Information and formalities necessary for evaluating if requirements are met:

Ofertanthird parties, supporters and subcontractors should not be found in the situations provided for in art. 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the assumptionsby completing the DUAE will only be submitted at the request of the contracting authority only by the bidders placed on the first three places in the intermediate ranking completed at the evaluation of the bids, ie after the electronic auction stage

These documents may be:

1) outstanding debts at the moment of presentation; 2) as appropriate, documents throughit is demonstrated that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; 3) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those having the power to represent them;u control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; 4) other editorial documents, as the case may be. Tenderers, third parties and subcontractors shall comply with the conflict-of-interest rules provided for in Art. 58 63 of the Law no. 98/2016 on Public Procurement.

Information and formalities necessary for evaluating if requirements are met. The economic operators submitting the tender must prove a form of registration under the law of the country of residence, make it clear that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that heis the professional capacity to perform the activities covered by the contract. Way of completing: Completion of the DUAE, when the supporting document, respectively the ONRC certificate or the foreign tenderers, equivalent document issued in the country of residence, is presented only at the request of the contracting authority upon completion of the evaluation of the tenders, only by the tenderers3 places in the intermediate rankings drawn up at the completion of the evaluation of the tenders, respectively after the electronic auction stage.

Also, the foreign legal entities have the obligation to observe all the other minimum conditions imposed in the acquisition data sheet. The required or equivalent documents will be submitted, subject to the provisions of point IV.3.6) Language of the tender --Marketing authorization / distribution authorization issued by the National Agency for Medicines and Medical Devices according to art. 18 of Order 309/2015. Way of completion: Completion of the DUAE, with the supporting document or the equivalent document for foreign tenderers only being submitted at the request of the contracting authority upon completion of the evaluation of the tenders only by the tendererthe companies that ranked the first three places in the intermediate rankings drawn up at the completion of the evaluation of the tenders, respectively after the electronic auction stage.

In the case of submitting financial offers with the same price, in view of the division, request and submit through the SICAP a new financial offer requested by the equality bidders for that position in the ranking.
