1. The minimum period in which the bidder will be bound by the offer is specified in IV.2.6) as 2 months, with one month being 30 days.

2. The Ordering Party reserves the right to evaluate offers in the first place, and then to examine whether the contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions of thighsin the proceedings (Article 24aa).

3. Contractors who are not subject to exclusion from the proceedings for the award of a contract pursuant to Art. 24 sec. 1 of the Act.

In order to confirm the lack of grounds for excluding the contractor from participation in the proceedings, the Contracting Authority requires the following statements and documents:

a) Single European Order Document (EAT);

b) information from the National Criminal Record in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act;

c) the contractor`s statement that he has not issued a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums or - in the event of such a verdict or decision - documents confirms(d) a declaration by the contractor that the contractor has not been granted a preventive measure for not applying for public orders; (e) the contractor`s declaration of whether or not he is a part of the payment; affiliation to the same capital group; in casein the case of belonging to the same capital group, the contractor may submit together with the declaration documents or information confirming that connections with another contractor do not lead to distortion of competition in the proceedings (the Contractor submits the above document within 3 days from the date of placing information from the opening of offers on the website by the Contracting Authority) (Article 86 (5) of the Act)) - with referenceepisode of Chapter VI point 8 of the Terms of Reference (applicable to foreign Contractors).

4. The bid bond may be brought in one or several forms referred to in the ToR.
