Below are the numbers fromworthy of the ToR.

3.1.1. Contractors who are not subject to exclusion from the procedure pursuant to art. 24 paragraph 1 and paragraph 5 point 1 and 8 Public Procurement Law, subject to art. 133 section 4 Public Procurement Law, and meet the conditions specified on the basis of art. 22 paragraph 1 Public Procurement Law, which according to art. 22 paragraph 1b relate to:

3.1.1.1. possessing competences or rights to run a given dayprofessional regime, if it results from separate provisions:

The Employer does not impose specific requirements in terms of meeting this condition,

3.1.1.2. economic or financial situation:

The Employer does not impose specific requirements in the fulfillment of this condition.

3.5. In order to demonstrate the lack of grounds for exclusion, the Contractor should provide the following statements and documents:

3.5.1. informafrom the National Criminal Register in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the PPL, issued not earlier than 6 months before the deadline for submitting bids or requests to participate in the procedure;

3.5.2. certificate of the competent head of the tax office confirming that the Contractor is not in arrears with taxes, issued not earlier than 3 months before expiryThe deadline for submitting bids, or another document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of outstanding payments or withholding in full the decision competent authority;

3.5.3. certificate inthe appropriate field organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund (KRUS) or other document confirming that the Contractor is not in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting offers or another document confirming that the Contractor has concluded an agreement with the right oneauthority on the repayment of these receivables, together with any interest or fines, in particular, it obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the execution of the decision of the competent authority;

3.5.4. the Contractor`s declaration that he has not issued a final court judgment or final administrative decision regarding his arrearstax, fees or social security or health insurance contributions, or in the event of a judgment or decision being issued, documents confirming payment of those debts, together with any interest or fines, or the conclusion of a binding agreement on the repayment of those debts. A specimen is attached as Annex 7 to the ToR;

3.5.5. Contractor`s statement of no judgment againstas a precautionary measure forbidding public procurement. A specimen is attached as Annex 7 to the ToR;

3.5.6. an excerpt from the relevant register or from the central register and information on economic activity, if separate provisions require an entry in the register or the register, to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 Pzp;

3.5.7. statement Performadvisers not to pay taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and fees. A specimen is attached as Annex 7 to the ToR.

Below are the numbering in accordance with the ToR.

3.6. Documents and statements submitted in the case of Contractors having their registered office or place of residence outside the territory of the Republic of Poland:

3.6.1. if the Contractor has a seatroom or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in:

3.6.1.1. point 3.5.1 above submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor has its registered office or place of residence or the place of residence, to which the information or document relates, to the extent specified in art. 24 paragraph 1 item 13, 14 and 21 Public Procurement Law issued not earlier than 6 months before the deadline for submitting bids,

3.6.1.2. points 3.5.2, 3.5.3 and 3.5.6 above submit a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming respectively that:

it is not in arrears with taxes, oppatches, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines, in particular he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the decision of the competent authority issued not earlier than 3 months before uthe deadline for submission of bids;

its liquidation has not been opened or bankruptcy has been issued not earlier than six months before the submission deadline.

3.6.2. If in the country in which the Contractor has its registered office or place of residence or place of residence there is a person to whom the document relates, the documents referred to in point 3.6.1 shall not be issued. they are replaced by the document they containa statement of the Contractor, indicating the person or persons authorized to represent him, or a statement of the person to whom the document was to relate, submitted before a notary public or before a judicial, administrative or professional or economic self-government body competent for the seat or place of residence of the Contractor or place of residence that person`s residence. Time limitsane in point 3.6.1 regarding the issue of documents shall apply accordingly.

3.6.3. The Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, to whom the document referred to in point 3.5.1 applies, shall submit the document referred to in point 3.6.1.1, to the extent specified in art. 24 paragraph 1 points 14 and 21. If in the countryin which the person to whom the document was to reside has no place of residence, no such documents are issued, it is replaced with a document containing the person`s declaration submitted to a notary public or before a judicial, administrative or professional or economic self-government body competent for the place of residence of that person persons. Dates indicated in item 3.6.1 regarding issuesand the documents shall apply accordingly.
