Construction consultancy services

Performing CS on the implementation of engineering of the object "Complete reconstruction and modernization of the Stanke Lisichkovo border checkpoint"

The subject of the contract includes the implementation of the following activities:

Main Site: Stanke checkpoint Lisichkovo "- PI with iden. 37263.11.85, Blagoevgrad District, Blagoevgrad Municipality, Klisura Village, Customs.The implementation of the following activities shall be included in this procurement:

- Activity I "Preparation of a report on conformity assessment of the investment projects in compliance with the requirements of Art. 142 of the Spatial Planning Act,

- Activity II "Exercise of construction supervision during the construction according to Article 166, Paragraph 1, Item 1 of the Spatial Planning Act within the mandatory scope, regulated in Article 168, Paragraphs 1, 3 and 6 of ZUT",

- activity III" Exercise construction supervision during the elimination of defects during the warranty period in accordance with Article 168, paragraph 7 of the SPA ".

The specific responsibilities of the consultant are:

- conformity assessment - evaluation of compliance of all parts of the work design for the construction with the essential requirements for the construction works according to art. 142, para. 5, para. 6, vol. 2, para. 10 and para. 11in connection with Art. 142, para. 4 of the Spatial Planning Act,

- exercise of independent construction supervision: the consultant is responsible for his activities and obligations as a participant in the investment process, regulated in Art. 166 and Art. 168 of the SPA, as well as those arising from Art. 178 of the SPA, as well as other applicable provisions of the current legislation. Construction supervision is carried out within the compulsory scope of cothe requirements of the Spatial Planning Act, the requirements of Ordinance No. 3 of July 31, 2003 on the drafting of acts and protocols during construction, the requirements of Ordinance No. RD-02-20-1 of February 5, 2015 on the conditions and procedure for filing of construction products in the construction works of the Republic of BULGARIA and all laws and regulations in the field of construction in BULGARIA. The consultant is responsible for the itempreparation, systematization and assembly of the construction papers, the complex report and the commissioning of the construction,

- performs on behalf of the contracting authority the functions of coordinator of safety and health for the construction stage according to Art. 5, para. 3 of Ordinance No 2/2004 on Minimum Requirements for Health and Safety at Work When Performing Construction Works, includingbut fulfillment of all obligations of the contracting authority provided for in the said Ordinance,

- updating of the technical passport (s) and according to Ordinance No 5 of 2006 on the technical passports of the works,

- exercising construction supervision during the elimination of manifest defects. during the warranty periods in accordance with Art. 168, para. 7 of the Spatial Planning Act

The working design will contain the following parts:

Construction supervision in the design involves preparation of conformity assessment of all parts of the work design with the essential requirements for the construction works according to art. 142 of the Spatial Planning Act and reconciliation of the working investment projects after verification ofcompliance with the design assignments and the submitted CSCs.

Exercise of construction supervision will be in scope and scope, in accordance with the requirements of the Spatial Planning Act and the relevant by-laws, performing at least the following activities:

- continuous construction supervision of the execution of construction works - construction works (construction works) according to the approved investment project and the requirements of noregulatory acts,

- verification of the completed construction works by quantities,

- signing of all acts and protocols during construction,

- control of environmental protection and waste management,

- inspection and control of the delivered materials and equipment on the site,

- controls the quality of the construction works performed, etc.

1. To perform the service subject to the assignment with this publicand an order (OP) is required. the participant (s) to hold a special permit (CP). For a Bulgarian. participants this CP is objectified in a valid license to perform the activities under Art. 166, para. 1, item 1 of the ZUT, ed. by the Minister of Regional Development and Public Works (RBD) (paragraph 128 of the RFP of ZIDZUT), or a valid certificate for performing the activities under Art. 166, para. 1, item 1 of the ZUT, ed.by the Head of the National Building Control Directorate (DNSC), rec. the requirements of Art. 166, para. 2 of the SPA and Ordinance No. RD-02-20-25 of December 3, 2012 - for persons registered in the territory of the Republic of BULGARIA (Republic of Bulgaria). For a foreigner. participants this CP should be objective in eq / analogue. document, pleasure. their right to engage in such activity, ed. by a competent authority (CA) of a Member Stateof the European Union (EU), or others. country - party to the Agreement on the European Economic Area (SEEA).

