The subject of the order is related to the selection of a contractor to assess the compliance of the investment project in the technical phaseconstruction and supervision of the project "Implementation of Energy Efficiency Measures in Administrative Buildings - the Building of the Ministry of Interior - Varna", which will be assigned to engineering (design and execution of construction) in the implementation of the project "Implementation of Measures for Energy efficiency in administrative buildings - the building of the Department of Urban Development - Varna ". lt; / RTI & gt;efficacy in administrative buildings - the building of the Directorate of Interior of the Ministry of Interior - Varna "- Varna, 2 Tsar Kaloyan Str., pos. property with identifier 10135.1507.726 and the contractor's office / offices

The concrete responsibilities of the contractor are to perform: a) conformity assessment (including conformity assessment of "Constructive" under Article 142, paragraph 10 of the TDA) as a complex report about the site related todesign and execution of construction works within the framework of the project "Implementation of energy efficiency measures in administrative buildings - the building of the Regional Office for Urban and Regional Development - Varna", when the assessment of the compliance of the investment project with the essential requirements of the construction works is in compliance with the requirements of Art. 142, para 5 and para 9 of the Territory Planning Act, and (b) exercising construction supervision: executionthe shareholder is responsible for his activities and obligations as a participant in the investment process, regulated in Art. 166 and Art. 168 of the TDA, as well as for those arising from Art. 178 of the TDA. The construction supervision is performed in the obligatory scope according to the requirements of the SPA, the requirements of Ordinance No. 3 of 2003 for the preparation of acts and protocols during construction, taking into account the requirements ofOrdinance on the essential requirements for construction works and assessment of the conformity of construction products and all laws and regulations in the field of construction in BULGARIA. At least the following activities are carried out: - exercising continuous construction supervision over the execution of the construction works according to the technical design and the requirements of the normative acts;- preparation of the acts and protocols in accordance with the requirements of Ordinance No. 3 (SG, SG, No. 20/1998), - the preparation of the documents and protocols in accordance with the requirements of Ordinance No. 3 (SG, 72/2003) before, during the construction works and after their completion, - ensuring the observance of the safety conditionsLabor Code in accordance with the Health and Safety at Work Act (OHS) and its regulations, - Environmental protection control, - Control over the compliance of inputs and products and other similar activities.

The participant must be entered in the register with the NCCB for exercising the activities under Art. 166, para. 1, item 1 of the Territory Arrangement, and for foreign persons - in analogous registersthe law of the Member State in which they are established ..

Note: In the case of a grouping which is not a legal person, compliance with the requirement is evidenced by those members of the grouping who, according to the distribution of the participation of the persons in the performance of the activities provided for in the contract for the formation of the grouping are engaged in the execution of the construction supervisionIf the participant provides for the participation of subcontractors, the requirement shall be demonstrated for those subcontractors who, depending on the type and share of the contract awarded to them, will perform the construction supervision / the assessment of the conformity of the investment project. the bid participants declare compliance with this selection criterion only as a pop(EEDOP) - Part IV, Section A "Efficiency" of EEDOP - The document proving the requirement is a certificate / license to exercise the activities under Article 166, paragraph 1, item 1 of the TDA, or a certificate for the right to exercise the activities under Article 166, paragraph 1, item 1 of the Territory Management Act, to the persons under Article 166, paragraph 7 of the TDA, accompanied by the list ofthe able-bodied physical persons forming an integral part of it (certified copy). If the duration of the certificate / license of a participant expires before the term of the contract, the participant must also provide a declaration (free text) stating that if he is selected as a contractor, he / she undertakes to renew his / her certificate or to provide himself in accordance withWhen a participant is a foreign person, he must produce a copy of a document certifying the right to perform such activity, issued by a competent authority of a Member State of the European Union or of another State party to the Agreement on the European Economic Area, according to Art. 166 of the TDA or to submit a declaration or certificate for the presence of-such registration by the competent authorities under the relevant national law. Where a specific authorization or membership of a particular organization is required for the performance of the relevant service (construction supervision) under the law of the State in which the participant is established, the assignor shall require him to prove the existence of such authorization or membership.is the requirement to be submitted by the participant designated as contractor or upon request in the course of the procedure - in the cases of Art. 67, para. 5 and 6 of the PPL.

Not applicable. The guarantee to secure the performance of the contract is 2% of its value excluding VAT. The guarantee shall be in one of the following forms: (a) deposit of a sum of money to the account of the contracting authority;

b) bank guarantee in nthe oath of the assignor; or (c) insurance covering performance by covering the contractor's liability.

The Contractor shall choose the form of the guarantee himself. 2. Specific national grounds for exclusion (Section D, Part III of EEDOP):

A. The participant should declare the absence or existence of a final sentence for an offense under Art. 194-208, Art. 213a-217, Art. 219-252 or Art. 254a-260 of NR. The participant (he alone) should not be associated with other participants in the present procedure under Art. 101, para. 11 of the Public Procurement Act. The participant should not be established by a punitive decree or a court decision, violation of Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 228, para. 3 of the Labor Code orsimilar obligations established by an act of a competent authority under the law of the State in which the applicant or participant is established. The participant should not have the circumstances under Art. 69 of the Law for Counteracting Corruption and for Removal of the Acquired Property. Infringements under Art. 13 para. 1 of the Labor Migration and Labor Mobility Act. I'm learningshould comply with the requirements of Art. 3, item 8 and Art. 4 of the Economic and Financial Relations Act with companies registered in jurisdictions with preferential tax regime, the persons controlled by them and their real owners.
