amounts, the Contractor should refer to the terms of the contract, Technical Specifications for the Performance and Acceptance of Construction Works, Design Documentation, information, instructionsand or descriptions of the robot and the materials used.

3. The subject of the contract also includes restoration works related to the restoration of the area to the condition in accordance with the conditions of restoration of the surface issued by road managers, execution, agreement and approval of traffic organization projects and the payment of the road lane in accordance with administrative decisions, payment of the feefor the possible seizure of real estate for the needs of the construction site or for other purposes of carrying out the task during the period of execution of the works, conducting final tests, costs of removing any defects in the works. The contractor will also perform the activities necessary to commission the robot.

4. The contractor is also obliged to take over the construction site, clean up the area of works after their completion (adjfor the original state) no later than the date of the technical acceptance of the robot (date of issue of the Take-over Certificate) and for leaving the whole area of the robot after completion of the work in order, clean and usable.

The Employer informs that the Contractor should take into account the successive connection of subsequent residents to the newly built network, including residents not included in the project, without submitting claims by the Contractor and without losing the warranty for defects for the Employer, for which youthe contractor agrees.

5. The contractor must submit the works to the Customer Service Office Wodociągow Kieleckich Sp. z o.o. "Notification of joining the robot".

Public procurement can be requestedContractors who meet the following conditions for participating in the procedure:

1. are not subject to exclusion from the procedure in the circumstances specified in: art. 24 paragraph 1, art. 24 paragraph 5 point 1), 2), 4), 8) of the Public Procurement Law, subject to the provisions of art. 133 section 4 of the Public Procurement Law,

2. meet the conditions for participation in the proceedings:

1) regarding technical or professional ability - in accordance with point III.1.3);

2) regarding peconomic or financial standing - in accordance with point III.1.2).

1. The Contractor is obliged to attach to the Offer the following documents:

1) To demonstrate compliance with the conditions for participation in the procedure and the lack of grounds for exclusion specified by the Employer in item 10 of the IDW, a statement in the form of a single European order document (EAT) prepared in accordance with a standard templateon the form specified in the European Commission implementing regulation issued on the basis of art. 59 clause 2 of Directive 2014/24 / EU and art. 80 clause 3 of Directive 2014/25 / EU, hereinafter referred to as the Single European Order Document or EAT, in electronic form with a qualified electronic signature. On the website of the PPO there is the `Instructions for submitting a single europePolish order document using electronic means of communication. "

The information contained in the document will constitute preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure.

2) Appropriate power of attorney (a) - if the authorization to sign the offer does not results directly from an excerpt from the relevant register or if the offer is not signed by Wykthe contractor.

3) In the case of Contractors jointly applying for the award of a contract, a document establishing the Proxy to represent them in the contract award procedure or to represent them in the procedure and conclusion of the contract on this public contract.

4) Obligation of a third party if the Contractor demonstrating that the conditions for participation in the proceedings have been metega on the abilities or situation of other entities (according to the template constituting Annex 6 to the IDW).

5) A complete Price List in accordance with Annex 7 to the IDW.

Documents referred to above should be submitted in accordance with the rules set out in point 16 of IDW.

2. In the event of joint application for the Contractors by the Contractors, a declaration in the form of a Single European Order Document (EAT) shall be made by each of thewcow jointly applying for the contract. These statements are to confirm the fulfillment of the conditions for participation in the procedure, the lack of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure and the lack of grounds for exclusion. These declarations should take the form of an electronic document signed with a qualified electronic signature.

3. Contractor, whory refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion against them and to meet the conditions for participation in the proceedings, to the extent that they refer to their resources, also submits the uniform documents (EAT) indicated above, regarding these entities, as well as submits with respect to these entities the documents listed in 11.5.4) IDW. Entity statementsin those sharing the potential submitted on the EAT form should be in the form of an electronic document signed by a qualified electronic signature by each of these entities to the extent that they confirm the circumstances referred to in art. 22 paragraph 1 of the Public Procurement Law

The Employer informs that he will first evaluate the offers and then examine whether the Contractor whose bid was assessed asmore favorable, not subject to exclusion and meets the conditions for participation in the procedure on the principles set out in Article. 24aa of the Public Procurement Law

the Contractor will meet the conditions for participation in the proceedings regarding the economic or financial situation (in the case of joint application of two or more Contractors for the award of this contract, their total economic or financial situation will be assessed, includingthe purpose of the documents is required to be submitted by those or those of the Contractors who on behalf of all will demonstrate compliance with this condition), if they demonstrate that:

a) has financial resources in the amount of at least PLN 400, 000.00 or has a credit capacity of at least in the amount of PLN 400, 000.00;

b) has civil liability insurance in respect of related activitieswith the subject of the contract for an amount of at least PLN 2, 500, 000.00 net.

1. The contracting authority provides for the possibility of awarding the contracts referred to in art. 134 section 6 point 3 of the PPL Act consisting in the repetition of works consistent with the subject of the order - in accordance with point 6 IDW.

2. The Contractor within 3 days from the date of posting on the website the information referred to in art. 86 section 5Public Procurement Law Acts will provide the Employer with a statement (in the form of an original) on belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the PPL, prepared in accordance with Annex No. 5 to the IDW. Along with submitting the declaration, the Contractor may provide evidence that links with another Contractor do not lead to a distortion of competition in thigh proceedingsordering.

3. The Awarding Entity, before awarding the contract, will call the Contractor whose tender has been rated the highest to submit it within a designated period, not shorter than 10 days, valid on the day of submitting the declarations or documents specified in point 11.5 IDW.

4. In order to confirm the lack of grounds for excluding the Contractor from participation in the procedure, the Employer requests the submission of documents in accordance withfrom point 11.5.4 IDW, i.e.: information from the National Criminal Record in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the PPL Act issued not earlier than 6 months before the deadline for submission of bids;

b) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with tax payment, issued not earlier than 3 months before the deadlinesubmitting bids or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of outstanding payments or withholding in full the execution of the decision of the competent authority ;

c) certification of the relevant siteentry of the organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund (Kasa Rolniczego Ubezpieczenia Społecznego) or other document confirming that the Contractor is not in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or another document confirming that the Contractor has concluded an agreement with the right fatherin the matter of repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or distribution in installments of overdue payments or withholding in full the execution of the decision of the competent authority;

d) an excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry toregister or records to confirm the absence of grounds for exclusion under Article 24 paragraph 5 point 1 of the Public Procurement Law;

e) the Contractor`s statement that he has not issued a final court judgment against him or a final administrative decision on arrears in the payment of taxes, fees or social security or health insurance contributions, or - in the case of such a judgment or decision - documents pconfirming the payment of these claims together with any interest or fines or concluding a binding agreement on the repayment of those debts;

f) the Contractor`s statement that there was no decision against him as a preventive measure prohibiting him from applying for public contracts;

g) the Contractor`s declaration of non-payment taxes and local fees referred to in paraw of 12.1.1991 on local taxes and fees (consolidated text of the Journal of Laws of 2018, item 1445, as amended).
