The subject of the order is the construction of a gas network in the Warsaw Agglomeration divided into parts specified in Section II.2 of the Announcement. : Rejon ul. Bouquet, ul. Kolberg, street J. Kaczmarskiego, ul. Joliot Curie, ul. Woronicza in the Capital City of Warsaw-District Mokotow

Stage IV.6 provides for the execution of construction works involving the construction of a medium-pressure gas network in the area of ul. Bouquet, ul. Kolberg, street J. Kaczmarskiego, ul. Joliot Curie, ul. Woronicza in the Capital City of Warsaw District Mokotow consisting in particular in the reconstruction of existing steel sections of the low pressure gas network on the medium polyethylene networkpressure using the relining method and the open excavation method together with the adaptation of the modernized network to work at medium pressure.

I. Contractors, who are:

1), are not subject to exclusion from the procedure,

2) They meet the following conditions for participation in the proceedings:

a) They have the authority to perform a specific activity or activity if the law imposes an obligation to have such rights: does not specify this condition;

b) Have technical skillsand professional referred to in point III.1.3) announcements

c) They are in an appropriate economic and financial situation, ensuring the execution of the public co-financed order in accordance with the requirements set out in point III.1.2) notices Contractors are excluded from the proceedings on the basis of the following premises: a) in Article 24 paragraph 1 of the PPL, with the exception of art. 24 sec. 1 point 13 lit. d, in conjunction from art. 133 par. 4 Public Procurement Laws (b) in art. 24 paragraph 5 points 1) and point 8) Pzp.

II. Documents and declarations submitted together with the offer by all Contractors:

NOTE: EAT must be submitted in electronic form bearing a qualielectronic signature in accordance with the requirements specified in SIWZ

3) Proof of payment of the bid security in accordance with the requirements of the ToR - 4) Power of attorney to sign the offer - if applicable - 5) Obligation of the third party to share resources - Annex No. 6 to the ToR - if applicable - 6) Declaration of belonging or non-affiliation to the same capital group (Annex No. 7 to-SIWZ), submitted by Contractors within 3 days from the date of placing by the Employer on the website information referred to in Article. 86 par. 5 of the Public Procurement Law, ie information from the opening of offers. III.The assessment of compliance with the above-mentioned conditions will be made in accordance with the formula "does not meet", based on information contained in a single document, statements and documentsto strike against the Contractor in order to confirm the fulfillment of the conditions for participation in the proceedings. The Contracting Authority informs that it will conduct proceedings in accordance with art. 24 aa of the Public Procurement Law, which means that the Awarding Entity will first evaluate the offers, and then examine whether the contractor whose tender has been rated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure. IV. Contractor cane to confirm compliance with the conditions of participation in the procedure, in appropriate situations and with regard to a specific order, or a part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of its legal relationship. Contractor who relies on the abilities or situation of other pentities must prove to the orderer that while implementing the order will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary resources for the needs of the order. The Awarding Entity assesses whether technical or professional capacities or their financial or economic situation are made available to economic operators by other entitiesallow the contractor to demonstrate compliance with the conditions for participation in the proceedings and examine whether there is any ground for exclusion referred to in item 9 of the Terms of Reference. The contractor, which relies on the economic or financial situation of other entities, is jointly and severally liable with the entity that has committed to provide resources for the damage sustained by the contracting authority.due to the lack of access to these resources, unless the resource is not made available for fault.

The contractor will meet the condition if it proves that he is insured against civil liabilityin the scope of conducted activity related to the subject of the order for a guarantee sum of at least PLN 500, 000.00 (in words: five hundred thousand zlotys). Note: Regardless of how many parts of the Order the Contractor submits the offer, he must demonstrate that he fulfills the above condition. fills in EED Part IV: Eligibility Criteria Section B point 5) Economic and financial situation, indicating the following-data: Guarantee sum of your civil liability insurance in the scope of conducted activity related to the subject of the order.

In the case of contractors jointly applying for the order, the above condition will be considered fulfilled if at least one of the Contractors applying for the order will meet it.

I. Documents and declarations submitted by the Contractor, whose offer has been assessed by the Employer as the most advantageous (abbreviation of Chapter 10 of the SIWZ):

1) Information from the National Criminal Register in the scope-referred to in Article 24 sec. 1 point 13, 14 and 21 Pzp, issued not earlier than 6 months before the deadline for submitting offers. 2) Certificate of the competent head of the tax office confirming that the Contractor is not in arrears with payment of taxes, issued not earlier than 3 months before the deadline for submission of offers or other document confirming that the contractor has entered into an agreement withthe tax authority with respect to the repayment of such receivables, together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments or suspension of the execution of the decision of the competent authority;

3) Certificate of the relevant organizational unit of the Social Insurance Institution or Agricultural Funds Insurancea Social or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued no earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding repayment of these receivables with any interest or fines, in particular obtainedrocks provided by law for the exemption, postponement or installment of overdue payments in installments, or suspension of the execution of the decision of the competent authority in its entirety;

4) Copy from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require entry in the register or records in order to confirmation of the lack of grounds for exclusion under Art. 24 sec. 5 point 1Pzp;

5) Declaration of no grounds for exclusion Annex No. 8 to the ToR,

8) List of persons referred by the Contractor to implement the contract - Annex No. 9 to the ToR,

9) List of construction works carried out - Annex No. 10 to the ToR with the attachment evidence that the works were properly carried out,

10) Documents confirming that the Contractor is insured against liabilitycivil liability in the scope of conducted activities related to the subject of the order for a guarantee sum of at least PLN 500, 000.00. III.1. The admission is conducted in an unlimited tender.

2. The Contracting Party reserves the right to change the content of the ToR and the announcement, including changes in deadlines contained there.

3. The orderer does not provide for the awarding of contracts under Article 67 (1) (6, 7) and Article 134 (3).6 point 3 Pzp.

4. The request for ordering is carried out in Polish.

5. The orderer does not allow variant offers, does not provide for the conclusion of a framework agreement, electronic auction, dynamic purchasing system and reimbursement of participation costs subject to the reservation provided for in Pzp.

6. The deadline for binding the offer is 60 days counted from the deadline for submitting bids.

8. The ordering party will invalidate the procedure for awarding the order, if one of the conditions listed in art. 93 para. 1 Pzp.
