1.1. The subject of the contract is construction works, on the premises of the waste disposal facility the Ordering Party at ul. Jabłoniowa 55, 80-180 Gdańsk, POLAND, carried out in accordance with the project documentation Construction design "Construction of the sector No. 800/3 municipal waste storage facilities for the Utilization Plant in Gdańsk Szadołki" together with squares, roads and technical infrastructure - developed in January 2017 by Heko Halina Karmolińska - Słotkowska, ul. Jugosłowiańska 41, 60-301 Poznań, POLAND and the building permit No. WUiA-I.6740.805-3.2017.5-AB.146446 of 29/06/2018

1.2. The scope of the order includes:

a) development of multi-industry and technological executive designs,

b) establishment of a Construction Manager,

c) development of a safety and health plan, in accordance with the Regulation of the Minister of Infrastructure of 23.6.2003 on information on safety and health, as well as a safety and security planny (Journal of Laws No. 120 item 1126),

d) organization of the construction site,

e) delimitation of objects in the area,

f) construction of sector 800/3 of municipal waste storage facilities with accompanying infrastructure,

g) delivery and assembly of devices and equipment,

h) delivery of technical and operational documentation (DTR) of devices

i) preparation and submission of a complete application on behalf of the Employer and obtaining a claimfor the use of sector No. 800/3 of the landfill site other than hazardous and inert waste together with the accompanying infrastructure, - j) preparing and submitting a complete application on behalf of the Employer and obtaining a valid integrated permit, k) preparing and submitting a complete application on behalf of the Employer and obtaining a legally valid water permit,

l) preparation of the landfill instructions together with obtaining a valid decision approving the operating instructions, - m) preparation of the as-built documentation with the necessary descriptions in the scope and form as in the Design Documentation, the content of which will be presented by the Contractor as completed by the Contractor; and execution of geodetic documentation of completed worksincluding a geodetic documentation prepared at particular stages of construction and a geodetic as-built inventory along with a copy of the current base map,

n) handover of the object to the Ordering Party

1.3. Requirements related to the implementation of the order regarding employment under a contract of employment. The ordering party in accordance with the instruction of art. 29 para. 3a of the Public Procurement Law, requires the Contractor lor a subcontractor who will direct the work of his employees performing activities related to construction and assembly works to the work performed by his employees during the period in which the given activity is to be performed (except for persons performing independently technical functions in the construction industry, e.g. robot manager, key specialists)

1.4. Before proceeding to realThe Contractor will present a list of activities related to construction and assembly works in the scope of implementation of the Subject of the Order in the manner specified in art. 22 - 1 of the Labor Code. The Contractor shall submit a written statement that persons performing these activities will be employed by him during the period in which the given activity is to be performed, based on a contract of employment.

1.5. Detailsthe subject of the order is included in Part III of the ToR and in the Building Design and Technical Specification for the Construction Work and Organization.

Each Contractor is obliged to secure his bid bond in the amount of PLN 450, 000.00 (in words: four hundred fifty thousand zlotys 00/100)

Any settlements related to the implementation of the public order concerned by this orderzycie and SIWZ will be made in PLN.

Note: The Contracting Authority informs that it makes settlements using the split payment method.

1. Contractors applying for a public order must meet the following conditions for participation in the procedure in accordance with art. 22 ust. 1 uPzp:

1) can not be excluded on the basis of art. 24 sec. 1 and par. 5 points 1) and 8) uPzp;

2) meet the conditionsparticipation in the proceedings;

2. The Contractors who meet the conditions for participation in the proceedings concerning: - 1) Competence or entitlements to conduct a specific professional activity, as per separate regulations,

2) Economic or financial situation,

3) Technical ability or professional,

Specified by the Employer in the announcement and SIWZ.

