1. The subject of the order is the purchase of computer equipment for the needs of the Office of the Marshal of the Lower Silesian Voivodship

1. The subject of the order is the purchase of computer equipment for the needs of the Marshall's Office of the Lower Silesian Voivodshipment.

2. A detailed description of the subject of the order and the conditions for its implementation is specified by the Contracting Authority in the contract template constituting Annex 5 to the ToR.

3. In the present proceedings, the Awarding Entity does not specify the requirements referred to in art. 29 para. 3a of the Act

1. The Employer does not specify the conditions for participation in the scope of the ability to conduct a professional activity.

2. You can apply for the orderA Contractor who is not subject to exclusion pursuant to art. 24 sec. 1 item 12-23 and para. 5 points 1, 2, 4, 8 of the Public Procurement Law Act

3. The Ordering Party may, at any stage of the proceedings, consider that the Contractor does not have the required capacities if the involvement of technical or professional resources of the Contractor in other economic undertakings of the Contractor may have a negative impact on the implementation of the order. Contractorsthey can jointly apply for a contract. The provisions concerning the Contractor shall apply accordingly to the Contractors jointly applying for the order. In the case of Contractors jointly applying for the award of the contract, the conditions referred to in point III.1) will be fulfilled if Contractors jointly applying for the award of a contract show that they jointly meet the conditionsspeech in the above at the point of announcement, or on their own, one of them (the Employer allows the possibility of combining / adding up the experience / personal potential, also when using the resources of a third party).

5. Contractors jointly applying for the award of a public order shall appoint an attorney to represent them in the proceedings or to represent them in the proceedings-and conclusion of a public procurement contract.

6. The assessment of compliance with the conditions for participation in the procedure, specified in point III.1) of the announcement, will be made in accordance with the formula "does not meet" based on the information contained in the declarations and documents indicated in point III.1) of the announcement. it is clear that the Contractor has met the above-mentioned conditionsreserves the right to verify the above documents.

7. The Contractor may, in order to confirm that the conditions referred to in point III.1) meet, in relevant situations and in relation to this contract or part thereof, rely on technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the merger stack him with himlegal unions.

8. The Employer informs that the "appropriate situation" referred to in point 7, will occur only when:

1) The Contractor, which relies on the abilities or situation of other entities, will prove to the Ordering Party that in fulfilling the order will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give it the necessary disposal

2) The Awarding Entity will assess whether the technical or professional capacity or their financial or economic situation made available to the Contractors by other entities, allow the Contractor to demonstrate fulfillment of the conditions for participation in the procedure and will examine whether the entity is subject to this exclusions referred to in art. 24 sec. 1 item 13-22 and para. 5-points 1, 2, 4, 8 of the PPL

9. The Contractor, who relies on the financial or economic standing of other entities, is jointly and severally liable with the entity that committed to provide resources for the damage suffered by the Employer due to the non-availability of these resources, unless the lack of access to resources is not at fault. The Awarding Entity does not specify the conditions of participation in the scope of the eco situationand financial account.

c.d. regarding item III.1.1) of the announcement

2. Before the deadline for submitting bids, the Contractor shall submit a statement valid as of the day of submitting bids constituting preliminary confirmation that the Contractor is not subject to exclusion from the proceedings in the circumstances indicated in Chapter V, point 1.1) of the ToR and that he meets the conditions for participation in the proceedings set out in Chapter V, point 1.2) Terms of Reference. Switchablea physical statement of the Contractor shall be submitted in the form of a Single European Order Document (EED), prepared in accordance with the specimen of the standard form specified in the European Commission Implementing Regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU (Annex 2 to the ToR). The Employer allows that within the scope of participation conditions (qualification criteria) the Contractor shall limitonly to complete the α section in part IV. EAT. The Contractor may submit a general statement to the Employer by providing a "yes / no" answer to the question whether he meets the required eligibility criteria, as a consequence he does not have to fill in the remaining sections in Part IV.

Contractor's statementso jointly applying for the award of orders and entities making the potential available on the principles set out in Article 22a of the Act shall be submitted on the form JEDZ in the form of an electronic document, signed with a qualified electronic signature by each of them in the scope in which they confirm the circumstances referred to in art. 22 ust. 1 of the Act. An analogous requirement applies to EAT splaced by the subcontractor, subject to Chapter VI point 3 of the ToR.

The means of electronic communication serving the submission of the GME by the Contractor to the Ordering Party is ePUAP.

3. In the case of Contractors, indicated in point III.1.1) point 4 of the announcement, the declaration specified in item 2 shall be submitted by each of these Contractors. This statement is to confirm the fulfillmentthe terms of participation in the procedure and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion. The Employer does not request the statement indicated in point 2 from subcontractors, unless they are entities, for resources the Contractor is calling to demonstrate fulfillment of the conditions for participation in the procedure.The lecture, which refers to the resources of other entities, to demonstrate the lack of grounds for exclusion and fulfillment in the scope in which it refers to their resources conditions of participation in the proceedings also submits the statement referred to in point 2 concerning these entities, signed by persons authorized to represent the subject of providing access.

6. Ordering party before granting the orderfor the tender, whose tender was rated the highest, to submit in the prescribed, not shorter than 10 days, the current date as of the day of submitting the following statements or documents:

a) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the act issued not earlier than 6 months before the deadline for submission of bids,

b) statements.for the issue of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or in the event of a verdict or decision confirming the payment of such claims together with any interest or fines or a binding agreement in on the matter oft of these receivables, - c) statements of the Lecturer on the lack of a ruling against him as a preventive measure of the prohibition to apply for public orders, - d) the competent head of the tax office confirming that the lecturer is not in arrears with paying taxes, issued not earlier than 3 months before the deadline of
