The subject of this Order is the construction works on the 227/249 line and the Gdańsk Zaspa Towarowa station as well as the 722 line within the project "Improvement of the rail access infrastructure to the port of Gdansk".

Main Site: Line 227/249 and Gdańsk Zaspa Towarowa station and line 722.

1. The object of this Order is the execution of construction works on the 227/249 line and the Gdańsk Zaspa Tow stationarowa and 722 as part of the project "Improvement of rail access infrastructure to the port of Gdansk". a) railway line No. 227 (Gdańsk Gł-wny Gdańsk Zaspa Towarowa) from km 0.654 to km 3, 495,

b) railway line No. 249 (Gdańsk Głowny Gdańsk Brzeźno ) from km 0.586 to km 3, 534,

c) Gdańsk Zaspa Towarowa station:

Tory line no. 227 from km 3, 495 to km 6, 085,

Tracks line No. 249 from km 3, 534 to km 6, 085,

Line tracksii No. 722 from km 0.000 to km 0.192,

d) railway line No. 722 (Gdansk Zaspa Towarowa ZP1 Gdańsk Wiślany) from km 0.192 to km 3, 745

The whole of the subject of the Order includes the implementation of the following elements:

1.1. Implementation of the robot in the following ranges:

1) surface and substructure, including drainage,

2) railway traffic control devices (srk),

3) telecommunications devices and systems,

4) traction network togetherwith power supply,

5) electric power equipment and systems up to 1 kV,

6) engineering structures,

7) cubic buildings,

8) road surface,

9) external networks and installations,

10) transitions and crossings,

11) geology.

1.2. Implementation of the robot consisting in the construction of facilities for environmental protection

1.3. As-built documentation, including:

• preparation of technical regulations, in cooperation with Zamawion the basis of Instruction Ir-3, after completing the construction works, in the scope of all industries, - preparation of geodetic as-built documentation: - - chainage line and profile of the longitudinal railway line,

- transfer and receipt protocols for track axis regulation,

- numerical situational and altitude map with geodetic post-implementation inventory. • preparation of documentation from the assumption and-Railway measurement of the basic geodetic control network and Railway special network,

• development of new traffic control schemes and dispatching points.

1. Contractors may participate in the Proceeding:

1.1. for which there are no grounds to exclude from the proceedings under Art. 24 sec. 1 item 12-23 of the Act, excluding the premises specified in art. 24 sec. 1 point 13 lit. d and point 14 in zthe scope of the offense referred to in Article 24 sec. 1 point 13 lit. d of the Act (premises for mandatory exclusion) and in art. 24 sec. 5 points 1, 4, 5 and 6 of the Act (grounds for optional exclusion),

1.2. meeting the conditions for participation in the Procedure, specified in SIWZ.

2. The Contractor may, in order to confirm compliance with the conditions of participation in the Proceedings in relevant situations and with respect to a specific oneo orders, or parts thereof, rely on the technical or professional abilities or financial or economic situation of other entities, regardless of the legal nature of the legal relationship that it has with it.

3. The Contractor, which relies on the abilities or situation of other entities, must prove to the Ordering Party that while performing the order, he will have the necessary resources of these entities, -in particular, presenting the commitment of these entities to give him the necessary resources for the implementation of the Order.

4. In order to demonstrate in advance that there are no grounds to exclude from the Procedure and confirm that the conditions for participation in the Procedure are met, each of the Contractors is obliged to submit a Single Document.

5. In the case of joint application for ordersNot by Contractors (Consortium), the relevant Single Document is submitted by each of the Contractors jointly applying for the order.

6. The Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and fulfillment to them, in so far as it relies on their resources, the condition of participation in the proceedings also submits the relevant Single Document.each of these entities together with a commitment.

7. The Contractor who indicates in the Single Document subcontractors, on the resources of which the Contractor does not relate, if it is already known to the Contractor which subcontractors intend to entrust the execution of a part of the order, in order to demonstrate the absence of grounds for exclusion, submits an appropriate Single Document for each of these subcontractors.

8. The contracting party, prior to the order being awarded, will call the Contractor whose tender has been best assessed, to submit within the prescribed period, not shorter than 10 days, valid as of the date of submitting declarations or documents confirming the circumstances referred to in the Single Document. In the event that the Contractor relies on the resources of other entities, he will call the Contractor whose offerthe highest rated, to submit within the prescribed period, not shorter than 10 days, valid as of the date of submitting statements or documents confirming the circumstances referred to in the Single Document regarding each of these entities.

10. List of required declarations and documents referred to in items 8 and 9 (including those concerning Contractors with registered office or place of residence outside ofof the Republic of Poland) can be found on the website: https://zamowienia.plk-sa.pl under the reference number of the subject order.

It is required that the Contractor demonstrates that he is in an economic and financial situation ensuring the execution of the Order, i.e .: 1. has in the last 3 financial years, and if the period of business is shorter, for thisperiod, average annual net sales revenue in the minimum amount of PLN 119 800 000.00,

2. has financial means or creditworthiness - in the amount not less than PLN 29, 900, 000.

As the exchange rate for PLN of financial data expressed in currencies other than PLN, the average rate published by the National Bank of Poland on the first business day of the month should be used, which publicationthe announcement of the contract in the Official Journal of the European Union.

Evaluation of compliance with the abovementioned condition will take place on the basis of the documents provided by the Contractor, referred to in point 9 of the IDW.

1. Documents and statements required from the Contractor, confirming the absence of grounds for exclusion of the Contractor from the procedure and detailed information on the required documents are available at: https: //zamowienia.plk-sa.pl.

2. Note to section II.2.7) Deadline for the implementation of the Order: according to the date indicated in the offer by the Contractor, but not less than 30 months and not longer than 36 months from the Start Date.

3. Note to section IV.2.6) Minimum period for which the tenderer will be bound by the offer - 90 days.

4. Criteria for offer evaluation:

a) Total gross price - weight 80%

b) Date of implementation --weight 10%

c) Supply of strategic materials - weight 5%

d) Block transport of switches and their building - weight 5%.

5. Ref. Section VI.3 Information on the electronic auction - continued:

If at least two offers not subject to rejection are submitted and the gross price of the highest-ranked offer of offers not subject to rejection exceeds the amount that the Orderingy intends to finance the Order, after the evaluation of the offers, the electronic auction will be conducted to select the best offer.

In the course of the electronic auction, the price will be the bidding parameter.

The rules for conducting the electronic auction are described in detail in point 29 IDENTIFICATION

6. The Ordering Party informs about the special attention paid to the provisions of point 15. IDWconcerning the electronic submission of the GOAT

7 document. The contracting authority provides for the award of contracts referred to in Article 134 sec. 6 point 3) of the Act - A similar order may be awarded in the single-source order mode, after prior negotiations with the Contractor, in particular within the terms of the contract, including the price, performance date, warranty period / warranty period, andwill expand the Gdańsk Wiślany region on line 722 ie: - reconstruction of the track surface around 2.5 km of tracks,

- incorporation of 14 turnouts,

- development of road and rail surface.
