Numbering in accordance with the ToR:

The numbering according to the ToR is retained:

3.1.1. Contractors, who are not subject to exclusion from the Proceedings pursuant to art. 24 sec. 1st Pzp and paragraph 5 point 1) and point 8) of the PPL, subject to art. 133 ust. 4Pzp, and meet the conditions specified on the basis of art. 22 par. 1 PPL, which pursuant to art. 22 par. 1b concern:

3.1.1.1. The possession of competences or entitlements to conduct a specific professional activity, if it results from separate regulations.

The ordering party does not make any particular requirements to meet this condition.

3.1.1.2. Economic and financial situation.

The ordering party does not make any particular requirements to meet this condition.

3.1.1.3. Technical or professional capacity

The Contracting Authority will recognize that the Contractor meets the condition of participation in the procedure - For public order in the field of knowledge - experience if the Contractor shows up within the last 3 years before the deadlineand offers, if the period of business is shorter - during this period, due to the implementation of supplies of longwall shearers for 1000V voltage, giving their value, item, dates of completion and recipients, and attaching evidence that these deliveries have been made duly. The total value of gross deliveries made by the Contractor during the last three years before the deadline expiresat the submission of bids, and if the period of business is shorter - during this period, it must be not less than PLN 2, 500.00.00.

3.1.2. In the case of Contractors jointly applying for the award of the contract, the conditions referred to in point 3.1.1. SIWZ The Contracting Authority does not specify a special way to meet the conditions for participation in the Proceeding pursuant to art. 23 par. 5 PPL.

3.1.3. Ordering party in accordance withArt. 22d ust. 2 Pzp may, at any stage of the Procedure, consider that the Contractor does not have the required capacities if the Contractor's technical or professional resources involvement in his other business ventures may have a negative impact on the implementation of the order.

3.1.4. The Awarding Entity shall assess the fulfillment by the Contractor of the conditions of participation in the Procedure by the statement: "meets" or "does not meet" inbased on the required documents and statements and the information contained therein.

3.2. The grounds for exclusion, referred to in art. 24 sec. 5 Pzp

The Contracting Authority provides for the exclusion of Contractors from the Proceedings pursuant to art. 24 sec. 5 points 1 and 8 PPL. Proceeding from the Proceedings for awarding the contractor Exclude the Contractor:

1) pursuant to art. 24 sec. 5 point 1 Pzp - in relation to which liquidation was opened, inthe system approved by the court in the restructuring proceedings is intended to satisfy the creditors by liquidating its assets or the court ordered the liquidation of its assets pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2017, item 1508 and 2018, item 149, 398, 1544 and 1629) or whose bankruptcy was announced, except for the contractor who, the bankruptcy arrangement has been concluded by a legally binding court decision, if the arrangement does not provide for the assets under Art. 366 para. 1 of the Act of 28 February 2003 on Bankruptcy Law (Journal of Laws of 2017, item 2344 and 2491 and 2018, item 398, 685, 1544 and 1629);

2) pursuant to art. 24 sec. 5 pt 8 Pzp - which violated obligations regarding tax payments, fees or social insurance contributionsor health, which the contracting authority is able to demonstrate by means of appropriate evidence, except in the case referred to in paragraph 1 - Point 15, unless the contractor has made payment of taxes, fees or social or health insurance contributions, including interest or fines, or has made a binding agreement regarding the repayment of these debts.

Cd III. 1.1) 3.4. In order to demonstratecompliance of the Contractor with the conditions referred to in art. 22 par. 1 Pzp, the Contractor should submit the following documents / statements:

3.4.1. In order to demonstrate compliance by the Contractor with the conditions referred to in point 3.1.1.1 .: Not applicable.

3.4.2. In order to demonstrate compliance by the Contractor with the conditions referred to in point 3.1.1.2: Not applicable.

3.4.3. In order to demonstrate fulfillment by the Contractorconditions referred to in point 3.1.1.3.:

3.4.3.1. A list of deliveries made, and in the case of periodic or continuous services also performed, in the last 3 years before the deadline for submitting offers, and if the period of business is shorter - in this period, the implementation of supplies of longwall shearers for the voltage of 1000V, including their value, subject, dates madeand the entities for which deliveries have been made and attach proofs as to whether these deliveries have been made or are duly performed, whereby the evidence referred to are references or other documents issued by the entity for whose delivery were performed, and in the case of benefits periodic or continuous are carried out, and if for a justified reason for objectsthe contractor is not able to obtain these documents by the contractor's declaration; in the case of periodic or continuous services, ongoing references or other documents confirming their proper performance should be issued no earlier than 3 months before the deadline for submission of tenders. The list model is Annex 5 to the ToR.

3.5. In order to demonstrate the lack of grounds for wexclusion The contractor should provide the following declarations and documents:

3.5.1. information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the PPL, issued not earlier than 6 months before the deadline for submitting bids or motions for admission to participate in the procedure,

3.5.2. certificate of the competent head of the tax office confirming thatThe Contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the legally required exemption, postponing or spreading overdue installments into installmentsor to suspend in full the execution of the decision of the competent authority;

3.5.3. certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance premiums, issued not earlier than 3 months before the deadlineplacing an offer or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension in full of the decision of the competent authority; 3.5.4. Contractor's statement about the lack of release of wofor it a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or in the event of such a verdict or decision, documents confirming the payment of such claims together with any interest or fines or a binding agreement on repayments these receivables(template for the statement in Appendix No. 4 to the ToR)

3.5.5. declaration of the Contractor about the lack of a ruling against him as a precautionary measure prohibiting to apply for public orders (template for the statement in Annex 4 to the ToR) - Proceedings for granting a public sector order are conducted in electronic form via the Tauron Group Procurement Platform available atem: http: //swoz.tauron.pl

The numbering in accordance with the ToR is kept:

2.10. Information on the use of the reversed procedure - the Employer will not use the option provided for in art. 24aa paragraph 1 Pzp,

4.2.4.1. The Contractor is bound by the offer for a period of: 60 days

4.2.4.2. The bid validity period begins with the deadline for submitting offers.

4.2.4.3. The Contractor may extend it himselfdate of binding the offer.

4.2.4.4. The contracting authority may only once, at least 3 days before the offer binding date, request the Contractors to agree to extend the deadline by a specified period of time, not longer however than 60 days. Refusal to give consent, referred to in the previous sentence, does not result in the loss of the bid bond.

4.2.4.5. The Contractor's consent to extend the period of being bound by the offer ist allowed only with simultaneous extension of the validity period of the tender bond or, if this is not possible, with the payment of a new tender bond for the extended period of being bound by the offer.
