The subject of the orders are: Roborenovation and construction in the Primary School No. 15 at ul. Wojska Polskiego 84 in Sosnowiec regarding the renovation of the building's facade.

1. The subject of the order are: Renovation and construction works at Szkoła Podstawowa No. 15 at ul. Wojska Polskiego 84 in Sosnowiec regarding the renovation of the building fa-ade.

2. The scope of the order includes renovation of the building facade and reconstruction of the external wall pconstruction of an evacuation exit from the cloakroom and reconstruction of stairs to basements with planting.

The detailed description of the subject of the order is a separate Annex No. 3 to the ToR. The sizes shown in Appendix 3 are for illustration only.

3. The minimum required warranty period is 36 months.

4. If the Purchaser indicated trademarks in the item description, patents, origin or sources as well as standards, technical approvals and reference systems, allow us to offer equivalent solutions, provided that they maintain the same minimum technical, quality and functional parameters, etc. The contractor who invokes the equivalent solution described by the Employer is obliged to indicate that offered by himthe subject of the order meets the requirements specified by the Ordering Party.

5. The Employer requires employment by the Contractor or Subcontractor based on a contract of employment of persons performing activities in the implementation of orders consisting of: - - demolition and renovation works, - masonry and masonry works, - plastering, - wall insulation, - installation of a lightning protection system

6. Bu worksthey will be carried out in an active facility, and therefore require special care in conducting works, in particular the use of appropriate safeguards and covers to enable the facility to function, and to keep the site in good order.

7. Deadline for order fulfillment: 3 months from the date of signing the contract.

8. The Contractor is obliged before the expiry of the offer submission deadlineSending a bid bond in the amount of PLN 4, 000.00 (in words: PLN 4, 000 and 00/100).

9. The Contractor will be bound by the submitted offer for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

10. The ordering party does not anticipate the orders referred to in art. 67 sec. 1 point 6 of the Act on Public Procurement Law, consisting in the return of similar construction worksh.

11. Before signing the contract, the Contractor is obliged to provide a performance bond for the amount of 5% of the offer price given in the Offer Form. The ordering party will choose the most advantageous offer based on the following criteria: - gross price (60%) - length of the guarantee period (20%)

- the amount of contractual penalty for delay in performance of the Subject of the contract (20%). • The contracting party, prior to the order being awarded, will call the Contractor whose tender has been best assessed for submission within the prescribed, not shorter than 10 days, valid day as of the day of submitting statements or documents confirming the circumstances referred to in art. 25 ust. 1 of the Public Procurement Law. The ordering party will call the Contractor, in particular to submit the following documentTrademarks:

1. information from the NQF in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2. certificate of the competent head of the tax office confirming that the Contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for submission of tenders, or other document of monsterstating that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained the legally required exemption, deferral or installment payment of overdue payments or suspension of the execution of the decision of the competent authority in its entirety; certificate of the relevant ZUS or KR regional organizational unitUS or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued no earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding repayment of these receivables together with possible interest or fines, in particular obtainedpunishment provided for by the law, the release, postponement or spreading into installments of overdue payments or suspension in full of the implementation of the decision of the competent authority;

4. excerpt from the relevant register or central records and business information, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1-Public Procurement Law Acts,

5. the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision on late payment of taxes, fees or social security or health insurance premiums or in the event of such a verdict or decision confirming the payment of such claims together with any interest-fines or the conclusion of a binding agreement regarding the repayment of these debts;

6. the Contractor's statement about the lack of a ruling against him as a preventive measure of the prohibition against applying for public orders;

7. Contractor's statement on not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (ie 2017 Journal of Laws of 2017, Pos. 1785 with changes).

8. If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in: - a) in point 1 he shall provide information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has its seat or place of residenceb the place of residence is taken by the person concerned by information or a document, to the extent specified in art. 24 sec. 1 point 13, 14 and 21 of the Act on Public Procurement Law;

b) point 2 4 submits a document or documents issued in the country in which the Contractor has his registered office or place of residence, confirming accordingly: - - he is not in arrears with paying taxes, fees, social insurance contributions or zdor concluded an agreement with the competent authority regarding the repayment of such receivables together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension in full of the decision of the competent authority, - its liquidation was not opened or no bankruptcy was proclaimed.