3. In order to youIf there are no grounds for exclusion from the proceedings for granting this order, the Contractors shall submit the following documents: - 1) A copy from the relevant register or central records and business information, if separate regulations require entry in the register or records, in order to confirm the lack grounds for exclusion under art. 24 sec. 5 point 1 of the Acty Public procurement law, issued not earlier than 6 months before the deadline for submission of bids (in the case of joint application for this order by two or more Contractors in the offer must be submitted documents for each of them),

2) Certificate of the competent head tax office confirming that the Contractor is not in arrears with paying foratkow, issued not earlier than 3 months before the deadline for submission of tenders or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of these receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or payment in installments overdue payments or suspension in fullthe decision of the competent authority (in the case of joint application for this contract by two or more contractors, the submitted documents must be submitted for each of them),

3) Certificate of the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor nIt is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of offers or other document confirming that the Contractor has made an agreement with the competent authority regarding repayment of such receivables with possible interest or fines, in particular right to be released, postponed or divided intoinstallments of overdue payments or suspension in full of the implementation of the decision of the competent authority (in the case of joint application for this order by two or more contractors, the submitted documents must be submitted for each of them),

4) Information from the National Criminal Register in the scope specified in art 24 sec. 1 points 13, 14 and 21 of the Public Procurement Act, issued no earlier than6 months before the deadline for submission of bids (in the case of joint application for this contract by two or more Contractors in the offer must be submitted documents for each of them), 5) the Contractor's statement that he has not issued a final court or final judgment against him an administrative decision on default of taxes, fees or compositionsk for social or health insurance or in the event of issuing such a verdict or decision documents confirming the payment of these claims together with any interest or fines or conclusion of a binding agreement regarding repayment of such debts, (in the case of a joint application for this order by two or more contractors on offer must be blive the submitted statements for each of them),

6) the contractor's statement about the lack of a ruling against him as a precautionary measure prohibiting to apply for public orders (in the case of joint application for this order by two or more contractors in the offer must be submitted subject matter statements for each of them),

7) statements by the contractor onot paying up taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716) (in the case of a joint application for this order by two or more contractors in the offer must be submitted statements for each of them) - In the field of settlements using the mechanism dividedj payments:

a) Declaration on the possession of a bank account related to running a business, prepared on the basis of the template constituting Annex No. 6 to IDW.

4. Pursuant to the provisions of - 7 para. 1 of the Regulation of the President of the Council of Ministers of 27.7.2016 on the types of documents that the Employer may request from the Contractor in the proceedings for the award of the contract (Journal of Laws from 2016, item 1126 from late zm.):

1) if the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in point 10.3.1) -10.3.4) IDW consists of: - a) within the scope of [10.3.4) IDW information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country, in Rector:the contractor has his registered office or place of residence, or the place of residence is held by the person concerned by information or a document, to the extent specified in art. 24 sec. 1 item 13, 14 and 21 of the Code of Civil Procedure;

b) in the scope of [10.3.2) -3)] IDW document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that it is not in arrears with paying taxes fees, insurance premiumssocial security or health, or that it has entered into an agreement with the competent authority regarding the repayment of such claims together with any interest or fines, in particular it has obtained the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the decision of the competent authority; within the scope of [10.3.1] IDW document or documents issued inin which the contractor has its registered office or place of residence, confirming that its liquidation has not been opened or bankruptcy announced; - 2) documents referred to in 10.4.1) a) and 10.4.1) c) IDW should be issued not earlier than 6 months before the deadline for submitting offers,

3) document referred to in 10.4.1) b) IDW should be issued not earlier than 3 months before the end of the terminu of offers;

4) if in the country in which the contractor has its registered office or place of residence or place of residence has the person concerned, the documents referred to in point 10.4.1) IDW is replaced by a document containing the statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person whose document ishe had to refer to a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the place of residence or place of residence of the contractor or the place or place of residence of the contractor or the place of such person's confusion. The provisions of point 10.4.2) -3) IDW apply accordingly;

5) Contractor having its registered office in the territory of the Republic of Poland.in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in point 10.3.4) IDW, consists of a document referred to in point 10.4.1) a, to the extent specified in art. 24 sec. 1 item 14 and 21 of the UPpp.

If in the country where the person whose document is to be residing in the place of residence does not appear such documents, it shall be replaced bythe document containing the statement of that person submitted to a notary or to a judicial, administrative or professional body competent for the place of residence of that person. The provisions of point 10.4.3) IDW apply accordingly.

5. The contracting authority demands from the contractor, which relies on the abilities or situation of other entities under the rules set out in Article22a uPzp, submit for these entities the documents listed in point 10.3 of the IDW

6. The contracting party requests from the contractor to present the documents listed in point 10.3 of the IDW, regarding the subcontractor, which he intends to entrust the execution of a part of the order, and which is not an entity on whose capacity or situation the contractor relies on the principles set out in Article. 22a of the Act

7.-According to Art. 24aa. Public Procurement Law The Employer reserves the right to evaluate offers and then to investigate whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.
