The subject of the order is the delivery of computer equipment and software for the Primary School in Brzeziny, Nowodworze, Skrob-w-Kolonia and Wolce Rokicka as part of the project "Modernization of school infrastructure in Lubartow commune..

1. The subject of the order is the delivery of computer hardware and software for the Primary School in Brzeziny, Nowodworze, Skrob-w-Kolonia and Wolce Rokicka as part of the project "Modernization of school infrastructure in the Lubart-w commune".

The material scope of the subject matter of the order includes:

1 ) delivery of a brand new one, i.e. unused before the day of accessarcing, excluding the use of correct work necessary for the test, originating from the official distribution channels of the manufacturer, ensuring in particular the implementation of warranty rights to hardware and software to the extent specified in Annex 1, 2, 3a and 3b to the ToR together with their transport, bringing, setting, mounting, connection, configuration and timinghomage in places indicated by the Employer,

2) training of personnel in the scope of hardware and software service,

3) delivering, along with ordering, the instruction required in the Polish language, - 4) providing technical and usage documentation related to the subject of the order, . all documents necessary for the legal use of the operating system license softwarej3 (delivered licenses should be a one-off purchase without the need to renew them or pay another fee maintaining their validity),

5) quality guarantee for a period consistent with - 10 of the contract and resulting from the Contractor's offer for delivered equipment and conditions not worse than manufacturer's warranty, confirmed by separate warranty documents provided inonce with devices.

Note:

1) For each device, the Contractor will be required to make stickers informing about co-financing of the EU project in accordance with the Managing Authority guidelines available on the website: https://rpo.lubelskie.pl/strona-592-zasady_oznakowania_projektow. html

2) Devices must have a positive impact on promoting the principle and accessibility of people with a disabilitywnościami. It is assumed that the supported infrastructure will be fully available to all potential stakeholders, including people with disabilities. The purchased equipment will be adapted to the needs of people with disabilities (eg laptops, interactive boards, visualizer adapted to the needs of visually impaired people).

3. A detailed description of the subject of the order and the place of delivery and the distributionaccommodation equipment is included in Annex 1 to the ToR

-6.1. Contractors who are not subject to exclusion and meet the conditions of participation in the procedure specified by the awarding entity may apply for the award of the contract,

-6.2. Contractors who meet the conditions concerning: -6.2.1. May apply for the award of the contract. competence or entitlements to conduct a specific professional activity, o. andle this results from separate regulations:

The ordering party does not specify the condition in the abovementioned range.

-7.1. The contractor is excluded from the contract award procedure in relation to which any of the circumstances referred to in art. 24 sec. 1 point 12 23 of the Act,

-7.2. The Contracting Authority provides for the grounds for exclusion indicated in art. 24 sec. 5 points 1, 2, 4 and 8 of the Act,

-8.1. The contractor is obliged to pay a feelive as of the day of submitting bids a statement constituting preliminary confirmation that the Contractor:

a) is not subject to exclusion,

b) meets the conditions for participation in the procedure.

-8.2. The declaration referred to in point 8.1 of the Terms of Reference is to be submitted by the Contractor in the form of a single document drawn up in accordance with the specimen of the standard form set out in the implementing regulation of the European Commission-2016/7 of 5.1.2016 issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU, hereinafter referred to as "Single Document" or "EAT" acc. Annex 4 to the ToR (information on the form and manner of submitting the EAT statement are included in item 8.2 of the SIWZ)

-8.3. Contractor within 3 days from the date of placing information on the website of the contracting party, referred to in Article 86 par. 5 acts (iinformation from the opening of tenders), is obliged to provide the orderer with a declaration of belonging or absence of belonging to the same capital group, referred to in art. 24 sec. 1 point 23 of the Act. In the case of belonging to the same capital group, the contractor may submit together with the statement documents or information confirming that connections with another contractor do not lead todistortion of competition in the proceedings. The pattern of the declaration is attached as Annex 5 to the ToR,

-9.6. The contracting authority demands from the contractor, which relies on the abilities or situation of other entities under the rules set out in Article 22a of the Public Procurement Law, present in respect of these entities the documents listed in point 8.7.2 SIWZ,

