The subject of the orders under the name: "Reconstruction of the culvert with a greater light located in branch 12j of the Głębocko forestry, Tułowice forest district." are services consisting in investor supervision over the investment involving the reconstruction of the small retention facility (culvert), in forestry Głębocko, branch 12j, terrain of the Tuł-w Forest Districtice.

These tasks are co-financed from the funds from the Operational Program Infrastructure and Environment for the years 2014-2020, as part of the "Comprehensive project of forest and forestry adaptation to climate change - small retention and counteracting water erosion in lowland areas"

The aim of the investment is to replace the existing one brick culvert, which technical condition prevents its further-operation of a new facility that will facilitate the outflow of water from the catchment and enable safe passage through forest transport.

The new culvert is planned to be made of spirally corrugated steel pipes with a diameter of 1 500 mm and a length of 13.5 m, together with the reconstruction of the R-1 duct, whose dimensions will be adapted to the planned culvert traffic light. • The detailed scope of duties of the supervision inspector specified inhas been included in Annex No. 2, i.e. the contract template, about which is - 4 of the contract. The Employer does not set requirements in this condition. Contractors may participate in the proceedings, who are not subject to exclusion from the procurement procedure in the circumstances referred to in art. 24 sec. 1 item 12-23 of the PPL, art. 24 sec. 5 points 1-8 Pzp

In order to confirm the lack of grounds for exclusion from the proceedings, Wthe Contractor shall be obliged to provide the Employer with the following declarations and documents: a) Contractor's statement constituting preliminary confirmation of compliance with the conditions of participation in the procedure set out in this SIWZ and no grounds for exclusion, submitted on the uniform European order form (hereinafter "EAT"), d) excerpt from the relevant register or from central records iiinformation about economic activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under art. 24 sec. 5 point 1 Pzp;

e) certify. the competent head of the tax office confirming that the contractor is not in arrears with paying taxes, issued no earlier than 3 months before the deadline for submission of offers or another documentconfirming that the contractor has entered into an agreement with the competent tax authority regarding the repayment of such claims together with any interest or fines, in particular obtaining the legally required exemption, deferral or installment payment of overdue installments or suspension of enforcement of the decision of the competent authority in full; . appropriate organizational unit of the Plant-Social Security or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of offers or other document confirming that the contractor has concluded an agreement with the competent authority regarding repayment of these receivables together with ewentualnym interest or fines, in particular obtained the lawful exemption, postponement or distribution into installments of overdue payments or suspension in full implementation of the decision of the competent authority;

g) information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the Act and, regarding conviction for a prison sentence, to the extent specified by the orderthe applicant on the basis of art. 24 sec. 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submitting bids,

h) declaration. contractors that he has not been the subject of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums or in the event of such a decision or decisionand documents confirming payment of these receivables together with any interest or fines or conclusion of a binding agreement regarding repayment of such receivables (with reference to the exclusion condition described in Article 24 paragraph 1 item 15 PPL) (non-binding form is attached as Appendix 7 to the Terms of Reference)

i) declare. contractor about the lack of a ruling against him as a precautionary measure againstfor applying for public orders (in relation to the exclusion referred to in Article 24 paragraph 1 item 22 of the PPL) (the non-binding form is attached as Appendix 7 to the ToR)

j) declaration. contractor on the lack of a final conviction of a conviction court for offense of restriction of liberty or a fine to the extent specified by the awarding entity pursuant to art. 24 sec. 5 points 5 and 6 Pzp

k) decreepart. contractor on failure to issue a final administrative decision against him in breach of his obligations under labor law, environmental law or social security regulations to the extent specified by the awarding entity pursuant to art. 24 sec. 5 point 7 Pzp

l) declare. contractors on non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on taxes and local fees - The condition regarding the economic or financial situation will be fulfilled if the Contractor shows that he has financial means or creditworthiness not smaller than PLN 5, 000.

The condition in respect of the contractor's liability for civil liability will be met if the Contractor shows that he has insuranceno liability for a guarantee sum not less than PLN 4, 000 gross. The condition will be assessed on the basis of criterion meets / does not meet based on information contained in EED, and then confirmed in documents or statements made by the Contractor whose offer will be the highest rated.

The proceedings are conducted in accordance with the rules provided for the so-called 'proceduresy reversed ", referred to in Article 24 aa paragraphs 1 and 2 of the Public Procurement Law. According to the aforementioned provisions, the Contracting Authority may first evaluate the offers and then examine whether the Contractor whose tender has been evaluated as the most advantageous is not subject to exclusion and meets the conditions participate in the proceedings.

In the proceedings for the ordering of the declaration, applications, notifications and information Orderand the Contractor shall provide via postal operator within the meaning of the Act of November 23, 2012. Postal Law in person, by means of a messenger, fax or using means of electronic communication within the meaning of the Act of 18.7.2002 on the provision of electronic services, taking into account the form requirements laid down below.

1. If the Employer or Contractorca transmit statements, applications, notifications and information by fax or using electronic means of communication within the meaning of the Act of 18.7.2002 on the provision of electronic services, each party at the request of the other party immediately confirms the fact of receiving them. In the proceedings, the declaration shall be made in writing or in electronic form, from-that EAT should be sent in electronic form, in particular with regard to the provisions of item 8.2, sub-point 3 of the SIWZ.

3. EAT must be provided with a qualified electronic signature. Declarations of entities submitting the offer / application jointly and entities making the potential available on the JEDZ form in the form of an electronic document, should also be signed with qualifiedby electronic means by each of them to the extent that they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. The same requirement applies to EAT submitted by a subcontractor, pursuant to art. 25a para. 5 point 1 of the Public Procurement Law Acts a) Electronic means of electronic submission used by the contractor are electronic means of submission. Warning! Placing the EAT-along with the offer on a data carrier (eg CD, pendrive) is unacceptable, it does not constitute its submission using means of electronic communication within the meaning of the provisions of the Act of 18.7.2002 on the provision of electronic services.

If the Ordering Party and the Contractor pthey convey statements, applications, notifications and information by fax or e-mail, each party immediately confirms receipt of the request on the other party's request.

In the absence of acknowledgment of receipt by the Contractor, the Ordering Party will consider that the letter sent by the Ordering Party to the fax number or the e-mail address provided by the Contractor has been delivered to sppersons enabling the Contractor to read the contents of the Contractor.

5. The Contractor is obliged to notify the Employer in writing of any change of the fax number and e-mail address provided in the offer. The ordering party does not provide for the selection of the most advantageous offer with the use of electronic auction, does not provide for the conclusion of a framework agreement, does not provide for a dynamic systemPurchase

5. The Employer does not provide for the orders referred to in Article 67 sec. 1 point 6 of the PPL Act;
