"Technical Assistance in Project Management" within the project "Improvement of Regional Infrastructure Road Infrastructure - Transilvania Nord Regional Route, Apuseni Road, by modernizing DJ 108K (Bihar Dragan County Barrier) at km 26 455 km 29 495 and DJ 764B (Drăgan Dam DN1 intersection) at km 0 000 per km 22 164, 500 "according to the requirements of the notebookBidders, third parties and subcontractors MUST NOT find themselves in the situations referred to in art. 164, 165 and 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation, including associate, subcontractors / third partiesand supporters. This requirement applies also to associates, subcontractors and / or third parties who supplement the information related to their situation to the level of a distinct DUAE.

The supporting documents proving the fulfillment of the assumed completion by the DUAE are to be submitted at the request of the contracting authority only by the tenderer ranked first after applicationthe award criterion for admissible tenders. These documents may be:

- certificates of absence of debts regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of their submission,

the criminal record of the economic operator and of the members of the management, management or supervisory bodyoversight of the respective economic operator or of those who have the power of representation, decision or control within it, as follows from the certifying certificate issued by the ONRC / constitutive act, - as the case may be, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 p- other procuring documents, as the case may be.

The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 60 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation.-This requirement applies also to associates, subcontractors and / or third parties who supplement the information related to their situation to the level of a distinct DUAE.

6) The services will be performed for the entire duration of the execution of theuntil the signing of the minutes of the final acceptance of construction works, respectively 84 months from the date of issuing the order for commencement of services (of which 24 months represents the execution of the works and 60 months the warranty period of the works). A person who considers himself / herself injured by an act of the contracting authority may appeal, as provided in the provisionof the Law no. 101/2016
