A participant who meets the conditions of Art. 10, para. 1 of the Public Procurement Act. The Assignor does not have a prerequisite for the establishment of a legal entity under Art. 10, para. 2 of the Public Procurement Act. The assignor shall remove a participant for whom the grounds under Art. 54, para. 1, item 1-7 of the Public Procurement Act, Art. 55, para. 1, item 1, item 4 and item 5and Art. 107 of the Public Procurement Act, the circumstances under Art. 3, item 8 and Art. 4 of ЗИФОДРУПДРКЛТДС as well as presence of circumstances under Art. Article 69 of the Law on Counteracting Corruption and for Removal of the Acquired Assets.

Where the participant is a consortium which is not a legal entity, a copy of a document shall be provided showing the legal basis for establishing the grouping, shorter than the villagerock for the implementation of this public procurement. The document should also contain:

1. the rights and obligations of the members of the grouping; the distribution of responsibility among the members of the grouping; the activities that each member of the group will perform.

This document should unconditionally certify the designation of the partner representing the grouping for purposesof the public procurement contract and the fact that the persons in the grouping take joint and several liability jointly and severally for their participation and the performance of the contract. Any member of the consortium which is not a legal entity and subcontractors / third parties must comply with the relevant selection criteria and there should be no grounds for removal. Participant for whom there are grounds under Art.-54, para. 1, items 1-7 of the Public Procurement Act and Art. 55, para. 1, item 1, item 4 and item 5 of the Public Procurement Act shall have the right to present evidence under Art. 56 of the Public Procurement Act. According to Art. 67, para. 1 of the PPL when submitting the tender, the participant declares lack of grounds for removal and compliance with the selection criteria by presenting the ENEOP. Where the participant is an association which is not a legal entity, the submission of the tender for participation shall be submitteda separate EEDOP for each member of the grouping. A separate ENDED is submitted to subcontractors / third parties. Documents demonstrating the information specified in the enEDOP are presented under the conditions of Art. 67, para. 5 and para. 6 of the PPA. Documents are submitted by each member of the grouping that is not a legal entity and by the subcontractors / third parties. When signing the contract for the implementation of thethe tenderer designated as a contractor shall provide a guarantee for the performance of the contract at the rate of 5% of the value of the contract, exclusive of VAT. The guarantee shall be in one of the following forms: (a) bank guarantee in original; or

(b) a cash amount; or

(c) insurance covering the performance by covering the contractor's liability in the original.

Terms and Conditionsthe detention order and the release of the performance guarantee shall be governed by the contract for the award of the contract.
