Construction work.

Detailed description of the subject of the public procurement contract shall be enclosed in the technical specifications and the Bill of Quantites, an integral part of the public procurement documentation.

The selected most favourable Bidder should provide a Good Performance Waranty in amount of 10 % of the contract value (VAT included).

The waranty shall be submitted in the form of a bank waranty in writing. The warranty should be submitted in original form. Copies shall not be accepted.

The Good Performance Waranty shall be valid until full completion of the contract. The Contracting Authority, having selected the most favourable Bidder, shall additionally establish the validity period of the guarantee.

The Bank guarantee for the Good Performance Waranty shall be expressed in MKD.

The Good Performance Waranty must be issued by a bank.

The most favourable Bidder shall submit the Good Performance Waranty within 5 /five/ days of signing the contract.

The Good Performance Waranty shall be submitted within the envisaged period, as follows: via post or in person to the contact person mentioned in the public procurement documentation.

The payment under the Good Performance Waranty shall be collected if the Main Contractor fails to meet any of the obligations of the public procurement contract within the maturity date, informing the Main Contractor in writing regarding the same. If the payment is collected under the Good Performance Waranty, the Contracting Authority shall announce a negative eference to the ESPP. The Main Contractor may initiate proceedings in front of a competent court for payment of the bank guarantee for contract quality performance.

If the public procurement contract has been fully carried out in accordance with what has been agreed, the bank guarantee - the Good Performance Waranty shall be returned by the Contracting Authority to the Main Contractor within 14 days of the full contract implementation.

The good performance guarantee shall be returned by the Contractor via post, in person at the economic operator's business seat, or in person at the Contracting Authority's business seat.

The payment shall be made on the basis of monthly interim situations for completed works and submission of construction book certified by the supervising engineer, certified by the supervisory authority and the orderer of the works within 20 days.

The terms of payment are mandatory. Each Bid that contains terms of payment different from the ones specified in this section shall be deemed unacceptable and shall be rejected by the Public Procurement Committee.

For the purpose of proving its personal standing, the economic operator shall submit the following documents:

— statement by the economic operator that no effective court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years,

— statement by the competent authority that no bankruptcy procedure has commenced,

— statement by the competent authority that no liquidation procedure has commenced,

— receipt on settled taxes, contributions and other public duties by the competent authority from the country of registration of the economic operator,

— statement from the Register of penalties for crimes committed by legal entities stating that no minor penalty temporary or permanent ban has been pronounced for participation in invitation to public procurement procedures, procedures for awarding public procurement contracts or private-public partnership contract,

— statement from the Register of penalties for crimes committed by legal persons stating that no minor penalty temporary or permanent interdiction on carrying out particular business activity has been pronounced,

— statement that no misdemeanour sanction interdiction on carrying out/exercising profession, activity or responsibility, i.e. temporary interdiction on carrying out particular business activity, has been pronounced with an effective court decision,

In order to prove its capacity to pursue a professional activity, the economic operator shall submit:

— a document of registered business activity as a proof that it has been registered as physical or legal entity for exercising the business activity related to the subject of the public procurement contract or a proof that it belongs to a respective professional association pursuant to the regulations in the country of its registration,

— Licence A for construction of first category buildings issued by the Ministry of Transport and Communications.

*In the Republic of Macedonia, a foreign legal entity may perform works of designing, review, construction and supervision prescribed in this Law, if they obtain confirmation for performing the above works by the authorized body of the state administration responsible for carrying out activities in the field of spatial organization. www.mtc.gov.mk
