The object of the acquisition is the conclusion of a service contract for the technical assistance for the supervision of the works: - - for the supervision of the execution of the works that are the subject of the Financing Contract of the project "Modernization of inter-county road DJ 104A, DJ 105C and DJ 105P consisting of DJ 104A km 0 000-45 000, DJ 105C km 6 300-3 800, DJ 105P 0 000-3 800 ",

- for the supervision of the execution of works not subject to the Financing Contract of the project" Modernization of Inter-County Road DJ104A, DJ 105C and DJ 105P consisting of DJ 104A km 0 000-45 000, DJ 105C km 6 300-3 800, DJ 105P 0 000-3 800 "and which will be settled from the budget of Brasov County, - for tracking of the exploitation behavior of the executed constructions / investment objectives during the warranty period and which will be settled from the budget of the Braşov County

1) Bidders, third parties and othersthe contractors must not find themselves in the situations provided by art. 164, 165 and 167 of Law no. 98 / 2016.

The economic operator (leader, associate, third party, subcontractor) will fill in the appropriate requirement in the DUAE form with information related to their situation in the awarding documentation. In this respect, the sole tenderer / associated offeror / subcontractor / third party willDUAE flight - Part III "Exclusion Grounds", Section A "Reasons for Criminal Offenses", Section B "Reasons for Paying Taxes or Social Security Contributions", Section C "Insolvency, Conflicts of Interest or Deviance professional ".

All participants in the procedure (regardless of their quality - leader, associate, third party, subcontractorant) will file with the DUAE, the declaration regarding non-compliance with the provisions of art. 60 of Law 98/2016, with subsequent amendments and completions, the association agreement, the subcontracting agreement, the commitment of the third supporting documents (if any).

Incorporating the situation provided in art. 164, 165, 167 of Law no. 98/2016 on public procurement leads to the exclusion of the bidderin the procedure applied for awarding the public procurement contract.

The supporting documents proving the fulfillment of the undertaken by completing the DUAE form must be presented, only at the request of the contracting authority, only by the bidder ranked first in the evaluation evaluation.

These documents are:

Romanian legal / natural persons:

- certificate of attestation(this certificate must show that the tenderer has no overdue debts at the moment of their submission), - a tax attestation certificate regarding the local taxes and duties in the case of a taxpayer, issued by the MFP or the subordinated sub- to the legal persons, issued by the Local Council (this certificate must appear asthe tenderer has no outstanding debts at the time of filing), - the criminal record of the economic operator and the members of the administrative, management or supervisory body of that economic operator or those having the power of representation, decision or control within the as it results from the certifying certificate issued by the ONRC / Constitutive Act

Personsforeign legal / physical documents: - editorial documents issued by the competent authorities of the country in which they are resident, proving the lack of outstanding obligations at the time of their presentation, obligations regarding the payment of taxes to the state budget and the local budget, according to with the legislation of the country of residence. The documents will be accompanied by the translatorit is authorized in Romanian. For non-resident tenderers, the provisions of art. 168 of the Public Procurement Act 98/2016, as subsequently amended and supplemented, - as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 concerning achithe public dues, with the subsequent modifications and completions, - as the case may be, other editorial documents; 2) Statement regarding the conflict of interests for bidders / candidates / associate bidders / subcontractors according to art. 60 of Law 98/2016 - Form 10.

The filing of the declaration - Form 7 will be made with the DUAE by all the participants in the award procedure.

1)If the first ranked tenders are found to have equal scores, the contracting authority will request the re-submission to SEAP of the clarification section, in order to divide the bids, on the basis of a new financial proposal, in which case the contract will be awarded to the bidder on first place after the recalculation of the scores, taking into account the weights assigned to each eva factor2) In order to view the awarding documentation uploaded in SEAP, economic operators must have a program to view the electronically signed files (this program being available free of charge on the websites of the electronic signature providers);

3) According to the provisions of art. 193 of Law 98/2016, it is mandatory to complete the DUAE for all participants in the procedure (ofecontractors, third parties, subcontractors), the confirmation documents being submitted only by the bidder ranked first in the ranking of the tender evaluation. In the process of evaluating the tenders, the offer will be rejected if the bidder does not submit the DUAE - art. 104 par. (3) in conjunction with art. 60 of HG 395 /2016 and art. 137 par. (2) lit. b) of GD 395/2016. 4) If the extended electronic signature does not belong to the legal representative of the bidder, athe road has the obligation to transmit along with the offer and empowerment of the person who signed the documents of the offer with the extended electronic signature. In this respect, the information related to this person will be specified at the level of the DUAE in Part II, letter B "Information on the representatives of the economic operator"; 5) The tenderer will fill in the Form 15 General information about the bidder;

6) The tender procedure is conducted online as a consequence; 7) The economic operator interested in the procurement procedure requesting clarifications or additional information in relation to the related tender documentation will submit the request through the SEAP by the due date submitting bids by accessing the dedicated "Questions" section of thedetails of the ongoing award procedure
