1. The contracting authority removes a participant who:

1.1. was convicted of having entered theforce of conviction for a crime under Art. 108a, Art. 159a - 159d, Art. 172, Art. 192a, Art. 194 217, Art. 219-252, Art. 253-260, Art. 301-307, Art. 321, 321a and Art. 352-353f of the Penal Code;

1.2. has been convicted by an enforced sentence of an offense similar to those referred to in point 1.1 in another Member State or a third country;

1.3. there are obligations for taxes and compulsory social security contributions within the meaning of Art. 162, para.2, item 1 of the Tax Insurance Procedure Code and the interest thereon to the state or municipality at the registered office of the assignor and the participant, or similar obligations established by an act of a competent authority, in accordance with the legislation of the state in which the participant is established, proved by an effective act of a competent authority;

1.4. there is inequality in the cases under Art. 44, para. 5 of HOP;

1.5. has been found to: the selection criteria;

1.6. has been established by a decree or court order that has entered into forcedecision, violation of Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 118, Art. 128, Art. 228, para. 3, Art. 245 and Art. 301-305 of the Labor Code or Art. 13, para. 1 of the Labor Migration and Labor Mobility Act or similar obligations established by an act of a competent authority under the law of the country in which the participant is established;

1.7. there is a conflict of interestthat cannot be removed;

2. The contracting authority also removes from the procedure:

2.1. a tenderer who does not meet the selection criteria or does not fulfill the other condition set out in the contract notice or in the documentation;

2.2. a tenderer who has submitted a tender that does not meet the pre-announced conditions of the contract;

2.3. a tenderer who submitted an offer thatdoes not comply with the rules and requirements related to environmental protection, social and labor law, applicable collective agreements and / or provisions of international environmental, social and labor law, which are listed in Annex 10 of the PPL;

2.4. participant who has not submitted the justification under Art. 72, para. 1 of the PPA or whose offer was not accepted in accordance with Art. 72, para. 3-5 of the Public Procurement Act;

2.5. participants who are related persons within the meaning of - 2, item 45 of the Public Procurement Act;

2.6. bidder who does not qualify for submission, incl. for form, manner and term;

2.7. participants who are registered in a jurisdictional preferential tax regime (ADR) or controlled by a person registered in the ADR or in a civil society / consortium in which a company is involvedregistered in the JDPR pursuant to Art. 3, item 8 of the Law on Economic and Financial Relations with the companies, registered in JUPDR, the persons controlled by them and their real owners (ZIFODRUPDRKLDS), unless any of the exceptions under Art. 4 of ZIFODRUPRDLDS;

2.8. participants, who were found to be applying an exception under Art.4 of the ZIFODREPDRCLDS (in accordance with Article 5, Paragraph 1, Item 3, item "a" of the ZIFODREPDRCLDS);