Under the conditions of Art. 112, para. 1, item 2 of the Public Procurement Act, at the conclusion of the contract, the area designated as a contractor shall submit the documents under the preceding sentence. If the designated contractor is foreign. in-k, he must submit a document proving that he has the right to perform the activity in the Republic of Bulgaria, incl. that he has registered in accordance with with Art. 167, para. 1 of the Spatial Planning Act and Ordinance No. RD-02-20-25 of 3.12.2012 in connection with Art. 112, para. 1, item 4 of the Public Procurement Act, through which Doc. the information referred to in the EDES and the information provided. compliance with the selection criterion set, unless available in summer or notto get them. in accordance with Art. 112, para. 9 of the Public Procurement Act

Under the conditions of Art. 67, para. 5 of the PPA, the contracting authority may require at any time after the opening of the tenders through the committee appointed by it the presentation of evidence of the economic and financial condition of the participants - a certified copy of documents proving the existence of "Professionalreadiness "under Article 62, paragraph 1, item 2 of the Public Procurement Act, which proves the information specified in the EDES, when necessary for the lawful conduct of the procedure.

Under the conditions of Article 112, paragraph 1, item 2 of the PPA, prior to the conclusion of the contract, the participant designated as a contractor submits documents - a certified copy of documents proving the existence of professional liability insurance throughwhich proves the information specified in the EDES and certifying compliance with the set selection criterion, unless the contracting authority does not have them or cannot obtain them by the order of art. 112, para. 9 of the Public Procurement Act

Note 1: Where for a valid reason a tenderer is unable to present the documents requested by the contracting authority, it may prove its economic and financial standingusing any other document that the contracting authority considers appropriate

Note 2: Pursuant to Art. 65, para. 6 of the PPA, the contracting authority requires joint and several liability for the execution of the contract by the tenderer and the third party whose capacity is used to demonstrate compliance with the criteria related to the economic and financial situation. The joint and several liability for the execution of the order is poplion in the EDES, Part IV "Selection Criteria", Section B "Economic and Financial Condition", box "Other Economic or Financial Requirements" / Item 6) "With respect to other economic or financial requirements, if any".

1. The estimated value of the contract is the maximum financial resource that can be provided to execute the order. In case all bids received are answeredThey shall exceed the stated estimated value, which is also the maximum financial resource that the contracting authority can provide for the execution of the contract on the grounds of Art. 110, para. 1, item 7 of the Public Procurement Act the contracting authority will terminate the procedure.

2. In view of the legal possibility given to it in Art. 10, para. 2 of the PPA there is no requirement for the unions involved in the procedureto have a certain form to participate in the award of the contract, and it does not set a condition for the creation of a legal entity, if the successful tenderer is a merger of natural and / or legal persons.

3. The assignor shall remove from participation in the procedure a participant for whom there are or have arisen before or during the procedure the grounds for removal under Art. 54, para.1, items 1-7 of the Public Procurement Act, the conditions under Art. 107 of the Public Procurement Act, the circumstances under Art. 3, item 8 of the Law on the Icon. and the financial relations with the companies registered in preferential tax jurisdictions, the entities controlled by them and their beneficial owners, as well as the circumstances under Art. 69 of the Anti-Corruption and Forfeiture of Illegal Acquisition Act.

4. At the conclusionReading the public procurement contract and ensuring the performance of the public procurement contract, the contractor designated shall submit a security guaranteeing the performance of the contract, amounting to 5% (five per cent) of the value of the contract. The guarantee securing the performance of the contract is presented in the form of cash, bank guarantee or insurancewhich ensures performance by covering the contractor`s liability. The Contractor shall also be obliged to provide a guarantee guaranteeing the performance of the contract in the case of an amendment, by which additional activities under the contract are carried out.

5. The advance payment guarantee shall be presented at the amount foreseen for the advance payment under the contract and shall be released within 3 days withice return or advance payment. The advance guarantee shall be presented in the form of a cash sum, bank guarantee or insurance, which secures the advance advance. A guarantee in favor of the contracting authority for the advance funds provided shall not be presented if, within 3 days from the signing of the contract, the contractor states in writing to the contracting authority that he does not wishadvance payment.
