Within the framework of the contract "Water and sewerage networks, pumping stations, water pumping stationsin Barlad "the following categories of works are foreseen to be executed:

Main Site: Barlad Agglomeration.

Within the framework of the contract" Water and sewerage networks, pumping stations, waste water pumping stations in Barlad "are foreseen to be executed categories according to the specifications.

Estimated value excluding VAT: 44 631 538, 88 RON.

EC reserves the right to make modifications to thetract under Art. 235 and the following in Law 99/2016 on the following aspects listed by way of example: changes generated by requests from the owners of utility networks; alterations to the expropriation corridor / corridor; changes in the duration of execution due to the appearance of elements independent of the Beneficiary or Contractor's will; changelegislative or technical norms / standards / normative / standards; changes caused by environmental authority requirements; changes generated by local / central authorities required by various opinions / agreements / authorizations; changes resulting from agreements, conventions, understandings of the state / local authorities with other states; changes caused by the application of the law on historical monuments; modificationsgenerated by the inclusion of new subcontractors and / or replacement of the original subcontractors; changes caused by the change of key personnel; changes generated by technical expertise; changes in the minimum value of the CIP; changes arising from research and archaeological research. These changes may be made after the signing of the contract, under the conditions provided by ccontractual contracts, and only if they do not fall within the provisions of art. 240 par. (3) of Law 99 / 2016.

The estimated value includes the amount of 892 630.78 RON representing the amount of the implementation reserves, in accordance with the ANAP Instruction no. 3/2017 of 8.8.2017. Failure to comply with the provisions of art. 177, 178, 180 of Law no.99 / 2016

Qualification conditions:

Each economic operator (single bidder / associated offeror / third party / subcontractor) must not be found in the situations provided by art.177, 178, 180 of the Law no. 99/2016

Means of completeness to demonstrate that the requirement is met:

The DUAE will be completed by each economic operator (single bidder / affiliate / third party / subcontractor) attendingThe supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the Contracting Entity, only by the bidder placed on the first place in the ranking drawn up at the completion of the evaluation of the tenders. These documents are:

1. certificates of lack of debt res(local budget, state budget, etc.) at the moment of presentation;

2. the criminal record of the economic operator and the members of the management, management or supervisory body of that economic operator or those having the power to represent, decide or control within that economic operatoras it results from the certifying certificate issued by the ONRC / constitutive act at the moment of presentation; as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016 on sector acquisitions; other editing documents, as appropriate;

All documents drawn upmissions by the bidder for the purpose of confirming the DUAE will be scanned after the signed original documents and signed with the extended electronic signature; for foreign economic operators the documents will be accompanied by the authorized translation into Romanian. Failure to comply with the provisions of Articles 72 and 73 of Law no. 99/2016

The contracting entity will exclude from the award procedure the counterany bidder who is in any of the situations provided by art. 72 and 73 of Law no. 99 / 2016.

Each economic operator (single bidder / affiliate / third party / subcontractor) will fill in the appropriate fields from the DUAE.the contracting entity, only the bidder placed on the first place in the ranking drawn up at the evaluation of the tenders will submit statements from each economic operator (sole bidder / affiliate / third party / subcontractor) regarding the non-compliance with the situations stipulated in art. 72 and 73 of Law no. 99/2016 at the time of submission Form no. 3C in the Forms section

3. Details of association, third party support, subcontracting

The Bidder has the obligation to submit the following documents, as appropriate:

3.1. the association agreement, according to Form no. 3A in the Forms section; The average annual turnover for the last 3 years (2015, 2016, 2017) must be at least 44, 000, 000 Lei. For conversationtake in lei, if the financial statements are drawn up in another currency, the average rate communicated by the European Central Bank for that year shall be taken into account. For the conversion into Lei the average rate for the year will be used: 2015 1 Euro = 4, 4450 Lei; 2016 1 Euro = 4, 4908; 2017 4, 5688 NOTE: If the bidder is an association, the requirement is considered to be satisfied by summingof the annual turnover of all members of the association for that year.

The economic and financial situation of the economic operator can be sustained in accordance with art. 196 - 200 of Law no. 99/2016. If the tenderer demonstrates his economic and financial situation by invoking the support granted by one or more third parties, then the tenderer has the obligation to provethe contracting entity has taken all necessary measures by presenting a firm commitment on the part of the third party / third parties. In accordance with Article 198 of Law no. 99/2016, the economic operator and the third party / third party / supporter will be jointly and severally liable for the execution of the sectoral contract. The bidder is obliged to present the firm commitment of the third financial supporter butbusiness by loading it into SEAP together with the offer. NOTE: If the bidder is an affiliate or one or more third-party supporters, the requirement is considered to be met by aggregating the annual turnover of all members of the association and / or the third (or third) financial supporter (s) i) as appropriate, for that year.

-" In "is the cost index in construction - totally published by the National Statistics Institute in the Statistical Price Bulletin, table 15, applicable at 60 days before the last day of month n. The applicable value for this index for January 2017 is 113.8, - "Io" is the index-Costs in Construction - Total, Applicable to the Reference Date.

The indices used are the above and the source of these indices is the National Statistics Institute - Statistical Price Bulletin.

Also, the Value of the Contract will be adjusted to take account of any increase or decrease in the Cost resulting from the amendment of the Act (including the adoption of new laws and repeal or modiExisting Laws), published after the Reference Date, which will affect the Contractor in the performance of his obligations under the Contract.
