The following declarations are requiredare made and digitally signed in accordance with articles 19, 46 and 47, of the DPR n. 445/2000 by the candidate`s legal representative or by a person with suitable powers, as specified in the tender documentation.

Each declaration must contain the reference to the race code, the CIG code, and an indication of all the elements necessary for finding of information and dethe data object of the declarations themselves. The candidate, in support of the application, must declare / produce / certify / indicate, in the manner indicated in the tender documents:

a) registration with the C.C.I.A.A .; in the case of a candidate belonging to another Member State not resident in Italy, an equivalent act or declaration of registration in the professional and commercial registers, topursuant to art. 83, paragraph 3, of the code;

b) not to fall under any of the conditions provided for by art. 80 of the code (excluding letter m, paragraph 5) and not to incur in the additional causes of exclusion pursuant to art. 80, paragraph 5, lett. c), c-bis), c-ter), c-quater), f-bis) and f-ter), and of not having committed the crime of false corporate communications pursuant to arts. 2621 and 2622 of the Italian Civil Code, di referred to in paragraph 1, lett. b-bis) of the code;

c) the absence of grounds for exclusion from the procurement procedures pursuant to art. 53, paragraph 16 ter, of Legislative Decree no. 165/2001;

d) only for economic operators admitted to the arrangement with business continuity pursuant to art. 186 bis of the R.D. 16.3.1942, n. 267, or who filed the application pursuant to art. 161, paragraph 6, of the aforementioned RD 267/1942: please refer to the provisions of the combined provisions of Legislative Decree 50/2016 and RD 267/1942;

e) in the case of RTI, ordinary consortium or EEIG established, the related articles of association, statute or contract; in case of RTI or ordinary consortium not yet constituted, declaration of commitment, signed by all or legal representatives, to form a grouping or a consortium, in the case ofthe award of the contract and, in the case of RTI, the company that will be designated as the agent will also be indicated at the same time.

For the design service provider, possibly participating in the tender, as associated or indicated by the competitor performing the work:

f) the declarations referred to in letters a), b), c) and d) above, if the service provider both organizein corporate form and, as applicable, if the service provider is a freelancer;

g) declaration relating to the requirements of the Ministerial Decree 2016 n. 263 in relation to the design service provider; the competitor not established in Italy but in another Member State or in one of the countries referred to in art. 83, paragraph 3, of the code, presents registration in a special register cocorrespondent foreseen by the national legislation of belonging or sworn declaration or according to the modalities in force in the State in which it is established;

h) registration in the specific professional registers foreseen for the exercise of the activity subject to the tender of the professional who is the person personally responsible for the `duties; the competitor not established in Italy but in another Member Statebro or in one of the countries referred to in art. 83, paragraph 3, of the Code, presents registration in a special corresponding register provided by the national legislation of belonging or sworn declaration or according to the procedures in force in the State in which it is established; the competitor must indicate the name, professional qualification and details of the registration in the professional register;

i) indication of a fire-fighting professional registered in the Ministry of the Interior`s list pursuant to art. 16 of Legislative Decree 139 of 8.3.2006 as a firefighting professional.

For the competitor performing the work

a) Pursuant to art. 84, paragraph 7, letter a), of the code, declaration concerning the realization of a turnover, obtained with works carried out through direct activityand indirect, in at least 5 of the 10 years preceding the publication date of the notice, not less than 2 times the amount of the works based on the tender referred to in point II.1.5) of the notice, equal to 926 333 892.14 EUR, made by means of the form of the European Single Competition Document ESPD part IV section B (turnover).

For the design service provider

b) global turnover statement forservices pursuant to art. 3, point vvvv, of the code carried out in the best 3 years of the last five years prior to the publication date of the notice, for an amount equal to 1 (once) the amount of the design costs (5 921 093.56 EUR), foreseen in the contract, made by means of the European Single Contract Document form, DGUE, part IV, section B (turnover).

The required documentation dovra, under penalty of inadmissibility of the requests to participate, received within the deadline referred to in point IV.2.2) exclusively online, therefore, candidates not yet registered on the ANAS Purchasing Portal will have to register quickly on the aforementioned Portal following the operating instructions present in the section of the Portal itself, to which reference is made in full (assistance number telefonica: 39 02266002642).

The application and all documentation to be produced must be in Italian or accompanied by a sworn translation. The amounts declared must be in EUR.

Pursuant to art. 95, paragraph 12, of the code, ANAS S.p.A. reserves the right not to proceed with the award if no offer is convenient or suitable in relation to the object of the apphigh.

Requests for clarifications can only be made through the Portal functions https://acquisti.stradeanas.it, by only the competitors registered on the Portal as well as those qualified for the race, using the tool, available in the reserved area, dedicated to this race. In any case, we will provide feedback only to requests for clarifications regarding thethis announcement, received no later than 12:00 on 19.2.2020. This announcement does not bind ANAS S.p.A. neither to the completion of the tender, nor to the distribution of the invitations, nor to the subsequent award. ANAS S.p.A. expressly reserves the possibility to cancel the race or to modify or postpone the terms at any time and at its sole discretion, without the candidatesthey can make claims of any kind and nature. The award, also subject to the fulfillment of all the conditions, of any nature including those related to the total financing of the contract, by law, regulation and bankruptcy proceedings preparatory to the performance of the service, is not binding for ANAS SpA and does not give right to the stipulationof the contract or to any claim, claim, expectation or request of any kind from the competitors and the successful tenderer.

The costs relating to the publication of the notice and the notice on the results of the award procedure are to be borne by the contractor these costs are estimated for an approximate amount of 200, 000.00 EUR.