-9.8. Contractor who refers to the resources of other entities in order to demonstrateand the lack of grounds for exclusion and compliance with them, to the extent that they refer to their resources, the condition of participation in the proceedings also consists of EED regarding these entities,

-10.2. In the case of Contractors jointly applying for the awarding of orders:

a) none of them may be subject to exclusion due to non-compliance with the conditions referred to in art. 24 sec. 1 and par. 5 points 1, 2, 4, 8 of the Public Procurement Law, while fulfillment of the conditions of participation in the Contractor's proceedings are shown in accordance with point 6.2 of the ToR. The Ordering Party does not specify a special way of meeting the conditions by Contractors jointly applying for the order.

B) The Single Document referred to in point 8.2 The SIWZ is submitted by each of the contractors jointly applying for the order. These documents confirm fulfillmentthe conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the contractors shows compliance with the conditions for participation in the proceedings and no grounds for exclusion, c) a declaration of belonging to the same capital group as referred to in point 8.3 of the Terms of Reference is submitted by each of the Contractors,

d) they are obliged, at the request of the Employer, to submit documents andstatements referred to in point.8.7 of the ToR, whereby the documents and statements referred to in point. :-8.7.1 respectively submits the Contractor / Contractor, who / who demonstrates the fulfillment of the condition, in the scope and on the principles described in point 6.2 of the SIWZ,

-8.7.2 ToR shall be submitted by each of the Contractors,

-8.7.3 The ToR shall submit accordingly the Contractor / Contractor who / who indicates the confirmation of fulfillment by the offerimportant delivery of requirements specified by the Employer.

-6.2.2. economic or financial situation.

The ordering party does not specify the condition in the abovementioned in the area.

-8.11. Documents referred to in point 8.10 lit. a) and lit. b) second indent of the SIWZ, should be issued not earlier than 6 months before the deadline for submission of tenders. The document referred to in point-8.10 lit. b) the first indent of the SIWZ, should be issued no earlier than 3 months before the expiry of that period,

-8.12. If in the country in which the Contractor has its registered office or place of residence or place of residence has the person concerned, the documents referred to in point 8.10 of the ToR, it is replaced by a document containing the contractor's statement, as appropriate, with an indicationperson or persons authorized to represent it, or a statement of the person to whom the document was to be applied, submitted to a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the place of residence or place of residence of the person or place of residence. Provision of point 8.11 of the Terms of Reference, - -8.13 applies. In case of doubtsas to the content of the document submitted by the Contractor, the Employer may apply to the competent authorities of the country in which the Contractor is domiciled or domiciled or has the person concerned, to provide the necessary information about this document,

-8.14. The Contractor having its registered office in the territory of the Republic of Poland with regard to the personfor a resident outside the territory of the Republic of Poland to which the document referred to in Chapter 8 of the Terms of Reference applies, submit the document referred to in point 8.10 lit. a) SIWZ, to the extent specified in art. 24 sec. 1 point 14 and 21 of the Public Procurement Law. If in a country where the person whose document is to be residing is residing, such documents are not issued, it is replaced by a documentgranting a statement to that person before a notary or before a judicial, administrative or professional body competent for the place of residence of that person. The provision of point 8.11 of the Terms of Reference of the first sentence shall apply, - -8.15. In case of doubts as to the content of the document submitted by the contractor, the contracting authority may contact the competent authorities of the countrythe place of residence of the person the document concerns, for providing necessary information regarding this document,

-12.1. The Contractor is obliged to submit a bid bond in the amount of PLN 9, 000 (in words: nineteen thousand zlotys), - Offer must be made in writing under pain of nullity but EAT should be sent before the deadline for submission of tenders in the forman electronic version with a qualified electronic signature to the following e-mail address: ug@gmina-lubartow.pl or auctions @ gmina-lubartow.pl,

- the Ordering Party does not provide for the award of contracts referred to in art. 67 sec. 1 point 6 and 7 of the Act,

- The two-month period specified in Section IV.2.6) shall be understood as 60 days counted from the date set for submitting bids,

- Detailed information on the conditions-participation in the proceedings were included in Chapters 6, 7 and 8 of the ToR,
