The subject of this Orderest execution of the following elements:

Main Site: Gdynia Port railway station covering the areas of GPA, GPB, GPC, GPD, GPE, GPF, WSE and pre-port regions P1, P4, P6, P14, P15, P16 and P17 along with accompanying infrastructure and lines • The subject of this Order is the implementation of the following elements:

Reconstruction: Gdynia Port railway station including the following regions:

- GPA, GPB, GPC, GPD, GPE, GPF, GPW, and pre-port regions P1, P4, P6, P14, P15, P16 and P17 together with the accompanying infrastructure, including railway lines:

Line No. 201 (Gdynia Głowna Gdynia Port) from km 205, 885 to km 210, 763;

Line No. 228 (Gdynia Port GPF Gdynia Port Oksywie) from km 5, 618 to km 11, 227;

Line No. 723 (Gdynia Chylonia Gdynia Port GPF) from km -0, 400 to km 2, 078;

Line No. 961 (Gdynia Pbay GP14 Gdynia Port GPC) from km 0.000 to km 1, 103.

Line No. 724 (Gdynia Port GPD Gdynia Port GPO) from km 1, 209 to km 2, 157;

Line No. 725 (Gdynia Głowna R21 Gdynia Port GPD) from km -0.164 to km 2, 247.

The entirety of the subject of the Order includes the execution of the following elements:

1. Implementation of the robot in the following ranges:

1) railway surface with substructure and drainage,

2) control devices rurailway chemistry (srk),

3) telecommunication devices and systems,

4) catenary network with power supply,

5) electrical power equipment and systems up to 1 kV and up to 110 kV,

6) engineering structures,

7) cubature buildings

8) installations, networks and sanitary facilities,

9) transitions and railway crossings,

10) road surface,

11) geology

2. The implementation of a robot consisting in the construction of facilities serving ochthe environment.

3. As-built documentation, including: • preparation of technical regulations, in cooperation with the Employer, on the basis of Instruction Ir-3, after completion of construction works, in all industries, - preparation of geodetic as-built documentation: - chainage line and profile of longitudinal railway line,

- transfer and receipt protocols for track axis adjustment,

- numericlocation and altitude map with geodetic as-built inventory. • preparation of documentation from the foundation and measurement of the Railway primary geodetic control network and Railway special network,

• development of new traffic control schemes and dispatching points.

1. Contractors may participate in the Proceeding:

1.1. for which there are no grounds for exclusion from proceedings on grounds oftawie art. 24 sec. 1 item 12-23 of the Act, excluding the premises specified in art. 24 sec. 1 point 13 lit. d and point 14 for the offense referred to in Article 24 sec. 1 point 13 lit. d of the Act (premises for mandatory exclusion) and in art. 24 sec. 5 points 1, 4, 5 and 6 of the Act (grounds for optional exclusion),

1.2. meeting the conditions for participation in the Procedure, specified in SIWZ.

2. The contractor may inIn order to confirm compliance with the conditions for participation in the Proceedings in relevant situations and with respect to a specific order, or a part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of its legal relationship.

3. Contractor who relies on the abilities or situation of others underlitter, must prove to the Ordering Party that, when executing the order, he will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary resources for the needs of the Order.

4. In order to demonstrate initially that there are no grounds for exclusion from the Procedure and confirmation of fulfillment of the conditions for participation in Postęp-wEach of the Contractors is obliged to submit a Single Document.

5. In the event of a joint application by the Contractors (Consortium), the relevant Single Document shall be submitted by each of the Contractors jointly applying for the order.

6. Contractor who refers to the resources of other entities, in order to demonstrate the lack of grounds for exclusion and compliance with them in the scope ofin which they refer to their resources, the conditions for participation in the proceedings also submit the relevant Single Document for each of these entities along with the commitment. 7. Contractor indicating in the Single Document subcontractors, on the resources of which the Contractor does not relate, if it is already known to the Contractor which subcontractors intends to entrust the execution of a part of the order, in order to demonstrate the lackthe existence of grounds for exclusion against them, submits an appropriate Single Document for each of these subcontractors.

8. The ordering party, before the order is awarded, will call the Contractor whose offer has been rated the most, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting statements or documents confirming the circumstances referred to in Uniform Dokumencie.

9. If the Contractor relies on the resources of other entities, he will call the Contractor whose offer has been rated the most, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting statements or documents confirming the circumstances referred to in the Single Document concerning each of these entities

List of required statements and dthe documents referred to in items 8 and 9 (including those concerning Contractors who have their registered office or place of residence outside the territory of the Republic of Poland) can be found at: https://zamowienia.plk-sa.pl under the reference number of the subject order. by the Contractor that he is in an economic and financial situation ensuring the performance of the Contractnia, i.e .:

1. has in the last 3 financial years, and if the period of business is shorter, for this period, the average annual net sales revenue in the minimum amount of PLN 430, 000, 000.00,

2. has financial resources or creditworthiness - in the amount not less than PLN 108, 000, 000.00.

As the exchange rate for PLN of financial data expressed in currencies other than PLN, należy take the average exchange rate published by the National Bank of Poland on the first business day of the month in which the contract notice was published in the Official Journal of the European Union.

Evaluation of compliance with the abovementioned condition will take place on the basis of the documents provided by the Contractor, referred to in point 9 of the IDW.

2. Note to section II.2.7) Deadline for the implementation of the Order: according to the date indicated in the offer by the Contractor, but not less than 30 months and not longer than 36 months from the Start Date.

3. Note to section IV.2.6) Minimum period in which the bidt will be bound by the offer - 90 days.

4. Criteria for offer evaluation:

a) Total gross price - weight 80%

b) Implementation deadline - weight 10%

c) Supply of strategic materials - weight 5%

d) Block transport of crossovers and their building - weight 5%

5. Ref. Section VI.3 Information on the electronic auction - continued:

If at least two offers not subject to rejection are submitted in the proceedingsonce the gross price of the highest rated offer of offers not subject to rejection exceeds the amount that the Employer intends to allocate to finance the Order, after the evaluation of offers, an electronic auction will be carried out in order to select the best offer. the price parameter will be the parameter you are bidding for. The rules for conducting the electronic auction have been-they are described in detail in item 29. IDW.

6. The Ordering Party informs about the return of special attention to the provisions of point 15 of the IDW regarding the electronic submission of the GOAT document.
