The contract is for the Contractor to perform the function of Contract Engineer for the project entitled "Design and construction of the KG2 gas-fired boiler house in ElektrociepŻerań plant in Warsaw ".

The contract is for the Contractor to perform the function of Contract Engineer for the project entitled" Design and construction of the KG2 gas-fired boiler room at Elektrociepłownia Żerań in Warsaw ".

A detailed description of the subject of the order is provided in the contract template 19DOZZ143 constituting Annex No.4 to this Instructions for Contractors - the Contractor shall submit to the Ordering Party at his request a copy from the relevant register or from the Central Register and Information on Business, if separate provisions require entry in the register or records, to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1 of the Act

1. Contractors excluded from the proceedings are:

- nNot demonstrated fulfillment of the conditions for participation in the proceedings, or showed no grounds for exclusion, - a contractor who is a natural person who has been validly convicted of a crime: -a) referred to in art. 165a, art. 181 188, art. 189a, art. 218 221, art. 228 230a, art. 250a, art. 258 or art. 270, 309 of the Act of June 6, 1997. Penal Code (Journal of Laws, item 553, as amended) or Article 46 or art. 48 ustawa of 25.6.2010 on sport (Journal of Laws of 2016, item 176),

b) of a terrorist character, referred to in art. 115 - 20 of the Act of June 6, 1997. Penal Code, - c) treasury, - if a member of its management or supervisory body, a partner of the company in a registered partnership or partner society or a general partner in a limited partnership or limited joint-stock partnership or a proxy validI was convicted of an offense referred to in art. 24 sec. 1 point 13 (excluding the conviction of this person for the offense listed in Article 24 (1) (13) (d) of the Act Article 133 (4) of the Act), - to which a final court judgment or final administrative decision on payment was settled taxes, fees or social security or health insurance contributions, unless the Contractor has made pdue taxes, fees or social security or health insurance contributions with interest or fines, or a binding agreement on the repayment of such claims, - which - as a result of deliberate action or gross negligence - misleads the Employer when presenting information that he is not subject to exclusion, meets the conditions for participation in the proceedings or objectiveand non-discriminatory criteria, hereinafter referred to as "selection criteria", or who have concealed this information or are unable to produce the required documents;

who - as a result of carelessness or negligence - provided information that misleads the Employer that could have a significant impact on decisions taken by the Employer in Proceedings for the order -

- which unlawfully influenced orattempted to influence the Employer`s actions or obtain confidential information that could give him an advantage in the procurement procedure, - who participated in the preparation of the contract award procedure or employee, as well as a person performing work on the basis of a mandate contract, agency contract, or another contract for the provision of services, he participated in the preparation of such proceedingsia, unless the resulting distortion of competition can be eliminated in a different way than by excluding the Contractor from participation in the proceedings, - which - with other Contractors has concluded an agreement to distort competition between Contractors in the procurement procedure, which the Purchaser is able to demonstrate using appropriate evidence,

- being a collective entitym, for which the court has ruled that it is forbidding to apply for public orders, - for which a preventive measure was ordered to apply for public orders,

- Contractors who, in the same capital group, submitted separate offers, offers, unless they prove that interconnections existing between them do not lead to distortion of competition in the procurement procedure, -in relation to which the liquidation was opened or whose bankruptcy was announced, with the exception of the Contractor who, after the bankruptcy, concluded an arrangement approved by a valid court order.

Purchaser pursuant to art. 24aa paragraph 1 of the Public Procurement Law, may first evaluate the offers, and then examine whether the contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meetsconditions of participation in the proceedings. • The offer, under pain of nullity, should be made in electronic form and submitted via the Bidding Platform at https://termika.eb2b.com.pl/

Oferta with all attachments is submitted in electronic form with a qualified signature electronic or a copy certified for compliance with the original by submitting a qualificationelectronic signature by the Contractor. All documents prepared in a foreign language must be submitted together with the translations into Polish.

The offer with attachments must be signed by the person / s authorized to represent the Contractor. Authorization (power of attorney) to sign the offer should be attached to the offer, unless it is clear from other documents attached by the Contractor• By submitting its tender, the Contractor accepts in full and without reservation the conditions for the implementation of the order specified in the Terms of Reference (hereinafter referred to as "SIWZ") together with all attachments constituting its integral part.

For preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings, the Contractor attach to theerts valid as of the day of submitting bids a statement in the form of a single document available in an editable form posted on the Employer`s website. Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and fulfillment to them, to the extent on their resources, the conditions of participation in the proceedings, also in electronic form also uniform documents concerning these entities, signed by the entity whose documents relate.

In the case of joint application for contractors, the single document shall be submitted in electronic form to each of the contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of themgrounds for exclusion to the extent that each of the contractors demonstrates fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion.
